RECOMMENDATION
Staff recommends that the City Council approve a contract with the Law Firm of
Goldstein & Goldstein to provide representation to the City on all matters related to
Teamsters Petition for Recognition and Modification/Decertification.
DISCUSSION
On May 1, 2006 Teamsters filed a Petition for Recognition and
Modification/Decertification seeking to modify the existing general service bargaining
unit and establish a separate bargaining unit consisting solely of bus operators. This
petition resulted in a two day hearing in August and finally a recommendation by a
neutral fact finder that concluded a bargaining unit consisting solely of bus operators
was not appropriate under the City’s Employee Relations Ordinance and State law.
Teamsters also filed an unfair labor practice complaint with the Public Employment
Relations Board (PERB).
The law firm of Goldstein & Goldstein is nationally recognized as a leader in all
areas of employment and labor law. The firm handles all aspects of employment and
labor litigation and arbitration. Mr. Goldstein has been a leading labor attorney for 42
years, successfully representing public agencies before PERB and the National
Labor Relations Board (NLRB).

FISCAL ANALYSIS
The projected cost to utilize the services of Goldstein & Goldstein is an amount not
to exceed $20,000.
There are funds available in the Personnel Department budget line item
10122100.610300 – Personnel Services to cover this expenditure.

MOTION
That the City Council:
1. Approve the contract with the Law Firm of Goldstein & Goldstein to
represent the City in all matters related to Teamsters Petition for
Recognition and Decertification/Modification; and,
2. Authorize the City Attorney to prepare the proper documents and
authorize the City Manager to execute the Agreement on behalf of the
City.
