BACKGROUND:
During the Fiscal Year 2008-09 Budget process, staff met with the Budget & Finance
Subcommittee (Vice Mayor Armenta and Council Member Malsin) on a number of
occasions to discuss proposed fee increases and an equitable cost recover policy.
As a result of those meetings and internal discussions with operating departments,
staff developed a cost recovery policy and four-year implementation schedule for
each affected division. At the end of the four year implementation schedule (FY
2012-13), per the City’s financial policy, a new fee study should be conducted.
On June 23, 2008, the City Council approved the cost recovery policy and
implementation schedule, which is provided in the table below for City Council’s
reference. For additional background, a copy of last year’s staff report is also
included as Attachment 1:
DISCUSSION:
Pursuant to City Council direction, staff has adjusted fees to meet the overall division
cost recovery level identified in the table above. In addition, a few new fees have
been proposed for 2009-10. The new fees include:

• Expedited Business Tax Certificate Processing Fee is an optional fee service
being offered. An applicant typically receives their Business Tax Certificate
approximately 6 weeks after their application is filed. In some instances,
applicants may request to receive their Business Tax Certificate in a much
shorter time frame. Staff is proposing to offering that service for an additional
fee to cover the additional cost to process their application in a much shorter
period.
o Receive Certificate within 10 business days of filing application: $35
o Receive Certificate within 2 business days of filing application: $50
• Local Tax Appeal Fee: The Culver City Municipal Code sets up procedures
for requesting a refund of various local taxes (local taxes include Utility Tax,
Transient Occupancy Tax, Real Property Transfer Tax, and Business Tax). If
those refunds are denied, there is a process for the applicant to appeal that
denial upon payment of an appeal fee established by Resolution. These
types of appeals are extremely rare; however, an appeal fee should be
established. The appeal fee is established to recover some of the cost of the
administrative hearing procedure without making the fee so cumbersome it
deters appeals. This fee has been established similar to appeal fees in the
Building Safety Division, which has similar administrative processes
established to hear appeals.
• Public Notification Fee for Planning applications to cover the cost of public
notification and mailings required by the City’s Zoning Code:
o Legal notices published in the newspaper: Actual Cost
o Postcards/other mailings: $25 per 50 mailings
o A similar Public Notification Fee has also been added to the Finance
Department’s fee schedule for any required notification related to the
Committee on Permits and Licenses.
• Miscellaneous Recreation Program Fee has been proposed as a “catch all”
should any new program needs arise during the fiscal year. This fee is City of Culver City, California

proposed as actual staff costs (i.e. salary + benefits) plus any applicable
facility use fees.
• Transportation Permit – Issuance Fee ($48) to cover the City’s administrative
and processing costs for the transportation permit for oversized vehicles
using City streets. The fees for a one-way and two-way transportation
permits are regulated by the State of California; however, the State allows
local jurisdictions to charge an issuance fee to cover administrative costs.
• Miscellaneous Fees, Exhibit J, staff is recommending to expand cost recovery
for services provided by staff beyond telecommunication or cable television
franchise applications, renewals or extensions so the fees may be applied to
special situations as they arise.
With the exception of Planning, Building Safety, and Public Works fees set forth in
Exhibits D and H-1, respectively, all fees in the proposed resolution will become
effective on Monday, June 29, 2009. The fees in Exhibits D and H-1 are subject to
provisions of California Government Code Section 66017, which regulate
development processing fees, and shall become effective on Monday, July 13, 2009;
sixty days from the date of Council action this evening.
Other Post Employment Benefits (OPEB) – In addition to the new fees identified
above, a suggestion was made to include the cost to pre-fund retiree medical
insurance benefits for active employees in the fees and charges. Beginning with FY
2008-09 audited financial statements, the City will be required to report Other Post
Employment Benefits (OPEB) as a liability. Although there is no legal requirement at
this time to fund the reported OPEB liability, as a best management practice, the
City should begin identifying funding sources and setting aside funds to offset this
liability.
With that in mind, staff identified a number of methods to include OPEB costs in the
full cost for each fee activity with the idea that revenues generated from that
incremental increase in the fee would then be used to begin to pre-fund the OPEB
obligation. After considering various options and the operational logistics of
implementing those options, staff recommends increasing the full cost of each fee by
a certain percentage to account for OPEB costs. At the end of the fiscal year, that
percentage will be earmarked for OPEB costs and transferred to an irrevocable trust
once the City has established one.
Staff has calculated the percentage increase necessary to fully fund OPEB costs for
current General Fund employees as 4.6% (see table below). That is, if the City were
to include the amount necessary to pre-fund OPEB obligation for each active
employee; the total personnel cost for each active employee would increase by
approximately 4.6%, on average. City of Culver City, California

To maintain consistency with implementing increases over time to ease the financial
burden, staff would like to phase in the full cost over a three year period. Therefore,
staff proposes that 1.5% of actual fee revenues in 2009-10, 3.0% in 2010-11, and
4.6% in 2011-12 be earmarked to pre-fund the OPEB obligation.
On April 20, 2009, staff met with the Budget & Finance Subcommittee to discuss the
updated 2009-10 fees and charges schedule as well as the proposed OPEB cost
recovery strategy. Both the updated fee schedule and proposed OPEB cost
recovery strategy were well received by the Subcommittee Members.
If City Council directs staff to earmark a portion of the actual fee receipts to pre-fund
the City’s OPEB obligation, each department would fall short of cost recovery goals
by approximately 1%; any shortfall will be made up in future year fee updates.
However, due to the overall increase in cost recovery levels for each division,
earmarking a portion of these revenues would have a very minimal impact on the
projected 2009-10 deficit. Additionally, since the OPEB earmark will be based on
actual fee revenue received at year end (and therefore actual fee activity processed
by staff), any potential surplus or deficit in fee revenues will have a corresponding
increase/decrease in OPEB earmark.
Staff also recommends that the OPEB earmark be applied to the fee receipts for the
following General Fund divisions/departments: Building Safety, Engineering
(excluding Preferential Parking), Fire, Planning, and Police. At this time, staff does
not recommend that the OPEB earmark be applied to PRCS facility rental charges or
Recreation program fees. Facility rental charges should be excluded because those
fees are driven more by market rental rates than staff costs. With regard to
Recreation program fees, City Council has already increased many of those fees
(e.g. aquatics fees) and has made a policy decision to subsidize recreation
programs. Therefore, applying the OPEB earmark to Recreation fees does not have
a corresponding increase in cost recovery level, which would result in a net
decrease in General Fund levels.

If City Council directs staff to move forward with earmarking a percentage of certain
fee revenues for OPEB costs, staff will amend the User Fees and Charges section of
City Council Policy No. 5002 – Financial Policies – to include a statement that a
percentage of certain fee revenues, as determined annually by resolution of the City
Council, will be earmarked and set aside in an irrevocable trust for post employment
benefits. The amended policy will be presented to City Council as part of the 2009-
10 Budget.
PRCS Facility Rental Fees
In the fee resolution being discussed tonight, no changes are proposed to any of the
PRCS facility rental fees. PRCS staff will be returning in June to discuss updating
the facility rental fee schedule and simplifying the current category definitions.
FISCAL ANALYSIS:
User Fees & Charges
Unfortunately, due to current economic conditions, Departments expect to
experience a decrease in fee based activity over the next year and most major
economic indicators suggest that the economy has yet to hit bottom and is still
contracting. Since most of the City’s major fee revenues are derived from
construction and development related activities, which have been among the
industries hardest hit by the current recession, an overall decline in fee revenues is
expected despite increasing cost recovery levels.
Although demand for fee based services is expected to decrease, the cost to provide
those services, when utilized, is not expected to decrease. Therefore, staff
recommends that the City Council continue with the phased implementation plan
and ultimate cost recovery goals that were approved last year.
OPEB
As previously mentioned in this and other reports to City Council, the City will be
required to report the OPEB liability on the audited financial statements as of
6/30/09. There is currently no funding requirement at this time; however, as a best
financial management practice, the City should begin to identify sources of funding
and start to set aside funds wherever possible. The table below shows the amount
that may be earmarked in 2009-10 based on estimated receipts. Although this is a
relatively small amount, as the full OPEB earmark is implemented over the next
three years and the economy begins to recover, this amount should grow. Please
note that the below number is only an estimate, the actual earmark will be adjusted
at year-end based on actual revenues.

Setting aside this funding will have a very minimal impact on the projected 2009-10
deficit as the earmark will be absorbed by proposed increased cost recovery
amounts. If the City Council decides to include the OPEB earmark, then each
department would fall short of cost recovery goals by approximately 1%. The cost
recovery shortfall will be made up in future year fee updates and the recommended
cost recovery goal will still be met by FY 2012-13 as directed by City Council.
For reasons already identified, staff recommends excluding Recreation program
revenues from the OPEB earmark. Staff also recommends excluding Preferential
Parking revenues from the OPEB earmark due to City Council’s stated desire to
subsidize that program for residents. Preferential Parking revenues amount to a few
thousand dollars per year from parking permits and new parking district application
fees.

BACKGROUND:
The public hearing on this agenda item was continued from the May 19, 2008 City
Council meeting. Notices of the continuation of the public hearings were published
in local newspapers on June 19, 2008.
On June 26, 2006, the City Council adopted a resolution compiling all the City’s fees
and charges, which were previously contained in many resolutions adopted at
various times, into one document. In the 2006-07 Adopted Budget, the City Council
approved funds to hire a consultant to conduct a comprehensive study of the City’s
fees and charges. In September 2006, the City Council awarded a contract to Public
Resource Management Group (PRM) to conduct this study.
The purpose of the study was to calculate the full cost of providing each fee activity,
including direct and indirect costs. Direct costs are primarily staff’s salary and
benefit costs multiplied by the average time spent working on each fee activity.
Indirect costs consist of department overhead (i.e. utility costs, related operations
and maintenance costs, administrative support, management oversight, and support
from other departments/divisions) and city-wide overhead from the City’s Cost
Allocation Plan (i.e. support from other City departments such as Accounting and
Payroll, IT, Attorney’s Office, and Human Resources). The full cost, or actual cost,
as calculated by PRM is the maximum that the City can legally charge for each fee
related activity. PRM’s study from FY 2006-2007 is included as Attachment 2.
The actual cost of providing each service, as calculated by PRM, was then
compared to the City’s current fee for that service. PRM also provided a comparison
of current and recommended cost recovery rates for a number of California cities for
which PRM had conducted this same study. Based on this information, City staff
reviewed each fee and made recommendations to increase/decrease a number of
fees, which was adopted by City Council on May 7, 2007, by Resolution 2007-R024.
It should be noted that prior to this comprehensive fee study, each City department
brought forward its own fee resolution to request an increase during the annual
budget process. In most cases, these increases were based on the annual
Consumer Price Index (CPI) and did not take into consideration the actual direct,
indirect, and overhead costs which should be factored into the fee.
DISCUSSION:
City Council Policy 5002 – Financial Policies includes the following statements
related to user fees and charges:

1. All non-enterprise user fees and charges will be examined or adjusted annually
to determine the direct and indirect cost of service recovery rate. Where direct
services to users can be measured, the City shall consider use of appropriate
fees, charges or assessments rather than general tax funds.
2. User fees and charges for specialized services shall be established at a level
related to the cost of providing such service except where the City Council has
determined there is a public benefit to subsidize the service with tax based
revenue. The acceptable recovery rate and any associated changes to user fees
and charges will be approved by the City Council following public review.
Additionally, as a matter of good financial management, comprehensive fee studies
should be conducted every five years or so. The study conducted by PRM in 2007
was the first such study conducted by the City in more than 15 years. Consequently,
the fee adjustments adopted by City Council were significant in some cases.
Despite the significant increases, most fees were not increased to full cost recovery.
City Council may wish to increase a number of fees further to get closer to full cost
recovery.

meetings and internal discussions with operating departments, staff has developed a
revised cost recovery policy for FY 2008-09 and an implementation schedule for
each affected division over the next four years (Attachment 1). The implementation
schedule will be used by staff to increase fees incrementally over the next few years.
At the end of the four year implementation (FY 2012-13), it will be time to conduct
another fee study.
Since the nature of the fees in each division is inherently different, staff has made
the following recommendations based upon input from the Budget & Finance
Subcommittee and the operational nature of the division.

Staff is recommending a cost recovery level for land use related activities (i.e.
Building and Safety, Planning, and Engineering) between 85-95%. This is
consistent with surrounding cities. The resulting 5-10% subsidy level represents
subsidies for activities that impact residents to a larger extent. More detail on the
land use related fees is contained below:
Land Use Fee Activities:
Building & Safety: Building & Safety issues building, mechanical, plumbing, and
electrical permits and inspects contractor’s work to make sure that it complies with
local and state building codes. In most cities, Building & Safety typically has one of
the highest cost recovery rates compared to other fee related services in the City.
This is also the case in Culver City where the Division is currently recovering
approximately 85% of costs related to fee based services. Fee increases in Building
& Safety impact developers constructing large projects as well as small business
owners or residents constructing additions, remodels, and other facility repairs.
Staff is recommending an overall increase of approximately 7% in addition to the 4%
cost of living adjustment (COLA). This will bring the Building and Safety cost
recovery to approximately 92% with a proposed goal of 95% cost recovery within the
next two years.

Additionally, the current fee schedule for issuing electrical, mechanical, and
plumbing permits is very detailed and complicated. Building staff is proposing to
review their fee schedule in the upcoming fiscal year and possibly recommend a fee
structure during next year’s fee update that is easier to understand and implement.
Engineering: One of the Public Works Department/Engineering Division’s
responsibilities is issuing permits, reviewing plans, and maintaining the City’s rights-
of-way, including traffic and parking on City streets. The Engineering Division
charges many of its permits and plan checks on an hourly basis, which is currently
set at approximately 70% cost recovery.
The Preferential Parking Program and Neighborhood Traffic Management Program
(NTMP) are both heavily subsidized programs (the City only recovers approximately
30% of the cost of the preferential parking program and there is no charge for the
NTMP). Because preserving residents’ access to these two programs is important,
staff recommends maintaining the cost recovery for these programs at the existing
level by implementing only a 4% COLA.
The large subsidy in the preferential parking program significantly decreases the
Engineering Division’s overall cost recovery rate. Excluding these programs, the
Department’s overall cost recovery is approximately 70%. Staff is recommending an
increase of 10% in addition to the 4% COLA adjustment. This will bring the cost
recovery to approximately 80% (excluding preferential parking) with a proposed goal
of 85% within the next two years.
Planning: The Planning Division is responsible for ensuring that land uses in the
City comply with the City’s General Plan and Zoning Code. The fee activities
processed by the Planning Division impact developers proposing new developments
both large and small, as well as small business owners trying to expand or add
services to their business, and residents remodeling and adding living space to their
homes.
The Planning Division’s cost recovery rate prior to the fee study was 15%. For FY
2007-08, City Council adopted fees that increased the cost recovery rate to
approximately 41%. Staff is recommending another increase for FY 2008-09 to
raise the cost recovery level to approximately 64%. Staff recommends another 11%
and 10% increase in FY 2009-10 and FY 2010-11, respectively. This would bring
planning fees in line with the proposed goal of 85% cost recovery within the next
three years.
Parks, Recreation and Community Services Fee Activities:

Recreation: Recreation is a service area in which cities typically provide a higher
level of subsidy. Recreation programs include youth sports and afterschool
programs, adult sports programs, teen programs, park programs, aquatic programs,
etc. The Recreation Division is currently recovering approximately 48% of costs,
which is a relatively average recovery rate for recreation programs. After reviewing
the current cost recovery rates for each program area, staff recommends slightly
increasing a number of fees. However, because many of the fees are
recommended to stay the same while costs increase by 4%, the recommended
increases are a wash and the cost recovery rate will remain at approximately 48%.
Staff recommends that City Council adopt a proposed cost recovery rate for
recreation programs of approximately 50%.
Additionally, in order to better compete in the job market, PRCS staff will be bringing
a comprehensive package to the City Council in the near future that includes a
proposed pay rate increase for aquatics staff along with possible new fees and
charges at the Municipal Plunge.
Veteran’s Memorial Complex: Veteran’s Memorial Complex manages the facility
and room rentals for the Veteran’s Memorial Building and Auditorium, Senior Center,
and Teen Center. Currently, the Veteran’s Memorial Complex is recovering
approximately 54% of its costs. The current pricing structure allows for subsidizing
facility use at different levels, based on the classification of the person/organization
using the facility. Rental fees at the Veteran’s Memorial Complex were increased by
10% in 2006-07 and were not increased last year. An overall increase of
approximately 4% is recommended for FY 2008-09. This proposed fee increase
takes into consideration the facility rental market and the condition of the facilities
being rented.
Senior Center: Currently, the Senior Center does not charge fees for service. The
Culver City Senior Citizens’ Association (CCSCA) collects the annual membership
fee in lieu of charging user fees. The CCSCA then donates a portion of the collected
membership fees to the City. PRM’s analysis identified the full cost of providing
senior services and may be used in the future if the City decides to negotiate a
change in the current method of cost recovery.
Public Safety Fee Activities:
Fire: The Fire Department is responsible for performing safety inspections in a
number of areas, including fire safety compliance in new and existing structures,
hazardous material transport and handling, and fire alarm system installations.
Similar to the Building and Safety Division, fee increases impact developers
constructing large projects as well as small business owners and/or residents
constructing additions, remodels, and other facility repairs. In fact, the Fire

Department’s primary fee based activities are related to fire inspections on
businesses. The current fee structure provides a higher subsidy for smaller
businesses (less than 5,000 square feet) than larger businesses (larger than 5,000
square feet).
Since fire inspections are safety related and very high fees may result in people
attempting to avoid these inspections, some subsidy is recommended. Therefore,
staff is recommending fee increases to bring the Fire Department’s cost recovery
rate from 42% to 57%, with the goal of achieving 72% cost recovery within the next
three years. The most significant proposed increases are in the business fire
inspection category.
Police: The Police Department charges fees for a number of services, including
Livescan services, film permit applications, and alarm permits for alarm systems.
The Police Department currently has a strong cost recovery rate of about 85%, due
primarily to cost recovery for Livescan and alarm permit services. Staff recommends
increasing cost recovery slightly to 88%. This is due mainly to a proposed increase
in film permit application fees from $90 to $125. The ultimate cost recovery rate
recommended by staff is 90%.
Attachment 2 to this agenda report shows each fee, the current fee amount, the
recommended amount, and the cost recovery level at the proposed amount or a
brief comment. With the exception of Planning, Building Safety, and Public Works
fees set forth in Exhibits D and H-1, respectively, all fees in the proposed resolution
will become effective on Monday, June 30, 2008. The fees in Exhibits D and H-1 are
subject to provisions of California Government Code Section 66017, which regulate
development processing fees, and shall become effective on Monday, August 22,
2008; sixty days from the date of Council action this evening.
Fee Comparisons with other Cities
Comparing fees to other jurisdictions is a natural question, but unfortunately may not
provide a meaningful “apples to apples” comparison. California law (Proposition
218) mandates that local agency fees must be established at an amount that can not
exceed what it actually costs to provide the service. Culver City cannot set its fees
to be the average of other cities, or use any methodology taking into account other
cities’ fees. Culver City can only charge a fee which, at maximum, is no greater than
our costs. During PRM’s report to City Council in May 2007, they explained the
inherent difficulty of providing a meaningful fee comparison with other cities using
the absolute dollar cost of the fee due to the number of variables in policies and
procedures from city to city. A few examples of variables include: a) differences in
staff costs (i.e. the salary and benefit structure in City A may be different than City
B); b) different processes (i.e. permit approval in City A may require review by a City

Commission while approval in City B can be approved administratively by staff); c)
City A has recently completed a fee study and knows the full cost of providing their
service while City B has not done a fee study and doesn’t have a clear idea of the
cost to provide services; or d) a policy decision in City A to keep fees low (and
potentially provide the difference between the fee and actual costs as a subsidy from
the General Fund) versus a policy decision in City B to keep fees close to or at
actual costs (thereby minimizing the subsidy required from the General Fund).
According to PRM, the only way to approach some sort of meaningful comparison is
to compare cost recovery levels for each group of fees against cost recovery levels
in other cities who have had a fee study completed recently. Page 139 of
Attachment 3 shows a comparison prepared by PRM as part of their fee study that
compares cost recovery levels in Culver City to those in other cities that PRM
conducted a similar study. This was prepared in an attempt to hold some of the
variables constant, such as differences in payroll, differences in process, and
different fees, and focus primarily on the policy decision of cost recovery level. As
the comparison shows, Culver City was on the low end of cost recovery. With the
adoption of the fee increases last fiscal year, Culver City was brought more into line
with the comparison cities as it relates to cost recovery, but is still on the lower end.
FISCAL ANALYSIS:
Most fees collected by the various departments are placed into the General Fund
and are used to fund general City services such as public safety, public works
projects and maintenance, parks maintenance, and recreation programs, among
others.

In preparing the revenue projection in the above table, staff assumed a 4% increase
in fees when projecting the 2008-09 and 2009-10 revenues for the proposed budget.
If the fee resolution is adopted by City Council, as proposed, the fee projections for
2008-09 and 2009-10 may need to be increased. However, due to the current
economic uncertainty, especially in the real estate and financial markets, the Chief
Financial Officer recommends waiting until mid-year to make any adjustments to the
budget.

The current state of the real estate and financial markets may have a significant
negative impact on all construction activities, from large developments to smaller
home remodels. Developers are finding it increasingly difficult to get construction
financing, causing them to delay development plans. Additionally, home values are
rapidly declining, which is negatively impacting homeowner equity. As a
homeowner’s equity decreases, they are less likely to use their equity to remodel or
make upgrades to their home. If homeowners are not remodeling and developers
are not developing, then permit and inspection activities will decline, consequently
decreasing the revenues generated by those activities.
The economic uncertainty is further compounded by continuing price increases for
food, fuel, and other raw materials. Additionally, Federal Reserve Board Chairman
Ben Bernanke has alluded to the Federal Reserve Board taking action toward the
end of the summer by beginning to slowly increase interest rates. All of these
factors have a negative impact on consumers’ disposable income and discretionary
spending habits, which will adversely affect Culver City’s sales tax revenue. At this
point, the extent and duration of this impact is not known.
Due to these economic factors, potential additional revenues from an increase in
fees may be offset by a decrease in development and spending activity in the City.
Therefore, the Chief Financial Officer recommends a conservative “wait and see”
approach before making significant adjustments to revenue projections.

2. The rates for trash pick-up from the community compactors shall be as follows:
a) Collection Fee for Restaurant Businesses: The fee is $140 for a restaurant
with an average size of 2,582 square feet. The rate is increased or decreased
by dividing the square footage of a restaurant by 2,582 and multiplying that
number by $140.
b) Collection Fee for Non-Restaurant Businesses: The fee is based on a rate of
$50 for a commercial business with an average size of 4,829 square feet.
The rate is increased or decreased by dividing the square footage of a business
by 4,829 and multiplying that number by $50, the product will be disposal rate.
c) Administrative Fee for All Users: A fixed fee of $80 shall be charged to
businesses participating in the community compactors in addition to the
collection fee. This charge is required to cover maintenance of the compactors,
lease-purchase of the compactors and scheduled cleaning of the compactors
areas.

Refuse Collection fees for compactors installed as part of the Downtown Culver City Paseo Improvement
(CCMC 5.01.065, R-3069)*:
1. Community Compactors: Compactors are those which are installed in the Culver City Downtown as part
of the Downtown Culver City Paseo Improvement Project. Downtown businesses place their refuse in City
provided compactors that are serviced by refuse collection vehicles. Basic collection service is provided for
three (3) 4-cubic yard compactors and, one (1) 15-cubic yard compactor on a weekly basis. Fees are
assessed to downtown businesses based on business type (restaurant or other) and size (square feet)
through the Finance Department.
3. The Refuse Collection Fee set forth in Section 2, above, shall be collected pursuant to billing procedures

The following fare schedule is hereby adopted for all scheduled routes of the Culver
City Municipal Bus Lines, as follows:
The adult bus fares shall be seventy-five cents ($0.75) per fare. Such fare may
be paid in cash or by using a TAP card.
The fare for an inter-agency transfer shall be ten cents ($0.10) for senior citizens
and disabled persons and twenty-five cents ($0.25) for all others.
The student bus fare for kindergarten through high school students (12
th
Grade),
shall be fifty cents ($0.50). Such fare may be paid in cash by students
presenting a currently validated identification card issued by a recognized
educational institution or by using a student TAP card.
The bus fare for senior citizens, 62 years or more of age, and disabled persons,
other than the blind, presenting a valid identification card issued by the federal or
state government, by the City of Culver City or by other Los Angeles County
Transportation Operators’ Association members shall be thirty-five cents ($0.35).
An orange discounted TAP card may also be used for fare payment.
Free transportation shall be provided on all regularly scheduled buses of the
Culver City Municipal Bus Lines for all City employees and for all blind persons
within the definition of the California Welfare and Institutions Code §19153,
whose blindness has been so certified as required by said Section.
There shall be no charge for an intra-line transfer.

To protect the public health, safety and welfare, if additional staff time is required by an
activity that is beyond the normal scope of staff's work duties, to evaluate each application
from telecommunications companies regarding proposed provision of telecommunication
services and/or use of the City’s public-rights-of-ways for the installation of wires, conduits,
mechanisms and/or facilities. The complexity and extent of telecommunication laws and
regulations may require the City to obtain outside consultation to protect the public health,
safety and welfare and the City is authorized to charge fees to the user for services
rendered.
For any staff support required by a position that is not listed above, the City shall
charge actual costs plus a twenty-five percent (25%) administration fee. Actual costs
shall be calculated as hourly salary plus benefits (including City tax liability, health
insurance benefits, retirement and deferred compensation benefits, workers'
compensation insurance costs, etc.)

OUTSIDE LEGAL, ENGINEERING, OR CONSULTING SERVICES:
Any telecommunications company user whose application service requires the retention of
legal, engineering, or other outside consulting services by the City shall reimburse the City
for the actual costs for said services plus an twenty-five percent (25%) administrationve fee
of twenty-five percent (25%).
PUBLIC HEARING COSTS:
DIGITAL IMAGING AND STORAGE OF PLANS AND DOCUMENTS AND TECHNOLOGY
IMPROVEMENTS FEE:
California Health and Safety Code §19850 requires local jurisdictions to maintain official
copies of the plans of every building for which a building permit has been issued. California
Health and Safety Code §19852 allows the City to recover the costs of maintaining official
copies of building plans through the imposition of fees.
Any other direct costs incurred by the City directly related to services rendered to a particular
user an application by a telecommunications company shall be reimbursed to the City by the
user applicant. The City may require a user telecommunications company to pay a deposit
for an amount to cover the estimated staff time and other costs related to the service
application. The applicant user shall receive an invoice detailing the components of the
estimate and payment shall be made to the City of Culver City prior to action on the
application. If the actual cost exceeds the amount of the deposit, the user applicant shall pay
the balance due before any easement is granted or other permit issued. If the deposit
exceeds the actual costs, the applicant user shall be reimbursed the balance within thirty (30)
days of completion of the service application process.
For each notification for a public hearing to be held before the City Council or any City Board
or Commission empowered to hear the related matter related to a telecommunication
company’s application, a fee of one hundred dollars ($100.00) shall be charged, the
applicant shall reimburse the City for the cost of publication in an adjudicated newspaper, if
required. The applicant shall also pay a fee of $25 per 50 postcards/mailings, if required, to
reimburse the City for related costs.

In addition to any other fees, a permit fee surcharge totaling four percent (4%) of any
building, mechanical, plumbing and/or electrical permit and plan check fee; Planning
discretionary review and Planning permit and plan check fee; Fire Prevention permit
and plan check fee; or Engineering permit and plan check fee is hereby adopted and
shall be paid by the applicant prior to the issuance of any such permit.
The surcharge shall be used by the City solely to fund digital imaging and storage of
plans and documents and technology improvements and maintenance to enhance
customer service.
The City Manager, upon the recommendation of the Community Development
Director, may waive the fee established herein when the applicant is another
governmental agency or 501(c)(3) charitable nonprofit organization headquartered in
the City of Culver City.
