City of Culver City, California Agenda Item Report RECOMMENDATION: Staff recommends the City Council adopt an Ordinance adding a Subchapter entitled Very High Fire Hazard Severity Zone to Chapter 9.02 of Title 9 of the Culver City Municipal Code, to designate certain properties in the Culver Crest area a Very High Fire Hazard Zone (VHFHSZ). BACKGROUND/DISCUSSION: At the City Council meeting of September 24, 2012, after consideration of public and staff input, the City Council introduced the VHFHSZ Ordinance by a unanimous vote (5-0). The ordinance is brought back tonight for adoption. FISCAL ANALYSIS: Adoption of this Ordinance does not create a fiscal impact. ATTACHMENTS: 1. VHFHSZ Ordinance 1-3 ORDINANCE NO. 2012- AN ORDINANCE OF THE CITY OF CULVER CITY, STATE OF CALIFORNIA, ADDING A SUBCHAPTER ENTITLED VERY HIGH FIRE HAZARD SEVERITY ZONES TO CHAPTER 9.02 OF TITLE 9 OF THE CULVER CITY MUNICIPAL CODE, TO DESIGNATE CERTAIN PROPERTIES IN THE CULVER CREST AREA A VERY HIGH FIRE HAZARD SEVERITY ZONE (VHFHSZ) WHEREAS, the California Department of Forestry and Fire Protection (CAL FIRE) is mandated by Public Resources Code sections 4201-4204 and Government Code sections 51175-89 to identify very high fire hazard severity zones (VHFHSZ) statewide in local areas of responsibility (LRA) such as the City of Culver City; and WHEREAS, CAL FIRE has identified a section of the Culver Crest neighborhood in the City of Culver City as a VHFHSZ; and WHEREAS, pursuant to Government Code section 51179, the City is required to designate by ordinance the VHFHSZ in its jurisdiction. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF CULVER CITY, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: Chapter 9.02 of Title 9 of the Culver City Municipal Code, entitled "Fire Prevention," is hereby amended to add a subchapter entitled VERY HIGH FIRE HAZARD SEVERITY ZONES as follows: Very High Fire Hazard Severity Zones 9.02.400 Designation of Very High Fire Hazard Severity Zone (a) The City Council designates a Very High Fire Hazard Severity Zone as recommended by the Director of the California Department of Forestry and Fire Protection, and as designated on a map entitled Very High Fire Hazard Severity Zones in LRA - As Recommended by CAL FIRE, dated September, 2011. 1 (b) The VHFHSZ map shall be kept on file in the City Clerk's office 2 of the City, and in the Fire Prevention Division offices. 3 4 SECTION 2: Nothing in this Ordinance shall be construed to affect 5 any suit or proceeding impending in any court, or any rights acquired, or 6 liability incurred, or any cause or causes of action acquired or existing, under 7 any act or Ordinance hereby repealed as cited in Section 1 of this Ordinance; 8 nor shall any just or legal right or remedy of any character be lost, impaired or 9 affected by this Ordinance. 10 SECTION 3: Pursuant to Section 619 of the City Charter, this 11 Ordinance shall take effect thirty (30) days after its adoption. Pursuant to 12 Section 616 and 621 of the City Charter, prior to the expiration of fifteen (15) 13 days after the adoption, the City Clerk shall cause this Ordinance, or a 14 summary thereof, to be published in the Culver City News and shall post this 15 Ordinance or a summary thereof in at least three (3) places within the City. 16 SECTION 4: City Council hereby declares that, if any provision, 17 section, subsection, paragraph, sentence, phrase or word of this Ordinance is 18 rendered or declared invalid or unconstitutional by any final action in a court 19 of competent jurisdiction or by reason or any preemptive legislation, then the 20 City Council would have independently adopted the remaining provisions, 21 sections, subsections, paragraphs, sentences, phrases, or words of this 22 Ordinance, and as such they shall remain in full force and effect. 23 APPROVED and ADOPTED this day of 2012. 24 26 ANDREW WEISSMAN , MAYOR 27 City of Culver City, California 28 -2- ATTEST: APPROVED AS TD FORM: 4 5 Martin Cole City Clerk i v-C -AROL A.
