RECOMMENDATION
Staff recommends the City Council approve a professional services agreement with Degenkolb Engineers for soft story seismic retro-fit consultant services for a term up to one year in the amount not-to-exceed $170,370, plus up to $3,000 for reimbursable expenses.
BACKGROUND/DISCUSSION
On September 11, 2018 the City Council authorized issuing a Request for Proposal (RFP) to for consulting services to prepare a citywide soft story survey and related Soft Story Ordinance.
On September 20, 2018, the City published RFP #1903 Soft Story Seismic Retro-Fit Consultant Services, in accordance with City specifications. Seven proposals were received and opened on October 25th, 2018. The City received proposals from the following firms:

The five most qualified firms were interviewed, and evaluated based on their expertise and experience providing soft story consultant services to municipal governments. The firm most qualified and with the most experience with local government agencies is Degenkolb Engineers, which is recommended to complete the project. Degenkolb has completed similar projects in the cities of West Hollywood, Santa Monica, Beverly Hills and Pasadena.
If the City Council approves entering into an agreement with Degenkolb Engineers, staff will begin the process to negotiate a final agreement. Staff requests authority to make minor and insubstantial modifications to the agreement, provided that any such changes do not result in an increase to the final contract price in excess of the City Manager’s contract authority.
FISCAL ANALYSIS
The total cost for the Soft Story Seismic Retro-fit Consultant Services is $173,370 including reimbursable expenses. There are sufficient funds appropriated in the Community Development Department's Fiscal Year 2018/19, as included in 10150150.619800 to cover the cost of this procurement.

MOTIONS
That the City Council:
1. Approve a professional services agreement with Degankolb Engineers for Soft Story Seismic Retro-fit Consultant Services for a term up to one year in an amount not-to-exceed $170,370, plus up to $3,000 for reimbursable expenses; and,
2. If City Council approves the agreement with Degenkolb Engineers, authorize staff to negotiate the final terms of the agreement, provided the final contract price does not increase more than the City Manager’s contract authority; and,
3. Authorize the City Attorney to review/prepare the necessary documents; and,
4. Authorize the City Manager to execute such documents on behalf of the City.
