RECOMMENDATION:
Staff recommends the Culver City Redevelopment Agency (“The Agency”) approve
a professional services agreement with The Nickerson Company, with a not-to-
exceed fee of $30,000 to provide on an as-needed basis support to the Public Works
Department/Engineering Division for general public works inspection on the
Exposition Light Rail Transit Project.
BACKGROUND:
The Metropolitan Transportation Authority (Metro) has proposed to construct a 9.6-
mile light rail transit line to run along the Metro-owned Exposition Right-of-Way from
the existing Metro Light Rail Transit (LRT) station at 7th/Metro Center in downtown
Los Angeles to Venice/Washington in Culver City. This is known as Phase 1 of the
project.
The Exposition Metro Line Construction Authority (Authority) was created by the
California State Legislature to oversee the final design and construction of the
Exposition Light Rail Transit (Expo LRT). Phase 1 of the Expo LRT, which consists
of 3 segments (A, B, and C), is currently under construction or in the process of
design. The groundbreaking for Phase 1 occurred in early 2006.
Segment “C” is the Culver City portion of the project and a portion of the project to
the east of Wesley Street is currently in review at the 100% design stage. This
portion of the project will involve the realignment and reconstruction of National
Boulevard and related facilities between the City’s eastern boundary and Schaefer

Street. This work will occur in the City’s public right-of-way and will require
inspection by a public works inspector.
The Public Works Department/Engineering Division has one full-time Public Works
Inspector and relies on consultant support for public works inspection on special
projects such as this. There are currently multiple large projects under construction
in the private development sector such as Fox Hills Mall renovation/expansion, Sony
Studios new office buildings and parking structure adjacent to Culver Boulevard and
Motor Avenue, and Culver Studios expansion. All of these projects, in addition to
Caltran’s I-405 widening project, utility companies’ work, and other private
development occupy the time of the City’s single Public Works Inspector. Therefore,
it is necessary to use consultant inspection services for the Expo LRT project.
DISCUSSION:
The Agency has taken actions to ensure that design and development of the Expo
LRT project is accomplished to mitigate the impacts to the community and public
facilities.
As part of the Agency’s strategy regarding the Expo LRT project, the Agency has
retained consultants to provide specialized expertise and services. In order to
determine if the project related improvements affecting the public rights-of-way are
constructed according to approved plans and to adequately ensure that field
conditions are accurately assessed, knowledgeable and reliable ongoing City
representation at the construction site is necessary. Due to City existing and
anticipated public works inspection work load on other projects, we believe it is
necessary to rely on consultant assistance. Our belief is based on the complexities
of the project and the need to meet the project’s design/construction schedule
requiring timely and quick response to inspection requests and response to
unanticipated conditions.
In October, 2004, the City Council approved a contract with The Nickerson Company
for general public works inspection services. Vern Nickerson of The Nickerson
Company, is a retired Culver City Senior Public Works Inspector, who has over
eighteen years of experience inspecting public works projects in the City.
FISCAL ANALYSIS:
As stated above, The Nickerson Company is currently under contract with the City to
provide general public works inspection support to the Engineering Division. Staff
proposes a separate Agency contract with The Nickerson Company for the not to
exceed amount of $30,000 over the approximately 2 year construction period, in
order to pay on an as-needed basis for the work that it performs inspecting the
construction of Expo LRT project improvements relating to City facilities.

• Construction Inspector 268 hours (69%) x $85.00 per hour
• Assistant Construction Inspector 120 hours (31%) x $60.00 per hour
NOTE: All rates are effective to December 31, 2008. There will be an adjustment in
billing rates for 2009 as measured by the Consumer Price Index (CPI) from
December 2007 to December 2008.
There are sufficient funds in Account Number 59190400.612100 (Engineering
Services) to fund the $30,000 contract with The Nickerson Company.

That the Agency:
1) Approve a Professional Services Agreement with The Nickerson Company to
provide as-needed general public works inspection support for the Engineering
Division’s on the Exposition Light Rail Transit Project at a not-to-exceed fee of
$30,000, and,
2) Authorize the Agency General Counsel to review/prepare the necessary
documents and authorize the Executive Director to execute such documents.
