RECOMMENDATION
Staff recommends the City Council adopt an ordinance repealing and replacing Chapter 9.02, Sections 9.02.005-9.02.075 (“Fire Code Adoption and Amendments”), and 9.02.200-9.02.240 (“Fireworks”) of Chapter 9.02 of Title 9 of the Culver City Municipal Code (CCMC) and adopting by reference the 2016 California Fire Code (CFC) with local amendments.
BACKGROUND/DISCUSSION
At its meeting of December 12, 2016, the City Council (by a vote of 5-0) introduced, for first reading, an ordinance repealing and replacing CCMC Chapter 9.02, Sections 9.02.005-9.02.075 (“Fire Code Adoption and Amendments”), and 9.02.200-9.02.240 (“Fireworks”) with the proposed Ordinance adopting the 2016 CFC with local amendments.
During the course of Council’s discussion, a question was raised as to whether the City would be able to potentially conduct a fireworks show for the Centennial. The answer is yes. CCMC Section 9.02.020, amending Fire Code Section 105.6.15.1, states, “The City Council, by resolution, upon written application as provided in this Subchapter and subject to the provisions of this Subchapter, may grant two (2) permits to conduct a public display of fireworks in a calendar year, each display to occur on a separate date. The City Council may by resolution, grant an additional special permit for a public fireworks display sponsored by the City.” Thus, the City may grant permits for up to three fireworks displays each calendar year.
Additionally, Section 105.6.15.3 states that permits may be granted for a 4th of July celebration and the High School’s homecoming; however, these events are not mandatory and the permits are not dedicated solely to those two events. A language change was made when the 2013 Fire Code was adopted (changing “shall” to “may”), to allow City Council flexibility in granting the fireworks permits.
Accordingly, staff presents the Ordinance this evening for adoption, as introduced.
FISCAL ANALYSIS
There is no direct fiscal impact related to the adoption of this ordinance.
