RECOMMENDATION:
Staff recommends the City Council (1) approve the purchase of Kompan playground
equipment in an amount not to exceed $96,000 from U.S. Communities; (2) approve
the final plans and specifications; and, (3) authorize the publication of a notice
inviting bids for the Fox Hills Park Playground Project (PZ958).
BACKGROUND:
During the Fiscal Year 2011/2012 Budget process, $250,000 was allocated for the
Fox Hill Park Playground Project (PZ958). In Fiscal Year 2011/2012, the Parks
Division of the Parks, Recreation and Community Services Department was
managing and/or working on several park-related projects, including the installation
of new court surfacing, windscreens and fences at various parks, the installation of
new PAR Course exercise equipment at Blanco and Fox Hills Parks, the El Marino
Park and Culver City Park Playground Projects and adding additional elements to
the Veterans’ Memorial Park Playground and Picnic Area, among other projects and
on-going maintenance tasks. Therefore, the funding for the Fox Hills Park
Playground Project was carried over during the Fiscal Year 2012/2013 Budget
process, and the Project is currently one of the Parks Division’s top priorities.

To gather preliminary information for the Fox Hills Park Playground Project (PZ958),
staff obtained playground designs and informal quotes for the purchase and
installation of playground equipment from four playground equipment manufacturers.
As a result of this process, staff determined the playground design submitted by
Kompan and the company’s composite play equipment would best meet the criteria
for (1) providing physically challenging play; (2) optimizing psychological
development through mentally stimulating play opportunities; and (3) compliance
with the Federal Accessibility Guidelines for the physically challenged.
Kompan, Inc., a leader in the playground industry and one of the primary suppliers of
playground equipment and parts for the City of Culver City, manufactures state-of-
the-art products of high quality and durability. In addition, Kompan offers an
excellent warranty policy on its equipment. Kompan equipment is in use at Lindberg
Park, the Veterans’ Memorial Park playground for children ages 2 – 5, and the
recently completed and overwhelmingly popular playground at Culver City Park,
which also features a playground design by Kompan.
Staff received a sales proposal for twenty (20) Kompan products, two age
appropriate signs, freight and sales tax totaling $87,405.42. This quote includes a
discount of $9,988.20 for the Kompan products. If approved, the purchase will be
made through a contract that the City has with U.S. Communities, a Government
Purchasing Alliance; Kompan is a “supplier partner” of U.S. Communities and it is
due to the City’s agreement with U.S. Communities that product discounts are
available. The Parks Manager would like to add a contingency amount of
approximately 9.75% to cover any unforeseen circumstances and/or change orders,
bringing the total request for purchase approval to $96,000.
Pursuant to Culver City Municipal Code Section 3.07.075, purchases of goods and
services exceeding $30,000 in a single fiscal year must be formally bid and
approved by the City Council. However, CCMC Section 3.07.045.C provides an
exception to the formal bid provision when it is determined that there is only one
source for the required equipment, good, supply or service. Kompan, as do many
playground manufacturers, has authorized Sales Representatives that cover
assigned regional areas for their product. Purchases in a certain region can only be
made through the Sales Representative for that particular area for Kompan product.
This includes competitive bids for contractors on a Capital Improvement Project as
well as individual municipalities making direct purchases for replacement parts or
completely new equipment. Staff has obtained and filed with the
Purchasing/Procurement Division a letter from Kompan confirming that it is a sole
source provider.
Fox Hills Park Playground Project

Fox Hills Park Playground will undergo a complete renovation of the playground
area for children ages 2 – 5 and the area for children ages 5 – 12. The new
equipment will be installed to promote a variety of physically and mentally
challenging play activities. The new playground will be 100% accessible, including
the addition of ADA ramps that will provide accessible routes for children of all ages
and abilities. The existing sand fall surface will be replaced with Engineered Wood
Fibar, which is also an American Society for Testing and Materials (ASTM) certified
accessible surface and safe loose fill fall surface.
It is anticipated that, if approved by the City Council at this evening’s meeting, the
playground equipment will be purchased as soon as possible, the Notice Inviting
Bids will be published in the Fall of 2012, and construction will begin in late 2012 or
early 2013.
FISCAL ANALYSIS:
There are currently funds available totaling $250,000 for the Fox Hills Park
Playground Project; $80,000 in Park Facilities (Quimby) Funds in Account Number
41980000 PZ958 and $170,000 in Capital Improvement and Acquisition (General)
Funds in Account Number 42080000 PZ958.
MOTIONS:
That the City Council:
1. Approve the purchase of Kompan playground equipment in an amount not to
exceed $96,000 from U.S. Communities; and,
2. Approve the final plans and specifications; and,
3. Authorize the publication of a notice inviting bids for the Fox Hills Park
Playground Project (PZ958).
