RECOMMENDATION:
Staff recommends the City Council reopen the public hearing to receive public
comment, if any, regarding the appeal of the Planning Commission’s denial of the
Site Plan Review, Administrative Use Permit and Administrative Modification for a
proposed mixed use development at 9900 Culver Boulevard; and continue the public
hearing to September 10, 2007 for further comment by the applicant and public, and
discussion and decision by the Council.
PROCEDURE:
1. Mayor calls on staff for a brief staff report.
2. Mayor reopens the public hearing to allow for public comment, if any. (At the
Council meeting of July 23, the Council adopted a motion closing the public
hearing.)
The following procedures will be carried-over to the evening of September 10, 2007:
3. Receive further comment from the applicant and public.
4. Mayor seeks a motion to close the public hearing after all testimony has been
presented.
5. Council discusses the matter and arrives at its decision.

BACKGROUND/DISCUSSION:
On July 9, 2007, the Council held a public hearing to consider the appeal of the
Planning Commission’s denial of the Site Plan Review, Administrative Use Permit
and Administrative Modification for a proposed mixed use development at 9900
Culver Blvd. The public hearing was continued to July 23, 2007, for further
consideration, during which it was again continued to August 6, 2007.
Staff was subsequently informed by the appellant that he will not be available for the
August 6
th
hearing, and that he does not wish for the appeal to be considered in his
absence. Staff therefore recommends the appeal be continued to September10,
2007.
FISCAL ANALYSIS:
The continuation of this item will have no fiscal impact to the City. The detail of fiscal
impact will be provided on September 10
th
report.
