RECOMMENDATION:
Staff recommends the City Council adopt an Ordinance to change the zoning from
Commercial Neighborhood (CN) to Commercial General (CG) for property located at
12402 Washington Place and waive further reading.
BACKGROUND/DISCUSSION:
On July 25, 2007, the Planning Commission adopted Resolution No. 2007-P014
conditionally approving Site Plan Review, SPR P-2007073, to allow the construction
of a 41,802 square-foot, 4-story, 56-foot tall commercial building, Administrative Use
Permit, AUP P-2007072, to allow tandem parking, and recommending approval of
Zoning Code Map Amendment, ZCMA P-2007075, to change the property zoning
designation from Commercial Neighborhood (CN) to Commercial General (CG) and
Tentative Tract Map, TTM P-2007074, to subdivide the property into 30 commercial
condominium airspace units.
At the City Council meeting of September 24, 2007, the Council adopted Resolution
No. 2007-R052 to approve Tentative Tract Map, TTM P-2007074, to subdivide the
property into 30 commercial condominium airspace units and introduced the
Ordinance to approve the Zoning Code Map Amendment by a 4-1 vote. The
Ordinance is being brought back for second reading and adoption.

There is no fiscal impact associated with this item at this time. .
ENIVORNMENTAL ANALYSIS
No additional environmental analysis is needed for this Council action, pursuant to
State CEQA Guidelines section 15162, because this action is for the same project
for which the Planning Commission already adopted a negative declaration and no
new environmental information has been made available since that adoption of that
document.
