RECOMMENDATION:
Staff recommends the City Council adopt a Resolution requesting the Public
Employees’ Retirement System (PERS) to extend the 960 hour calendar year
maximum for Andrea Daroca, Interim Chief Financial Officer Designate and PERS
retiree.
BACKGROUND:
The services of Andrea Daroca, a PERS retiree, were engaged by the City of Culver
City by the City Manager on June 15, 2006 in the roll of financial consultant. As a
PERS Retiree, Ms. Daroca can be employed by a PERS agency for up to 960 hours
in any calendar year without forfeiting her retirement benefits.
Per California Public Employees’ Retirement Law, Article 8, Section 21221
(Retirement Law) entitled, Conditions and Limitations on Service After Retirement,
“A retired person may serve without reinstatement from retirement or loss or
interruption of benefits provided by this system, as follows:
(h) Upon appointment by the governing body of a contracting agency to a
position deemed by the governing body to be of a limited duration and
requiring specialized skills or during an emergency to prevent stoppage of
public business. These appointments, in addition to any made pursuant to
Section 21224, shall not exceed a total for all employers of 960 hours in
any calendar year. When an appointment is expected to, or will, exceed
960 hours in any calendar year, the governing body shall request approval
from the board to extend the temporary employment. The governing body
shall present a resolution to the board requesting action to allow or

disallow the employment extension. The resolution shall be presented
prior to the expiration of the 960-hour maximum for the calendar year.
The appointment shall be deemed approved if the board fails to take
action within 60 days of receiving the request. Appointments under this
subdivision may not exceed a total of one year.”
DISCUSSION:
Ms. Daroca was engaged to assist the City Manager in evaluating the City’s financial
operations. On February 12, the City Council received a report from the City
Manager entitled “A Report from the City Manager on Implementation of Right-Sizing
by Zero Based Staffing including Authorization of the Creation of and Recruitment
for the Position of Chief Financial Officer.” At that time, the City Council authorized
the creation of the position of Chief Financial Officer, directed staff to create a
proposed Classification Specification, and remanded the proposed Classification
Specification to the Civil Service Commission for consideration at their meeting in
March, 2007.
It is anticipated Ms. Daroca will continue in her role as financial consultant until such
time as the Classification Specification for the position of Chief Financial Officer is
approved by the City Council (expected as early as March 12, 2007). At that time,
the City Manager intents to appoint Ms. Daroca to the position of Interim Chief
Financial Officer. Upon appointment in that capacity, it is expected that Ms. Daroca
will exceed the 960 hours referenced in the Retirement Law.
FISCAL ANALYSIS:
It is expected Ms. Daroca will provide an average of 20 hours of service each week
at an hourly rate of $95. Assuming appointment on March 13, 2007, there will be
approximately 16 weeks remaining in Fiscal Year 2006/2007. This yields an
additional cost of $30,400 for the remainder of Fiscal Year 2006/2007.
It is expected that this contract can be absorbed in existing appropriations. The
major source of anticipated savings is from the City Manager’s Office ($30,000 in
contractual services for Cable Television Inspection Services which will not be
incurred by the City). Therefore, a budget amendment is not necessary.
As mentioned in the February 12, 2007 staff report, it is anticipated the appointment
of a Chief Financial Officer will occur in July/August of 2007. Funding for Ms.
Daroca’s contract and for the position of Chief Financial Officer will be included in
the proposed Budget for Fiscal Year 2007/2008.City of Culver City, California

EMPLOYMENT EXTENSION FOR A PUBLIC EMPLOYEES'
RETIREMENT SYSTEM (PERS) RETIREE
WHEREAS, the City of Culver City appointed Andrea Daroca, a Public
Employees' Retirement System retiree, as an interim employee with an assignment of limited
duration and requiring specialized skills, on June 15, 2006; and,
WHEREAS, Andrea Daroca is expected to reach her maximum of nine hundred
sixty (960) hours this calendar year on or about August 31, 2007; and
WHEREAS, due to the current unavailability of a permanent Chief Financial
Officer with the depth of experience of Andrea Daroca to complete projects that are essential
to the effective functioning of the City.
NOW, THEREFORE, the City Council of the City of Culver City, California,
DOES HEREBY RESOLVE as follows:
1. That the CalPERS Board of Administration be requested to approve an
extension for the temporary employment of Andrea Daroca through December 31, 2007.
2. This Resolution shall take effect immediately upon its adoption.
