RECOMMENDATION
Staff recommends the City Council (1) authorize the acceptance of grant funds from the County of Los Angeles Metropolitan Transportation Authority (Metro) Active Transportation Program in the amount of $400,000 for the Robertson Boulevard Bus and Bike Lane Project, PF-024; and (2) approve a related budget amendment to appropriate the Grant Funds (four-fifths vote required); and (3) approve an amendment to the existing construction contract with Toro Enterprises Inc. for the Robertson Bus and Bike Lanes Project, PF-024 in an additional amount of $400,000 for a total contract amount not-to-exceed $1,798,732.
BACKGROUND
On January 20, 2021, the City received confirmation from Metro that Culver City’s Metro Active Transportation (MAT) application for pedestrian and bicycle improvements around the Culver City E Line station was selected for funding (Project).
On August 8, 2022, the MAT grant Funding Agreement was fully executed between the City and Metro to complete the Project along Robertson Boulevard.
On December 5, 2024, the Metro Board approved to de-obligate $434,969.47 of previously approved MAT Program funding awarded to the City of Culver City for MAT Funding Agreement Project #C1201. This was a result of the Class IV bikeway, bus-only lanes, and bus boarding islands having been removed along Washington Boulevard. The revised Funding Agreement with Metro indicated the remaining MAT funds in the amount of $1,521,559.53.
On April 14, 2025, the City Council authorized a construction contract with Toro Enterprises Inc. for the Robertson Bus and Bike Lanes Project, PF-024. The total not-to-exceed contract amount was $1,398,732, including contingencies. Construction of the project began in July 2025.
DISCUSSION
On April 17, 2025, the Metro board approved additional funding for the Culver City MAT grant in the amount of $400,000. The additional funds are for stormwater treatment measures, slip lane removal, and bike lane protection on the west side of Robertson Boulevard. Taking the de-obligation amount into consideration, the revised grant total is $1,921,559.53. The additional funds were made available to MAT Grant Cycle 1 projects due to higher than projected sales tax revenues in 2020 and 2021.
With the Robertson Boulevard project already in progress, staff recommends that Toro’s construction contract be modified to utilize these grant funds and construct the scope items that were added to the project. The existing contract is for $1,216,288 with a contingency not-to- exceed $182,444, for a total of $1,398,732. Staff recommends the contract be amended for an additional amount of $400,000, bringing the total contract amount to $1,798,732. The cost to purchase and construct the additional scope items is anticipated to be $500,000, so the additional grant funds and the existing contingency are sufficient to cover the entire scope.

Grant Account
Staff is requesting City Council authorize acceptance of the $400,000 in grant funds and approve a related budget amendment to appropriate the additional $400,000 in grant funds for CIP No. PF-024 (Expo to Downtown Connector) (four-fifths vote required).
The new total amount of grant funds for the project shall be $1,921,559.53.
Toro Contract
The original contract with Toro Enterprises, Inc. is in the amount of $1,216,288 with a Council-approved 15% contingency of $182,444 for a total $1,398,732. The proposed amended contract not-to-exceed amount shall be $1,798,732.
If the Council accepts the additional Metro grant funds and approves the associated budget amendment, there will be sufficient funding in the Revised Budget for Fiscal Year 2025-2026 for CIP project PF-024 (Expo to Downtown Connector) including the additional project scope. This project can be found in the Capital Improvements section of the budget book in Fund 423 - Capital Grants.

That the City Council:

4. Authorize the City Attorney to review/prepare the necessary documents; and
5. Authorize the City Manager to execute such documents on behalf of the City.
