RECOMMENDATION
Staff recommends the City Council (1) adopt a Resolution approving the amended Executive Compensation Plan to include updated Executive Management positions effective July 1, 2023; and (2) adopt a resolution approving the amended salary schedule to include updated Executive Management positions in the Executive Management Plan effective May 5, 2025.
BACKGROUND/DISCUSSION
The Executive Compensation Plan has been updated to reflect all eligible members of the Executive Staff in accordance with the California Public Employees’ Retirement System (CalPERS) rules and regulations.
The current Executive Compensation Plan does not list the classifications of City Manager and City Attorney, which have been added to reflect their correct status effective the original adoption of this agreement on July 1, 2023. . The Assistant City Attorney classification has been added and reflects an effective date of May 5, 2025. The amended Executive Compensation Plan is also updated to reflect the removal of Administrative Services Director and Community Development Director, as those classification titles are no longer utilized.
The Executive Compensation Plan is being updated in accordance with CalPERS rules and regulations, specifically California Code of Regulations (CCR) 571. CCR 571, “Definition of Special Compensation,” subsection (a), exclusively identifies and defines special compensation items for members employed by a contracting agency and school employers that must be reported to CalPERS if they are contained in a written labor policy or agreement.
More specifically, CCR 571(b) reflects that the board has determined that all items of special compensation are:
(1) Contained in a written labor policy or agreement as defined at Government Code section 20049, provided that the document:
(A) Has been duly approved and adopted by the employer's governing body in accordance with requirements of applicable public meetings laws;
(B) Indicates the conditions for payment of the item of special compensation, including, but not limited to, eligibility for, and amount of, the special compensation;
(C) Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer's internet website;
(D) Indicates an effective date and date of any revisions;
(E) Is retained by the employer and available for public inspection for not less than five years; and
(F) Does not reference another document in lieu of disclosing the item of special compensation.
The salary schedule is also being updated to reflect the addition of Assistant City Attorney classification to the Executive Management Compensation Plan effective May 5, 2025.
The resolution approving the updated Executive Compensation Plan is attached to this staff report as Attachment 1 and the resolution approving the amended salary schedule is t Attachment 2.
FISCAL ANALYSIS
There is no fiscal impact associated with approving an amended Executive Compensation Plan. All negotiated salary increases have already been included and approved in the Adopted Budget for Fiscal Year 2024-2025.
