Adopt a Resolution approving the Engineer’s Report and annual assessment levy for Zone 1 of Landscape Maintenance Assessment District No.1, for Fiscal Year 2010/2011; and 2. Adopt a Resolution declaring the intention to dissolve Landscaping Maintenance District No. 1, Zone 2 and setting a public hearing for August 23, 2010 at 7:00 p.m. in the Mike Balkman Council Chambers. PROCEDURE: 1. Mayor seeks motion from City Council to receive and file the affidavits of publication and posting of notices and correspondence received in response to the public hearing notices; and, 2. Mayor calls for a staff report and the City Council Members may pose questions to staff as desired; and, 3. Mayor seeks a motion to open the public hearing and City of Culver City, California Agenda Item Report 4. Mayor seeks a motion to close the public hearing after all public testimony has been presented; and, 5. City Council discusses the item and arrives at its decision. BACKGROUND: Landscaping Maintenance District No. 1, consisting of two zones was created for the purpose of providing on-going maintenance of landscaping along: • “Zone 1” (Studio Estates), being the periphery of the MGM Lot 2 residential subdivision; and • “Zone 2” (Ballona Creek), being the 20-foot wide strip along the southerly side of Ballona Creek from the easterly side of Overland Avenue to the northeasterly line of Westside Business Park, a distance of about 2,200 feet. On July 13, 2009, the proposed assessment increase for Zone 1 was approved by a majority of the votes received from members of the District. Also, the members of the District approved an annual increase based on the February Consumer Price Index for All Urban Consumers for the Los Angeles – Riverside - Orange County area plus up to a 5% premium each year until the revenues generated from the assessment match the annual expenditures of the District and the District has a positive balance. The proposed assessment increase for Zone 2 did not pass as result of a majority ballot protest. DISCUSSION: Public Hearing for Zone 1: For Zone 1, staff is proposing the City Council approve the annual assessment levy to include an annual increase based on the Consumer Price Index (CPI) plus 1.36% (additional amount required to provide sufficient District revenues). Based on the information provided by the Department of Labor, the CPI increase is 1.44%. Should the City Council adopt the proposed resolution, , the total increase to the assessment levy is 2.80%. The existing assessment levy per parcel is $184.92. The proposed assessment levy will be $190.20 per parcel for a total amount of $34,236 (180 parcels) for Fiscal Year 2010/2011. Zone 2: For Zone 2, the maintenance area is a 20 foot wide strip of land located on the southerly portion of the Los Angeles County Flood Control – Ballona Creek City of Culver City, California Agenda Item Report Channel. The existing maintenance activities are the removal of debris, maintain the landscape plants, trim the trees once every 5 years, and irrigate the landscape. The maintenance area has not had any new capital improvements in many years. The maintenance area has few remaining landscape plants. It does not have any constructed pathways. There are large trees and a boundary wall with access door from the Jefferson Business Park. The area does not appear to be accessed by the adjacent businesses and is rather secluded. Staff believes that Zone 2 can be disbanded without causing hardship to the adjacent property owners. In order to bring this area to a level that would encourage usage by the adjacent businesses would require a significant level of capital improvements such as a new enhanced entrance, new landscape plantings, decomposed granite pathways, tables and benches, lighting, security cameras, and emergency call box. Such an undertaking is estimated to cost more than $250,000. Additionally, these types of improvements and usage would require permits from Los Angeles County. Installation of capital improvements to Zone 2 would require a significantly higher assessment levy. It is unlikely that the adjacent property owners would approve such an increase by ballot. A small proposed consumer price index plus 5% increase to the assessment levy was not approved by the majority of property owners in 2009. Staff recommends that the adjacent property owners should no longer be levied an assessment for the maintenance of this area and that the City Council order Zone 2 be dissolved with the Zone Fund Balance be refunded to the District. Staff believes that Zone 2, without extensive capital improvements, does not provide the adjacent business or the general public any value or enjoyment. The area is within the jurisdiction of the Los Angeles County Flood Control District and, should the City Council ultimately dissolve Zone 2, staff will mail a letter to the County notifying them that the City will no longer maintain it. Staff recommends the City Council adopt the proposed Resolution declaring its intent to dissolve Zone 2. Should the City Council adopt the proposed Resolution, a public notice of the hearing will be published and posted no later than Thursday, August 12 th . Other options available to the City Council include: • Continue assessing Zone 2 at the current rate and adjust maintenance activities so that they do not exceed available revenue. • Continue maintenance in Zone 2 for one year until the fund balance is exhausted City of Culver City, California Agenda Item Report • By a 4/5ths majority vote, suspend collection of said assessment and continue the services, funding them with the City’s General Fund. This would also require a budget amendment. FISCAL ANALYSIS: The Landscape Maintenance District #1, Zone 1, budget is proposed to be 100 percent self-supporting for all expenditures. Herbertson, P.E., Public Works Director and City Engineer SUBJECT: LANDSCAPING MAINTENANCE DISTRICT NO. 1 FISCAL YEAR 2010-2011 ASSESSMENT ENGINEER'S REPORT LANDSCAPING MAINTENANCE DISTRICT NO. 1 (hereinafter referred to as "District"), described herein, has been formed in accordance Chapter 15.01 of the Code of the City of Culver City, California, Landscaping Maintenance District No. 1, consisting of certain public property and the real property within the District subject to assessment, is shown on maps consisting of two pages which have been filed in the Office of the City Clerk on May 21, 1979; April 21, 1980; April 12, 1982, and April 11, 1983; and by this reference are made a part hereof (pages 10 and 11). Landscaping and Irrigation System Plans The landscaping maintenance areas were constructed in several phases and improved with irrigation systems. The initial improvements for Zone 1 were constructed by a developer in accordance with approved plans under separate bonded agreement. The plans for the initial improvements for Zone 1 consist of landscaping plans, Drawing No. 5024-39g (one sheet) approved January 21, 1980, and landscape irrigation system plans, Drawing No. 4024-39g (two sheets) approved January 3, 1979. The plans for the initial improvements for Zone 2 consist of landscaping, planting and irrigation plans, Drawing No. 5024-39g (four sheets) approved May 3, 1978. The plans for the initial improvements of Annexation No. 1 to Zone 2 consist of landscaping plans, Drawing No. 5049-55g (sheet 16 of 19) approved April 1, 1982, and landscape irrigation system plans, Drawing no. 5049-55g (sheet 17 of 19 sheets) approved April 1, 1982. Performance of Maintenance by City Forces and/or Contractor The maintenance of the improvements is provided by City of Culver City forces and/or maintenance contractors through contracts awarded by the City, and the costs thereof shall be assessed to the benefiting properties within the District. Parcel Assessments Based Upon Benefit Received It is proposed to assess the total amount of maintenance and incidental costs for maintaining the landscaped areas to the individual parcels of real property within the District in proportion to the estimated benefit to be received by such parcels of real property. The assessments of such costs commenced upon acceptance of the improvements by the City of Culver City and the commencement of maintenance. This fiscal year assessment is calculated to be $190.20 per lot for Zone 1 and $.0213 per square foot of assessable land for Zone 2, based on the data shown in Tables I, II, Ill, IV, and V. The proposed individual assessments are shown on the attachedassessment roll. Method of Assessment The District is divided into two zones, Zone 1 and Zone 2.Zone 1 consists of all the lots in Tracts 34390, 34371, 36218, eight of the nine lots of Tract 33484, and thirty-one of the thirty-two lots of Tract 28805, all of which derive an equal benefit from the Zone 1 landscaping. .Zone 2 consists of the Westside Business Park and eight other parcels of land adjoining Westside Business Park on the west. Each parcel in Zone 2 derives a benefit from the Zone 2 landscaping based upon the area of that parcel. The assessments will be spread in accordance with the following formula. Zone 1 Annual Rate Per Parcel = Estimated Cost of Maintenance and Administration for Zone 1 Divided by: Number of Parcels in Zone 1 Zone 2 Annual Rate Per Parcel = Estimated Cost of Maintenance and Administration for Zone 2 Multiplied by: Square Footage of Each Parcel Divided by: Total Square Footage of All parcels in Zone 2 Estimated Cost of Maintenance and Improvements The annual assessment amount for maintenance and improvements for each zone for the fiscal year is calculated using the following: A. The total cost of constructing or installing all proposed improvements and maintaining and servicing all existing and proposed improvements, including all incidental expenses. B. The amount of any surplus or deficit in the District Fund to be carried over from the previous fiscal year. C. The amount of any contributions to be made from sources other than assessments levied pursuant to District assessment proceedings.D. The amount, if any, of the annual installment for an assessment ordered by the City Council wherein the estimated cost of any improvements shall be levied and collected in annual installments. E. The net amount to be assessed upon assessable lands within the District shall be the total maintenance and improvement costs, as referred to in A., above, increased or decreased, as the case may be, by any of the amounts referred to in B., C., or D., above. F. Item B above may specify individual parcels within a zone that did not receive notice of or pay assessments levied by the City Council, and which assessments are carried over and added to the assessments for the current fiscal year for each such specified parcel. Recommended Assessment: Zone 1: On July 13, 2009, the proposed assessment increase for Zone 1 was approved by a majority of the votes received from members of the District. Also, the members of the District approved an annual increase based on the February Consumer Price Index for All Urban Consumers for the Los Angeles — Riverside - Orange County area plus a 5% premium each year until the revenues generated from the District match the annual expenditures and the fund has a positive balance. For Zone 1, staff is proposing the City Council approve that the assessment district levy be modified to provide for an annual increase based on the Consumer Price Index (CPI) plus an additional amount up to 5% as needed to provide sufficient revenues for the District. Based on the information provided by the Department of Labor, the CPI increase is 1.44%. Based on the review of the expenditures and revenues, it is recommended that the proposed total increase to the assessment levy be 2.80 (1.4-4% + 1.36%). The existing assessment levy per parcel is $184.92. The proposed assessment levy will be $190.20 per parcel for a total amount of $34,236 (180 parcels) for Fiscal Year 2010-11. Zone 2:Staff is proposing that the City Council disband Zone 2 and the remaining funds be refunded to the property owners for Fiscal Year 2010-2011. Therefore, the property owners in Zone 2 will not receive an assessment levy on their property tax bill for Fiscal Year 2010-2011. This maintenance area is separated from the adjacent property owners by a 7 foot high wall and has one entrance gate. The area does not appear to be accessed by the property owners for enjoyment. The area has not received any capital improvements in many years and is located within the Los Angeles County flood control area. In order to install capital improvements such as an enhanced entrance, new landscaping, decomposed granite pathways, lighting, security measures, and tables and benches, would require expenditures of over $250,000.
