RECOMMENDATION:
Staff recommends that the City Council: (1) accept the work performed by Fleming
Environmental, Inc.; (2) authorize the filing of a Notice of Completion; and (3)
authorize the release of the retention payment in the amount of $24,484.80 upon
expiration of the 35-day lien period, for the Culver City Park Playground
Improvement Project, P-916.
BACKGROUND:
On April 21, 2008, the City Council adopted a Resolution approving a grant
application for $250,000 in Los Angeles County Proposition A Excess Funds to
demolish the existing playground and construct a new playground at Culver City
Park and approved a related budget amendment. On May 3, 2010, the City Council
adopted the Youth Employment Plan for the Culver City Park Playground Project,
thereby fulfilling the Los Angeles County Proposition A grant requirement related to
the employment of youth. On September 26, 2011, the City Council approved the
final plans and specifications for the Project and authorized the publication of a
notice inviting bids. On February 6, 2012, the City Council awarded a construction
contract to Fleming Environmental, Inc. in the amount of $237,373 along with a
$11,868.65 change order authority provided to the Parks Division Manager, for a
total of $249,241.65.

DISCUSSION:
The Culver City Park Playground Improvement Project included the demolition of the
existing rubberized surfacing and playground structures. Construction began on
April 2, 2012 and concluded in early May with the playground opening to stellar
reviews by children and those who accompanied them to the playground on May 8,
2012. The new site design features clusters of accessible playground equipment for
children ages 2 to 5 and 5 to 12 that provides novel, challenging age-appropriate
play. The upgraded playground surfacing, installed by the California Conservation
Corps (CCC) pursuant to the Youth Employment Plan for P-916, is engineered wood
fibar, a safe fill material that is 100% accessible. A few elements of the original
design have been incorporated into the project, including a separate sand play area.
The installation of new replacement concrete picnic tables was the final phase of the
upgrade to the entire picnic and playground area. Construction management was
done by staff, and the playground was audited and certified by playground
specialists.
FISCAL ANALYSIS:
The Culver City Park Playground Project, P-916, is fully funded by a Los Angeles
County Proposition A Excess Funds grant and requires no General Fund monies.
There are currently sufficient funds for the Project in Account Number
42300916.730100 (Capital Grants / Culver City Park Playground Project /
Improvements Other Than Buildings) to pay retention to Fleming Environmental, Inc.
in the amount of $24,484.80.
MOTIONS:
That the City Council:
1. Accept the work performed by Fleming Environmental, Inc. for the Culver City
Park Playground Improvement Project, P-916; and,
2. Authorize the Parks Division Manager to execute the Notice of Completion and
submit it to the Los Angeles County Recorder’s Office; and,
3. Authorize the release of $24,484.80 in retention funds to Fleming Environmental,
Inc. after the expiration of the 35-day lien period.
