RESOLUTION NO. 2010-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CULVER CITY, CALIFORNIA ORDERING THE
PREPARATION OF AN ENGINEER'S REPORT
PURSUANT TO THE PROVISIONS OF CHAPTER 15.01
OF THE CULVER CITY MUNICIPAL CODE AND
DECLARING ITS INTENTION TO ORDER THE ANNUAL
ASSESSMENT LEVY FOR THE ALBRIGHT AVENUE
STREETLIGHTING ASSESSMENT DISTRICT AND
SETTING THE TIME AND PLACE FOR THE PUBLIC
HEARING.
WHEREAS, the City Council of the City of Culver City desires to conduct
proceedings for considering the annual assessment of a benefit district pursuant to the
terms and provisions Section 15.01M70 of Chapter 15.01 of the Culver City Municipal
Code, in what is known and designated as the "ALBRIGHT AVENUE STREETLIGHT
ASSESSMENT DISTRICT;" and
WHEREAS, the City Council of the City of Culver City ilesires to complete the
proceedings for the annual levy of the assessments as required by Article XIII
(C) and (0)
of the Constitution of the State of California (Proposition 218); and
WHEREAS, these proceedings for the annual levy of assessments shall
relate tO the fiscal year commencing July 1, 2010 and ending June 30, 2011; and
WHEREAS, the provisions of Section 15.01.055, require a Written Engineer's
Report consisting of the following:
1. A diagram of the area proposed to be assessed; and
2. An assessment of the estimated costs for said fiscal year.1|1010101010|.6|101010 10

NOW, THEREFORE, the City Council of the City of Culver City, DOES
HEREBY RESOLVE as follows:
1. The above recitals are true and correct.
2. The certain street lighting improvements were completed in March
2005 and are set forth in the Engineers Report to be presented to this City Council for
consideration.
3. The City of Culver City hereby declares its intention to levy the annual
assessment on the 17 members of this assessment district for fiscal year 2010/2011_
4. The City Engineer is hereby ordered to prepare and file with the City
Clerk, for submission to the City Council, an Engineers Report relating to said annual
assessment and levy in accordance with the provisions of Section 15.01.055 of the Culver
City Municipal Code.
5. Upon receipt of the City Engineer's report, and in accordance with the
provisions of Section 15.01.070 of the Culver City Municipal Code, the City Clerk is hereby
ordered to give notice of the time and place a public hearing will be held by the City Council
to consider objections and protests.

6. A public hearing has been set for June 14, 2010 at 7:00 p.m. in the
Mike Balkman Council Chambers, located at City Hall, 9770 Culver Boulevard, Culver City,
California 90232.

RECOMMENDATION:
Staff recommends the City Council adopt a Resolution:
1. Ordering the Preparation of the Engineer’s Report for the Albright
Avenue Street Lighting Assessment District for Fiscal Year 2010/2011;
and,
2. Declaring its Intention to Order the Levy of Annual Assessments for
Fiscal Year 2010/2011; and,
3. Setting a Public Hearing for June 14, 2010, at 7:00 p.m. in the Mike
Balkman Council Chambers.
Should the City Council adopt the proposed Resolution, a public notice of the
hearing will be published and posted no later than Thursday, May 27th, and the City
Engineer will prepare a comprehensive report containing detailed information on the
actual and estimated charges that are proposed. The report will be made available
for public review at least 10 days before the Public Hearing at the City Clerk’s Office.
BACKGROUND/DISCUSSION:
The property owners requested that the City finance the construction of five (5) new
streetlights on Albright Avenue, south of Washington Place. The City’s policy is to
require property owners to pay for the installation of new street lights, when
requested by the property owners, on streets that do not currently have street lights.
In order to do this the City collects the cost, including a fair interest payment

through an assessment contained as part of the Los Angeles County property tax
bills for the benefited properties. In this case, the assessment is being collected
over a period of ten (10) years which commenced with the tax bill for fiscal year
2005-2006. The interest rate that was approved was 4%. This is the sixth year that
the City Council will consider the annual assessment levy for the Albright Avenue
Street Lighting Assessment District. The District costs are assessed to the
benefited eighteen (18) properties equally, as the benefit to each property is the
same. Each property (except one property that has already paid the full amount
owed) will be assessed one-eighteenth (1/18) of the total costs of the District.
Should the City Council adopt the proposed resolution, a Public Hearing will be held
not earlier than 10 days after authorization by City Council and publication of a
notice announcing the hearing, with a proposed date for the Public Hearing being
June 14, 2010. If approved, all property owners within the Assessment District
limits will be mailed a notification on Tuesday, May 25, 2010, of the proposed
continued assessment and the date, time and location of the public hearing.
FISCAL ANALYSIS:
There is no direct fiscal impact of the proposed action. The preparation of the
Engineer’s Report will be completed by staff.
