RECOMMENDATION

 

Staff recommends the City Council adopt a resolution approving a Temporary Use Permit (TUP) for extended construction hours for 109 days for a mixed-use development located at 11111 Jefferson Boulevard.

 

 

BACKGROUND

 

On October 11, 2021, the City Council approved the mixed-use development located at 11111 Jefferson Boulevard (the “Project”), per Ordinance Number 2021-0015 (P2021-0025-CP/ZCMA/DOBI/TPM). An Environmental Impact Report (EIR) was prepared and adopted for the Project with Project Design Features and Mitigation Measures included.

 

On May 27, 2025, the Project was subsequently administratively modified per Minor Modification P2025-0092, increasing the number of residential units and reducing the commercial square footage, and modifying the conditions of approval. An EIR Addendum was prepared and adopted for the modified Project.

 

Pursuant to Culver City Municipal Code (CCMC) Section 9.07.035 and Condition of Approval #66, construction hours are currently limited as follows:

                     Mondays through Fridays - 8:00 AM to 8:00 PM

                     Saturdays - 9:00 AM to 7:00 PM

                     Sundays - 10:00 AM to 7:00 PM

 

However, CCMC Section 9.07.035 also allows construction activity to occur outside of the above hours with approval of a TUP.

 

On May 4, 2026, the Applicant submitted a TUP request (Attachment 2) for extended construction hours to enable discrete construction activities related earthwork shoring/excavation, concrete pouring, and crane erection/disassembly to be completed more efficiently, effectively, and safely. Extended construction hours are requested as follows for a total of 109 days over the course of 15 months of the construction period:

                     Mondays through Fridays - 7:00 AM to 8:00 PM

                     Saturdays and Sundays - 7:00 AM to 7:00 PM

 

 

DISCUSSION

 

Findings

Pursuant to CCMC Section 9.07.035.C, extended construction hours may be approved in non-residential districts on construction sites of one acre or greater in size, provided that the extension has been determined to be in the public interest. The proposed extended construction hours are expected to provide the following public benefits:

                     The overall construction time would be reduced by approximately 2 months thus reducing the time frame during which the community may experience construction impacts.

                     The early start during extended-hour days would help mitigate traffic impacts that could otherwise be caused by morning hauling, deliveries, and worker arrivals during peak traffic hours.

                     Construction crew safety would be improved during large-scale tasks such as tower crane erection and disassembly.

 

Staff recommends that the required findings can be made for the requested extended construction hours, subject to the recommended conditions of approval (see below). The findings are addressed in the City Council resolution (Attachment 1).

 

Conditions of Approval

The extended construction hours will be subject to the following recommended conditions of approval:

                     Should negative issues arise, the Planning & Development Director may reduce or revoke the extended hours.

                     All Mitigation Measures and Project Design Features provided in the Certified EIR and Addendum, including those related to noise mitigation, shall be met to reduce impacts during extended construction hours.

                     The Construction Management Plan shall be revised to include approved extended construction hours.

                     Any changes to the Construction Management Plan, Pedestrian Protection Plan, and/or Construction Traffic Management Plan will require approval by the Public Works Engineering Division, Building Safety Division, and the Current Planning Division.

                     The Planning & Development Director may impose additional requirements on the extended construction hours approval should the City determine it is necessary.  Additional requirements may include, but not be limited to, construction signage informing the public of extended construction hours, increased sound attenuation, and added traffic control personnel.

 

Notice

Pursuant to CCMC Section 9.07.035, approximately 660 notices were mailed to all property owners and occupants within 1,000 feet of the Project site.  As of the preparation of this report, staff has received no comment letters.

 

 

ENVIRONMENTAL DETERMINATION

 

In accordance with California Environmental Quality Act (CEQA) Guidelines, Environmental Science Associates (ESA) prepared the original EIR and Addendum for the Project. ESA has also prepared a CEQA memo (Attachment 3) to evaluate CEQA implications of the proposed extended construction hours with regard to Air Quality, Health Risk, Noise, and other CEQA issue areas. Consideration was also given to the Project Design Features and Mitigation Measures already included in the Project’s Certified EIR and Addendum. The analysis concludes that the extended construction hours would not result in any new significant impact or a substantial increase in the severity of previously identified impacts in the Certified EIR or Addendum.

 

 

FISCAL ANALYSIS

 

There is no fiscal impact to the City for considering or authorizing the requested TUP.  The Applicant is required to pay the TUP fees and the third-party costs associated with the CEQA analysis, as well as all City costs associated with inspections and other matters performed during non-business hours.

That the City Council:

1.                     Adopt a Resolution approving Temporary Use Permit P2026-0109-TUP for Extended Construction Hours for 109 days for a mixed-use project at 11111 Jefferson Boulevard, to allow construction from 7:00 AM to 8:00 PM on Mondays through Fridays, and from 7:00 AM to 7:00 PM on Saturdays and Sundays, subject to conditions of approval; and

 

2.                     Authorize the Planning & Development Director to issue a Temporary Use Permit on behalf of the City.
