RECOMMENDATION
Staff recommends the City Council (1) adopt a resolution authorizing the City to enter into an amendment to the agreement with the Los Angeles County Flood Control District (LACFCD) for the transfer of Safe Clean Water Funds for the Washington Boulevard Stormwater Diversion Project (PR-001) for Fiscal Year 2025-2026 and (2) approve related budget amendments (requires a four-fifths vote).
BACKGROUND/DISCUSSION
In November 2018, Los Angeles County voters approved Measure W, Los Angeles County’s Safe Clean Water Program (the “Program”) to improve water quality, increase local water supply, and enhance communities. The Program provides local dedicated funding to increase local water supply, improve water quality, and protect public health. Under the Safe Clean Water’s Municipal Program, 50% of the funding is allocated to watersheds as regional competitive funding that applicants apply for to be ranked by Watershed Area Scoring Committees (WASCs).
Culver City’s Public Works Environmental Programs & Operations Division (EPO) applied for Measure W Regional Infrastructure Funds for the Washington Boulevard Stormwater Diversion Project PR-001 (“Project”), which is a partnership with Costco. Final project award recommendations were provided to the Los Angeles County Board of Supervisors for consideration and were approved on October 13, 2020. The Board of Supervisors approved $3.6M over three years to fund the project, and Culver City Council approved Transfer Agreement No. 2020RPCSMB07 on November 9, 2020. After receiving construction bids that exceeded the Project budget by $9M, staff re-designed the Project and applied for a Project Modification Request through the Safe Clean Water Program to request an additional $4M. In 2025, the WASC awarded the funding over three years, which requires an amendment of the existing Transfer Agreement for the Fiscal Year 2025-2026 contribution. Staff will return to Council to approve additional addendums and the associated budget amendments for the Fiscal Year 2026-2027 and Fiscal Year 2027-2028 funding.
Pursuant to Section 16.05.A.1 of the LACFCD Code, prior to City’s receipt of Program funds, the City must amend Transfer Agreement No. 2020RPCSMB07 for the Regional Infrastructure Project Funds.
FISCAL ANALYSIS
A budget amendment is requested to reflect the increased contribution from Los Angeles County’s Safe Clean Water Funds for Regional Infrastructure Projects from LACFCD for the Washington Boulevard Stormwater Diversion Project in the amount of $1,333,333. Funds received will be deposited in CIP Account No. 43880000.313705.PR001 Marina Del Rey Harbor Stormwater Project.
Funds will be expended from Account No. 43880000.730100.PR001. A budget amendment requires a four-fifths vote.

2. Approve related budget amendments (requires four-fifths vote); and
3. Authorize the City Attorney to review/prepare the necessary documents; and
4. Authorize the City Manager to execute such documents on behalf of the City.
