RECOMMENDATION
Staff recommends the Cultural Affairs Commission: 1) review CCMC Section 3.03.200 pertaining to powers and duties of the Cultural Affairs Commission; and, (2) make recommendations on language adjustments.
BACKGROUND/DISCUSSION
The November 19, 2019, CAC meeting agenda included an item pertaining to the powers and duties of the commission. At that time, the CAC was asked to review proposed changes to CCMC Section 3.03.200 to incorporate equity policy language. The changes were incorporated into an Ordinance (Ord. No. 2020-004) that was adopted by the City Council on February 10, 2020.
Earlier this year, Commissioner O’Carroll noted that the changes proposed in 2019 actually replaced one of the powers and duties as included in CCMC 3.03.200, Section B. The assumption is that this was inadvertent and that the equity language was to be an addition to what was already in the CCMC and not a replacement. The CAC expressed a desire to reinstate the prior language (while retaining the DEI language); this was included in the Cultural Affairs FY 2023 - 2024 work plan.
Staff proposes the following changes to what is currently incorporated into the CCMC (with underlined text being proposed new changes):
§ 3.03.200 POWERS AND DUTIES.
The Cultural Affairs Commission shall have the following powers and duties:
A. Act in an advisory capacity to the City Council on matters pertaining to the enrichment of the community through fine arts, visual arts, performing arts, arts education, historic preservation and cultural issues;
B. Serve as an advocate for cultural activities and programs within the City;
C. Serve as an advocate for equity, diversity and inclusion in cultural activities and programs within the City;
D. Implement the City's Public Art Program, and encourage the integration of cultural affairs into the social and economic fabric of the City to improve the quality of life for City residents; and
ED. Perform such other duties, not inconsistent with the City Charter or this Code, as maybe prescribed by ordinance, resolution, City Council policy or other City Council action.

The changes recommended by the CAC will be forwarded to the City Attorney’s Office who will draft an Ordinance to be included on a future City Council agenda.
FISCAL ANALYSIS
There is no direct fiscal impact associated with this agenda item other than staff time.
