RECOMMENDATION:
Staff recommends the City Council adopt a Resolution 1) establishing and amending
various fees and charges for services provided by the City; and 2) rescinding prior
fee Resolution No. 2011-R027 and portions of Resolution Nos. 2000-R074; 2003-
R023 and 2009-R052.

BACKGROUND:
In Fiscal Year 2006/2007 the City hired a consultant to conduct a comprehensive fee
study. Based on the information provided by the fee study, staff worked with a City
Council subcommittee to develop a cost recovery policy and five-year
implementation schedule for each affected division.
On June 23, 2008, the City Council approved a cost recovery policy and
implementation schedule for fees and charges, which is provided in the table below
for City Council’s reference. As illustrated in the table, the current overall cost
recovery for each fee area is at the cost recovery goal.
DISCUSSION:
Over the last few years, the City has been adjusting fees to meet the overall cost
recovery levels adopted by City Council. Due to recently approved Memoranda of
Understanding with all bargaining groups, staff costs are estimated to increase by
approximately 2% in the next year. Consequently, staff is recommending a 2%
increase to a majority of fees for Fiscal Year 2012/2013. In addition to the general
2% increase, staff is recommending a few other changes to the fee schedule to
better reflect operational realities. The more significant changes being proposed for
Fiscal Year 2012/2013 include:
Finance:
In Fiscal Year 2009/2010, a number of new fees related to Special Events Permits
requiring review by the Committee on Permits and Licenses and other expedited
permit/certificate processing services were added to the fee schedule. Now that
these fees have been in existence for a few years, staff has had the opportunity to

closely track and review the impact the various fee related activities have had on
staff time and overall operations. Consequently, staff is recommending an increase
to a number expedited service fees and late permit application filing while holding
the line on other fees. Overall, the proposed fees will maintain the Finance
Department’s cost recovery level.
Fire:
Fire Inspection Fees for Commercial Businesses are charged based on the size
(measured by square feet) of the business being inspected. Currently, businesses
are lumped into four broad size ranges. Since these types of fees are based on
averages, smaller businesses tend to pay a little higher fee per square foot for the
inspection while larger businesses tend to pay a little less per square foot for the
service. Staff is proposing to rework the Commercial Business Inspection fees by
adding additional size ranges to slightly reduce the fee per square foot for smaller
businesses and slightly increase the fees per square foot for larger businesses. This
change increases the equity of the fee structure as inspections for larger commercial
businesses are more of a burden on City staff time and tend to be more complex
than inspections for smaller commercial businesses. In effect, the proposed fee
structure will slightly reduce the extent to which smaller businesses subsidize the
inspections of larger businesses. Overall, this should not have a negative impact on
Commercial Business inspection revenues. In fact, it may slightly increase revenue
by increasing cost recovery from larger commercial facilities.
Parks, Recreation, and Community Services:
Park Permit Fees:
Due to the large capacity and demand for use of Veteran’s Memorial Park, staff is
recommending an increase to the Park Permit fee for use of Vet’s Park. The
increased fee revenue is needed to offset the wear and tear caused by the
increased use of Vet’s Park by large parties.
Facility Rental Fees:
Staff is recommending simplification of the rental fee categories to more easily
classify renters into the appropriate rental category. Additionally, Facility rental fees
have not been increased in more than five years while custodial costs have
increased by 20% over that same time period. Consequently, staff is recommending
increased rates for Categories A – E to better reflect the market rate for rental of
comparable spaces. Staff has also reviewed Miscellaneous Rental Fees and has
proposed changes to reflect current operations.
Police:
Staff is proposing a number of new fees for production/re-production of various
reports and investigative materials that are often requested by third parties. These
are relatively standard fees charged by many surrounding jurisdictions to recover the
cost of generating these reports and investigative materials for various parties.

Additionally, staff is recommending adding fees to recover costs for DUI collision
response, hit and run accident investigations, and police pursuits. Cost recovery for
these types of police activities are authorized by Government Code Section 53150
and are charged to the perpetrator, not the victim.
There are no significant changes being recommended in the other departments not
specifically discussed above. All fees in the proposed resolution will become
effective on Monday, July 16, 2012.
Other Post Employment Benefits (OPEB)
On June 22, 2009, City Council amended Council Policy 5002 – Financial Policies
(Attachment 2) – to add the following language:
“…A percentage of certain fee revenues, as determined by City Council
Resolution, shall be earmarked and set aside in an irrevocable trust for
post employment benefits. After the fiscal year has ended, the earmark
percentage will be applied to the actual fee revenues received during
the respective fiscal year…”
Staff calculated the percentage increase necessary to fully fund OPEB costs for
current General Fund employees as 4.5%. To maintain consistency with
implementing increases over time to ease the financial burden, City Council
approved phasing in the full cost over a three year period with full implementation in
Fiscal Year 2011/2012. Consequently, 4.5% of certain fee revenues (see below) will
be earmarked in Fiscal Year 2012/2013 to pre-fund the OPEB obligation.
City Council also approved applying the OPEB earmark to the fee receipts in the
following General Fund divisions/departments only: Building Safety, Engineering
(excluding Preferential Parking), Fire, Planning, and Police. The OPEB earmark is
not applied to PRCS facility rental charges or Recreation program fees because
facility rental fees are driven more by market rental rates than staff costs, and City
Council has made a policy decision to substantially subsidize recreation programs.
FISCAL ANALYSIS:
User Fees & Charges
Based on current economic forecasts, Departments expect to experience some
growth in fee based activity next fiscal year, following a significant decrease in fee
activity in prior fiscal years. Most of the City’s major fee revenues are derived from
construction and development related activities, which have been among the
industries hardest hit over the last few years. Therefore, fee revenues are expected
to continue to grow slowly as the economy begins to recover.

OPEB
As previously mentioned in this and other reports to City Council, the City was
required to report the OPEB liability on the audited financial statements as of
6/30/09. There is currently no funding requirement; however, as a best financial
management practice, the City has begun identifying sources of funding to start
setting aside funds wherever possible. The tables below shows the estimated
amount that may be earmarked in Fiscal Year 2012/2013 based on the proposed
budget. Although this is a small amount in relation to the size of the City’s OPEB
liability, as the economy begins to recover, this amount should grow. Please note
that the below amounts are only estimates based on the proposed budget, the actual
earmark will be determined at year-end based on actual revenues.

In January 2011, City Council approved entering into an agreement with PFM Asset
Management, LLC to establish an OPEB Trust. Staff is currently working with PFM
to establish the Trust. An initial deposit, including the amount earmarked from prior
year fee receipts, will be made once the Trust is established.

Armed Forces, Law Enforcement, and Service Dogs - A license

of the United States, or for any dog during such time as the dog

Disability - Culver City residents who meet the criteria of
Disability as established by the Social Security Administration’s
Supplemental Security Income (SSI) Program for the Aged, Blind

without regard to age, are exempt from paying a license fee for
the first dog and first cat, with all subsequent dogs and cats
requiring a license and tag fee of 50% of the fees established in
Section 1 of this Exhibit.

Senior Citizens - Residents of Culver City aged 60 years old
whose total adjusted gross income, as used for purposes of the
California Personal Income Tax Law, was no more than $18,200
for the last calendar year, and the combined adjusted gross
income of all members of the household in which an individual
resides was no more than $21,500 are exempt from paying a
license fee for the first dog and first cat, with all subsequent dogs
and cats requiring a license and tag fee of 50% of the fees
established in Section 1 of this Exhibit. The income amounts set
forth in this Section shall be subject to adjustment as provided
from time to time by the County of Los Angeles setting the
income qualifications for "low income" or from some other bona-
fide source, both subject to approval of the City Manager.

Culver City Non-Profit Organization means any established City group, or ganization or association including without
limitation, civic groups, service clubs , political organizations and fraternal associations who use any part of the
Complex facilities for any purpose when:
An admission is charged; or
Any donations are accepted before or during the event; or
Any type of sale or auction takes place; or
"Commercial" shall mean any group, organiz ation or association or any person or persons, whether a City resident
or not, who do not qualify for any of the other fee categories in this section when any part of the Veterans’ Memorial
Complex is used whether for monetary gain or not.
Any other means of f und raising is used; or
The activity is in the nature of a private party or social gathering; or

“Non-Resident Private” shall mean any type of family gathering that is organiz ed by invitation only, and no
admission is charged, and all non-profit organizations outside of Culver Ci ty who do not qualify as a charitable
501(c)(3) organization.
“Resident Private” shall mean Culver City residents holding a private gathering as defined above will receive a 10%
discount off of the Category D rental f ees. To qualify for this discount, the c ontract for the use of the Veteran's
Memorial Complex facilities must be entered into with, and signed by a Culver City resident who has supplied the
Veterans’ Memorial Complex office with a copy of their mo st recent utility bill.
Each City group, organization, or association must have on file with the Complex Manager’s office:
Current membership roster listing resident address of each member; and
Name and telephone number of the President and Vice President; and
Copy of its by-laws.
“Culver City Non-Profit Organization Fundraisers” ( defined below - #1), religious organiz ations, government agencies,
non-profit, charitable 501(c)(3) organiz ations outside of Culver City.
These fees shall be assessed in conjuction with the regulations set forth in Resolution No. 2003-R020:
“City Sponsored”, as used in Exhibit F-2, shall mean any City group, organization or association that is granted the use
of any part of the Complex facilities for any purpose for no fee, or for a sm all stipend determined by the Director. A
complete list of all City Sponsored organizations shall be presented in a to the City Council each year representing the
prior year’s usage of the Veterans’ Memorial Complex. City Sponsorship of one event in any given year does not
automatically qualify that group for on-going City Sponsorship.
"Culver City 501(c)(3) Charitable Non- Profit Organization," as us ed in Exhibit F-2, means any established City group,
organization or association headquartered in the City of Culver City, including without limitation, civic groups, service

“ Non Profit, Non-Resident” shall mean any 501(c)(3) Non-Profit Organization that is not
headquartered in the City of Culver City.Non-Resident 501(c)(3) Non-Profit Organization,
annually, shall submit a copy of their most current IRS Form 990 (Cannot be older than 2
years) to be placed on file with the PRCS Department as well as their General Liability
Insurance with corresponding headquarters address.
“Private Party, Resident” shall mean any City of Culver City resident holding a private
gathering. To qualify as a resident, renter shall submit a copy of their most current utility
bill (No older than 2 months) and provide a secondary proof of residency with a photo id.
Private Parties are events organized by invitation only, and no admission is charged, no
public marketing has occurred, no business or services are being provided.

2. The rates for trash pick-up from the community compactors shall be as follows:
a) Collection Fee for Restaurant Businesses: The fee is $147 for a restaurant
with an average size of 2,582 square feet. The rate is increased or decreased
by dividing the square footage of a restaurant by 2,582 and multiplying that
number by $147.
b) Collection Fee for Non-Restaurant Businesses: The fee is based on a rate of
$50 for a commercial business with an average size of 4,829 square feet.
The rate is increased or decreased by dividing the square footage of a business
by 4,829 and multiplying that number by $52.50, the product will be disposal rate.
c) Administrative Fee for All Users: A fixed fee of $80 shall be charged to
businesses participating in the community compactors in addition to the
collection fee. This charge is required to cover maintenance of the compactors,
lease-purchase of the compactors and scheduled cleaning of the compactors
areas.

Refuse Collection fees for compactors installed as part of the Downtown Culver City Paseo
Improvement (CCMC 5.01.065, R-3069)*:
1. Community Compactors: Compactors are those which are installed in the Culver City Downtown as part
of the Downtown Culver City Paseo Improvement Project. Downtown businesses place their refuse in City
provided compactors that are serviced by refuse collection vehicles. Basic collection service is provided for
three (3) 4-cubic yard compactors and, one (1) 15-cubic yard compactor on a weekly basis. Fees are
assessed to downtown businesses based on business type (restaurant or other) and size (square feet)
through the Finance Department.
3. The Refuse Collection Fee set forth in Section 2, above, shall be collected pursuant to billing procedures
established by the Finance Department.
Organic Waste Composting (refer to Resolution No. 2009-R018)
In the event a compactor bypasses the Transfer Station and is haulded directly to a
composting facility, a fixed fee of $34.00 shall be charged in order to cover the additional
transportation cost. This fee shall be in addition to the Compactor Empty and Organic

The following fare schedule is hereby adopted for all scheduled routes of the Culver City
Municipal Bus Lines, per Resolution No. 2009-R060, as follows:
The adult bus fares shall be one dollar ($1.00) per fare. Such fare may be paid in
cash or by using a TAP card.
The student bus fare for kindergarten through high school students (12
th
Grade),
shall be seventy five cents ($0.75). Such fare may be paid in cash by students
presenting a currently validated identification card issued by a recognized
educational institution or by using a student TAP card.
The bus fare for senior citizens, 62 years or more of age, and disabled persons,
other than the blind, presenting a valid identification card issued by the federal or
state government, by the City of Culver City or by other Los Angeles County
Transportation Operators’ Association members shall be thirty-five cents ($0.35). An
orange discounted TAP card may also be used for fare payment.
Free transportation shall be provided on all regularly scheduled buses of the Culver
City Municipal Bus Lines for all City employees and for all blind persons within the
definition of the California Welfare and Institutions Code §19153, whose blindness
has been so certified as required by said Section.
The fare for an intra-line transfer shall be ten cents ($0.10) for senior citizens and

OUTSIDE LEGAL, ENGINEERING, OR CONSULTING SERVICES:
For any staff support required by a position that is not listed above, the City shall charge
actual costs plus a twenty-five percent (25%) administration fee. Actual costs shall be
calculated as hourly salary plus benefits (including City tax liability, health insurance
benefits, retirement and deferred compensation benefits, workers' compensation
insurance costs, etc.)
To protect the public health, safety and welfare, if additional staff time is required by an activity
that is beyond the normal scope of staff's work duties, the City is authorized to charge fees to
the user for services rendered.
The following fees shall be charged to the user to recover the cost of providing the additional
service:
Any user whose service requires the retention of legal, engineering, or other outside consulting
services by the City shall reimburse the City for the actual costs for said services plus a twenty-

The surcharge shall be used by the City solely to fund digital imaging and storage of plans
and documents and technology improvements and maintenance to enhance customer
service.
The City Manager, upon the recommendation of the Community Development Director,
may waive the fee established herein when the applicant is another governmental agency
or 501(c)(3) charitable nonprofit organization headquartered in the City of Culver City.
PUBLIC HEARING COSTS:
DIGITAL IMAGING AND STORAGE OF PLANS AND DOCUMENTS
AND TECHNOLOGY IMPROVEMENTS FEE:
Any other direct costs incurred by the City directly related to services rendered to a particular
user shall be reimbursed to the City by the user. The City may require a user to pay a deposit
for an amount to cover the estimated staff time and other costs related to the service. The user
shall receive an invoice detailing the components of the estimate and payment shall be made to
the City of Culver City. If the actual cost exceeds the amount of the deposit, the user shall pay
the balance. If the deposit exceeds the actual costs, the user shall be reimbursed the balance
within thirty (30) days of completion of the service.
California Health and Safety Code §19850 requires local jurisdictions to maintain official copies
of the plans of every building for which a building permit has been issued. California Health and
Safety Code §19852 allows the City to recover the costs of maintaining official copies of building
plans through the imposition of fees.
In addition to any other fees, a permit fee surcharge totaling four percent (4%) of any
building, mechanical, plumbing and/or electrical permit and plan check fee; Planning
discretionary review and Planning permit and plan check fee; Fire Prevention permit and
plan check fee; or Engineering permit and plan check fee is hereby adopted and shall be
paid by the applicant prior to the issuance of any such permit.
OTHER COSTS:
For each notification for a public hearing to be held before the City Council or any City Board or
Commission empowered to hear the related matter, the applicant shall reimburse the City for
the cost of publication in an adjudicated newspaper, if required. The applicant shall also pay a
fee of $25 per 50 postcards/mailings, if required, to reimburse the City for related costs.
