RECOMMENDATION:
That the City Council adopt a resolution to establish a Building Safety, Planning, Fire
Prevention, and Engineering permit fee surcharge to fund digital imaging and
storage of plans and documents and technology improvements and maintenance in
order to enhance customer service.
BACKGROUND:
The Building Safety, Planning, Fire Prevention and Engineering Divisions currently
maintain a paper file on each property in Culver City. These files include all permits,
but may not include all correspondence, associated with each permit issued.
Building Safety also has digital records of all construction activity in the City through
its use of the permitting software "Permits Plus," which was instituted five years ago.
Construction plans of completed projects are currently stored in the Building Safety
plan check and storage room. When staff or a member of the public need to see a
particular set of plans, it may take staff significant time to retrieve the documents.City of Culver City, California

Three years ago, the Building Safety Division was allocated $22,000 to begin
digitally storing plans. Those funds have been exhausted through expenditures in
three areas:
1. The majority of the former microfiche files have been converted to digital files.
2. A duplex scanner capable of scanning (up to) legal size documents has been
purchased.
3. Building Safety currently shares the maintenance costs of the Public Works
Engineering Division large format scanner, with the intention Building Safety
may share the use of the scanner in the future.
Due to the Building Safety Division losing an Administrative Clerk position as part of
the Fiscal Year 2003-2004 budget reductions, there is currently no staff person or
staff time available to continue the digital imaging effort.
Culver City Building Safety Construction Permit Fees
Building Safety's permit fees were last updated in July 2002 through Council
Resolution No. 2002-R084. Prior to that resolution, the Culver City Building Safety
permit fees were very low compared to other jurisdictions in the Los Angeles Basin
Area, and did not cover the annual operating costs of the Division. The current
Building Safety permit fees cover the annual operating cost of the Division, and are
updated every year based on the Consumer Price Index. However, the current fees
do not make any provision to maintain accessible copies of plans and documents, or
provide for technology upgrades to improve customer service.
Current Culver City Building Safety permit fees remain lower than neighboring
jurisdictions (Attachment No. 1 - Fee Comparison) and most of these building safety
divisions charge a fee to maintain copies of plans (Attachment No. 2 - Other
Jurisdiction Comparison). Please also refer to the attached examples of recent
receipts from the City of Los Angeles Department of Building Safety indicating plan
maintenance and systems development surcharges. (Attachment No. 3 - Plan Check
Receipt; and Attachment No. 4 - Permit Receipt.)
In addition, the overall permit fees charged by the four Culver City Divisions that
typically review most permit applications (Building Safety, Planning, Engineering,
and Fire Prevention) do not cover the construction permit related costs of the
respective Divisions (Attachment No. 5 - Estimated Revenues vs. Expenditures of
City Divisions that Review Permit Applications).

California State law requires local jurisdictions to maintain copies of construction
plans (with the exceptions noted below). State law authorizes the adoption of fees
to pay for plan maintenance and requires jurisdictions to be accountable for the use
of any funds collected.
California Health and Safety Code Section 19850; Maintenance and Copy of
Building Plans: Requires Building Safety jurisdictions to maintain copies of all plans
except for single and multiple dwellings, garages, farm or ranch buildings, and one
story buildings with spans of less than 25 feet.
California Health and Safety Code Section 19132.3; Schedule of Fees, adoption of
ordinance: Allows jurisdictions to recoup the costs of administering construction
permits through permit fees, requires jurisdictions’ permit fees not to exceed the
costs reasonably required to administer construction permits, and states
construction permit fees shall not be levied for general revenue purposes.
California Health and Safety Code Section 19852; Fee: Authorizes local jurisdictions
to recoup the costs of maintaining official copies of construction plans through fees.
California Government Code Sections 66014, 60016 and 60017, Adoption of
Building Permit Fees: Require a local jurisdiction (i) to establish building permit fees
which do not exceed the estimated reasonable cost of providing the service for
which the fee is charged, (ii) to give at least 14-days’ written notice of the meeting at
which the fees will be adopted to any person who has requested that notice (iii) to
hold a regularly scheduled public meeting to receive testimony on the fees before
adoption (iv) to make available to the public at least 10 days before the meeting date
indicating the estimated cost required for the service and (v) to have the fees
become effective no earlier than 60 days after adoption.
Staff recommends a 4% permit fee surcharge be established to fund digital imaging
and storage of plans/documents and to fund technology improvements and
maintenance in the Building Safety, Planning, Engineering, Parks and Fire
Prevention Divisions and Information Technology Department. A 4% surcharge is
reasonable compared to surcharges and permit fees in other jurisdictions. If an
applicant supplies their own digital files in the correct format, one-half (1/2) of the
surcharge fee would be waived. The actual cost for providing the above mentioned
services is estimated to be $50,000 per year based on construction activity at the
current level.
Culver City’s Building Safety Division permit fees for Fiscal Year 2003-2004 were
approximately $1.1 million. The total number of permits issued was 2,600. The total
construction valuation was approximately $55 million and the average permit fee for
Fiscal Year 2003-2004 was $390.City of Culver City, California

If current construction levels remain the same in Fiscal Year 2005-2006, a 4% permit
fee surcharge would result in additional revenues of approximately $50,000, which is
equal to the estimated cost of providing the additional services for the permit. On
average, each applicant would be charged an additional $22 per permit.
If the City Council approves a permit fee surcharge, then staff recommends all funds
collected be given a separate account code, and all funds from that account be used
solely for digital imaging and storage of plans and documents and technology
improvements and maintenance in the Building Safety, Planning, Fire Prevention,
Parks and Engineering Divisions and Information Technology Department. Staff
also recommends that the Building Official and the City Controller be the designees
required to approve all expenditures from the account.
If a 4% permit fee surcharge is approved by the City Council, staff proposes the
funds be allocated in the following areas:
1. 50% to implement digital imaging and storage of plans and documents; and
2. 50% to fund technology improvements and Maintenance in the Building Safety,
Planning, Parks, Fire Prevention, and Engineering Divisions and the Information
Technology Department.
The recommended surcharge would eventually enable Building Safety to provide
many technology upgrades that could result in improved customer service. Some
examples might include:
1. An applicant would be able to apply for and receive permits (that don't require
plan check) over the Internet or on a touch screen computer at the Building
Safety counter. The applicant would then call for the appropriate inspection
when ready.
2. An applicant would be able to view inspection results and permit application
review comments over the Internet or on a computer at the Building Safety
counter.
3. An applicant would be able to view all public information records over the Internet
or on a computer at the Building Safety counter.
4. City inspectors would have mobile computing devices to enable digital input of
inspection results and real time status of construction in Culver City.
FISCAL ANALYSIS:
The estimated $50,000 in revenue that would be received from a 4% surcharge
would be allocated in the following manner:City of Culver City, California

1) Contract digital imaging services to be coordinated and approved by the
Information Technology Department; and
2) Technology improvements and maintenance.

As part of the work plan for developing the Dog Park, staff has met several times
with representatives from the Friends to develop the proposed MOU (Attachment 1)
regarding the relationship between the Friends and the City and each party's
respective duties and responsibilities pertaining to the development, operation and
maintenance of the Dog Park On November 18, 2004, staff and Friends
representatives met with the Subcommittee to receive input and comments on the
MOU On December 7, 2004, staff presented the MOU to the Commission for its
comments and recommendation The Commission voted unanimously (3-0,
Commissioners Daly-Redholtz and Cooper recused themselves due to a conflict of
interest) to recommend approval of the proposed MOU by the City Council
The terms and conditions of the MOU include, but are not limited to, the following
• The MOU may be terminated by either party upon sixty (60) days written
notice
• Friends will hold the City harmless for liability resulting from the Friends
cooperation with the City in developing, operating and maintaining the Dog
Park
• Friends will donate funds for the development and construction of the Dog
Park, when financially feasible
• Friends will maintain bulletin boards located within the Dog Park, which will be
used for the limited purpose of informing the public of dog related issues,
services and events
• City will indemnify the Friends from liability for the activities of the general
public
• City will be responsible for the overall maintenance of the Dog Park and may
close the park to perform maintenance activities when necessary
It is recommended that the City Council review the proposed MOU, provide
comments, and authorize its execution
Maintenance
At the November 18 th Subcommittee meeting, staff and Friends representatives also
received input from the Subcommittee regarding the Dog Park Schedule of
Maintenance Activities (Attachment 2) prepared by Public Works and Parks staff
The Commission, at its December 7th meeting, also reviewed and discussed these
maintenance activities and, although certain members of the Commission had
concerns regarding funding for maintenance costs, they voted unanimously (3-0,

Commissioners Daly-Redholtz and Cooper recused themselves due to a conflict of
interest) to recommend approval
The maintenance activities of the Dog Park include services to be performed by City
staff, as well as services that will be performed by outside contractors In addition, it
was suggested that an account or fund be established for future replacement costs
and capital expenditures The City will ultimately be responsible for covering these
costs
The Subcommittee, as well as City staff and Friends' representatives, discussed an
increase in dog licensing fees as a possible funding source to cover these costs
Currently, Culver City allows seniors and disabled individuals an unlimited number of
free licenses regardless of whether or not the dog is spayed or neutered Many
other cities only waive the license fee for the first dog licensed by a senior, and
additional dogs are licensed at a full or discounted rate The license fees currently
collected by the City do not cover the costs expended for animal care and control
services
Another possible funding source is to increase the number of dogs licensed in the
City Currently, the number of licensed dogs in Culver City is substantially below
other City averages Culver City has approximately 2,400 licensed dogs, however,
according to the most recent census, there are approximately 16,600 households in
Culver City, which should equate to a much higher number of dogs Citywide
It is recommended that the Council discuss these issues, provide comments, and
direct staff to bring back a comprehensive analysis regarding increasing animal
licensing fees and exploring canvassing options to increase the number of dogs
licensed in the City
FISCAL ANALYSIS
Per the MOU, the Friends, as much as financially feasible, will donate funds to assist
the City in the development and construction of the Dog Park, however, the Friends
is unable to commit to covering the cost of maintenance due to the uncertainty of the
organization's ability to raise future funds The execution of the MOU in and of itself
does not create a fiscal impact, however, the City, has an obligation to maintain the
Dog Park at the same level as any other City park In this regard, there is a cost for
maintenance of approximately $5,490 per year (See Attachment 2)
Staff recommends that the City Council consider license fee increases and
additional canvassing efforts to increase the number of dogs licensed in the City,
and direct staff to bring back to the City Council in February 2005 a more

comprehensive discussion of alternatives and a proposed resolution for fee
increases to achieve a goal of additional dog license revenues by $10,000

MEMORANDUM OF UNDERSTANDING
(CULVER CITY DOG PARK)
This Memorandum of Understanding (hereinafter, "MOU") is made and entered into by
and between the City of Culver City (hereinafter, the "City") and the Friends of the
Culver City Dog Park (hereinafter, "FCCDP")
The term of this MOU will commence on and continue thereafter on
a month-to-month basis until terminated by either party upon sixty (60) days prior
written notice to the other party as provided herein
RECITALS AND DEFINITIONS
A City is the owner and operator of the subject property commonly known as the
"Boneyard," which is a part of the Culver City Park located on the corner of
Duquesne Avenue and Jefferson Boulevard in the City of Culver City, County of
Los Angeles, State of California (hereinafter, the "Dog Park")
B In April 2003, the Culver City City Council officially designated and reserved the
Dog Park for the development of an off-leash dog park
C The FCCDP is a not-for-profit, tax exempt corporation consisting of members
and supporting members committed to supporting the development, operation
and maintenance of an off-leash dog park within the boundaries of the City of
Culver City The FCCDP believes that an off-leash dog park can be a clean and
safe environment for all canines and the general public To that end, and
pursuant to its bylaws and articles of incorporation, the FCCDP is committed to
assisting the City in the development, operation and maintenance of the Dog
Park
D The parties acknowledge that the Dog Park is a City park, owned by the City and
operated for the benefit of the general public and canines

claims, losses, injuries, lawsuits, and actions accruing or resulting from
the activities of the general public and canines at the Dog Park
D The FCCDP, its Directors, Officers, Agents, Employees, Members and
Volunteers, shall act in an independent capacity and not as Officers,
Agents, Representatives, or Employees of the City
E The FCCDP, its Directors, Officers, Agents, Employees, Members and
Volunteers agree to waive any and all charges, complaints, claims, losses,
injuries, lawsuits, and actions which may accrue or result from cooperating
with the City in the development, operation and maintenance of the Dog
Park, except for any and all charges, complaints, claims, losses, injuries,
lawsuits, and actions accruing or resulting from the City's sole negligence
The FCCDP, its Directors, Officers, Agents, Employees, Members and
Volunteers agree to inform each and every person or entity assisting the
FCCDP with the development, operation and maintenance of the Dog
Park of this provision, and shall obtain signed waivers from such persons
or entities suitable to, and agreed upon by, the City and will submit said
waivers to the City upon their execution and prior to commencement of
any assistance
F This MOU shall be binding upon, and shall inure to the benefit of, each
party and its Directors, Officers, Officials, Agents, Employees, former
Employees, Members, Volunteers, successors and assigns, and all
persons or entities acting by, through, under or in concert with them
G This MOU constitutes the entire agreement between the parties pertaining
to the subject matters contained herein, and supersedes any and all pnor
or contemporaneous agreements, representations, or understandings of
the parties
H No supplement, alteration, variation, modification, or amendment of this
MOU shall be binding, unless agreed upon in writing by both parties
I Notwithstanding any contrary provisions contained herein, and to provide
for enforcement of this MOU, the parties reserve to themselves the right to
initiate and to pursue any legal action necessary to enforce the terms of
this MOU In the event of legal action, the prevailing party shall be
entitled to recover from the non-prevailing party reasonable attorneys'
fees and costs and expenses actually incurred, in addition to any other

relief the court deems just and proper The parties agree to provide each
other with ninety (90) days' notice of intent to take legal action to enforce
the terms and conditions, responsibilities and duties as outlined in this

to try and resolve any disputes prior to litigation The cost and expense of
such alternative dispute resolution shall be paid by the City The parties
further agree that the proper venue for such legal action shall be the
Superior Court for the County of Los Angeles
The terms of this Agreement shall be interpreted according to the laws of
the State of California
This MOU may be executed in one or more counterparts, each of which
shall be deemed an original, but all of which together shall constitute one
and the same agreement A photocopy of a signed original of this MOU
may be used for all purposes for which a signed onginal can be used
If the City Council finds that it is in the public interest, health and/or
welfare, the City reserves the right to change the Dog Park to a use to be
determined by the City Council

II|109| FCCDP's Rights, Duties and Responsibilities
A If the FCCDP alters its charitable non-profit status, the City reserves the
right to renegotiate and/or terminate this MOU
B The FCCDP shall cooperate with the City in designing the Dog Park, and
shall submit any and all design proposals to the City and/or the City's
designated representative for approval
C The FCCDP will, as much as financially feasible, donate the funds
necessary to develop and construct the Dog Park, including interior and
perimeter amenities, including, but not limited to fencing, signs, trees,
ground covering, fountains, benches, and bulletin boards, in cooperation
with the City
D The FCCDP shall not alter the existing physical contours, features or
improvements of the Dog Park (Interior and exterior) without first
requesting in writing and seeking approval from the City and/or the City's
designated representative The City shall provide a written response
within a reasonable time after the presentation of any and all requests
E The FCCDP shall track and maintain fiscal accountability to all its donors
for funds expended for the development, operation and maintenance of
the Dog Park, and maintain records of financial transactions associated
with donated materials and labor as legally obligated under the provisions
of a 501(c) 3 charitable organization
F The FCCDP shall cooperate with the City in purchasing and restocking
supplies used for clean-up, and in cleaning the Dog Park on a periodic
basis
G The FCCDP shall maintain any and all bulletin boards located within the
Dog Park by removing unauthorized and outdated communications To
control communications posted on the bulletin boards, the FCCDP shall
ensure that such bulletin boards are secure and access is limited to the
FCCDP's Board of Directors and its designees and the City or the City's
designated representative It is understood that the purpose of this
bulletin board is to inform the public of dog related issues, services and
events
H The FCCDP may assist the City in amending the Rules and Regulations
associated with the use of the Dog Park as deemed necessary by either
party

A The City shall ultimately be responsible for the overall development,
operation and maintenance of the Dog Park
B The City shall maintain the Dog Park at the same level as other City
parks
C City reserves the right to remove interior amenities (such as benches,
water fountains or landscaping) if deemed necessary to protect the public
health, safety and/or welfare However, City shall give notice, when
possible, to the FCCDP and an opportunity to discuss the removal prior to
any action
D After discussion with the FCCDP, City shall inspect and review any and all
proposals for the design of the Dog Park and have the right to reject or
amend such proposals at its sole discretion
E After discussion with the FCCDP, City shall inspect and review any and all
proposals to alter the existing physical contours, features, or
improvements of the Dog Park (interior and exterior) and have the right to
reject or amend such proposals at its sole discretion

F City shall pay for all costs of utilities, including but not limited to water,
refuse collection, and electricity
G City shall pay for and maintain an irrigation system (if such system is
deemed necessary by the City)

City shall pay for and implement a graffiti abatement program for the Dog

required under feaeral, state, county and city laws and regulations

If necessary, City shall provide, or cause to be provided, park security,
police and animal control services to protect the general public and

necessary for the FCCDP to effectively fulfill its responsibilities under this

If City requires information from the FCCDP concerning issues related to
the Dog Park which may arise, City shall request such information, and
allow at least seven (7) business days for any and all written responses
from the FCCDP, unless otherwise requested

for maintenance as deemed necessary and shall provide notice of such
closure to the public

City shall inspect, review and approve all proposed signs by the FCCDP
prior to their posting at the Dog Park, including, but not limited to, placards
acknowledging the donors of exterior and interior amenities|10 10| With the cooperation of the FCCDP, City shall create and post signs
which inform the general public about any and all applicable laws,
ordinances, rules and regulations associated with the use of the Dog
Park Such signs shall be conspicuously posted at or near the entrance of

Discussion ensued regarding a staff recommendation for the City
Council to consider license fee increases The increased funds would
go towards the maintenance of the dog park Staff is tentatively
planning to return in February 2005 with proposals
Councilmember Gross expressed concerns that fiscal issues were not
being sufficiently addressed, that the City was willing to indemnify
the Friends of the Culver City Dog Park, and that assumptions were
being made regarding the proposed increase for license fees
Councilmember Gross recommended that this item be postponed for
further analysis and consideration
Further discussion ensued regarding feasibility of using an agreement
similar to those between the City Council and the Little League and
AYSO for maintenance of the dog park by the Friends of the Culver
City Dog Park, and deadline to get information to Los Angeles County
regarding the City's dog license fees Discussion continued
regarding restrictions on what can be posted on a bulletin board to
be located in the dog park It is proposed that only dog related
issues, services and events be posted
Councilmember Vera proposed a motion to adopt the staff
recommendation Councilmember Corlin seconded the motion
Councilmember Silbiger proposed an amendment to allow all City
related activities to be posted on the bulletin board in the dog
park
There was no second to Councilmember Silbiger's amendment

HEREBY RESOLVE as follows|109| ANNUAL DOG LICENSE FEE
A Pursuant to Section 5-27 of the Culver City Municipal Code the
City Council hereby establishes an annual dog license and tag fee of $40 00
except that the fee shall be $20 00 if a certificate is presented from a licensed
veterinarian that the dog has been spayed or neutered A fee of $5 00 shall
be charged for all replacement tags Disabled individuals and senior citizens
