RECOMMENDATION:
Staff recommends the City Council accept the work performed by the contractor, FS
Construction, and authorize filing a Notice of Completion for the Lindberg Park Stone
Building Courtyard Improvements, P-132.
BACKGROUND:
The Lindberg Park stone building and courtyard (located at 5041 Rhoda Way) is
used by the City’s Parks, Recreation, and Community Services Department for
afterschool programs and as a community rental facility. It is also leased by La
Playa Cooperative Nursery School for a morning preschool.
On January 28, 2008, the City Council awarded a construction contract to FS
Construction in the amount of $116,950. The scope of work for the courtyard
improvements which has now been completed by FS Construction, includes the
removal of the existing turf and concrete walkways, the construction of minor
drainage structures and landscaping, and the placement of concrete surface within
most of the courtyard.
DISCUSSION:
Two change orders were issued during the course of construction. The change
orders were issued primarily for extra work items requested by the City to make
construction changes to the grading, upon uncovering the unforeseen condition of
underground concrete tunnels in the courtyard. The final FS Construction contract
price is $128,752. The courtyard has been opened since early February 2009.

FISCAL ANALYSIS:
The Lindberg Park Stone Building Courtyard Improvements was funded by City-
Wide Municipal Building Maintenance Repairs, P-132. There are sufficient funds in
Account Number 42000132 to release the retention amount due to FS Construction
following the expiration of the 35-day lien period.
MOTIONS:
That the City Council:
1. Accept the work performed by the contractor, FS Construction, and authorize
filing a Notice of Completion for Lindberg Park Stone Building Courtyard
Improvements, P-132; and,
2. Authorize the Public Works Director/City Engineer to execute and submit the
Notice of Completion to the Los Angeles County Recorder’s Office for
recordation; and,
3. Authorize the release of the retention funds in the amount of $12,875 to FS
Construction, following the expiration of the 35-day lien period.
