RECOMMENDATION
Staff recommends the City Council adopt a resolution confirming the assessment and ordering the levy for the Sewer User’s Service Charge for Fiscal Year 2017/2018.
PROCEDURE
1. Mayor seeks a motion from the City Council to receive and file the affidavits of publication and posting of notices and correspondence received in response to the public hearing notices; and,
2. Mayor calls for a staff report, and the City Council Members may pose questions to staff as desired; and,
3. Mayor seeks a motion to open the public hearing; and,
4. Mayor seeks a motion to close the public hearing after all public testimony has been presented; and,
5. The City Council discusses the item and arrives at its decision.
BACKGROUND:
On May 30, 2017, the City Council adopted a resolution that approved the Engineer’s Report, declared its intention to order the assessment levy and collection of
assessments, and set the date, time, and place for this public hearing for the Sewer User’s Service Charge.
DISCUSSION:
The rates are proposed to increase 2.7% based on the Bureau of Labor Statistics February Consumer Price Index for All Urban Consumers for the Los Angeles - Riverside - Orange County area for the prior 12-month period ending February 27 for Fiscal Year 2017/2018.
On June 9, 2017 all affected property owners were mailed a notification of the proposed increased assessment and the date, time and location of the public hearing, as required by Proposition 218. Also Proposition 218 required that this public hearing be held not earlier than 45 days after the authorization by the City Council and advertisement of the hearing.
Staff recommends that the City Council adopt a resolution confirming the assessment and ordering the levy for the Sewer User’s Service Charge for Fiscal Year 2017/18.
Pursuant to Section 5.02.035.C of the Culver City Municipal Code (CCMC), any interested persons may file a written protest with the City Clerk (or withdrawal a previously filed protest) until the conclusion of the Public Hearing. Pursuant to CCMC 5.02.035.D, at the conclusion of the hearing, the City Council shall allow or overrule any objections. Unless there is a majority protest present, adoption of the proposed Resolution shall overrule any objections received and confirm and levy the sewer user’s service charge against each parcel as a special assessment and lien on that parcel.
There are two parcels in the Culver City located at 5975 Centinela Avenue and 6695 Green Valley Circle that are within the Los Angeles County Sanitation District #5 for collection of sewage and are excluded from these proposed rate increases. The property owners are only directly charged for the collection and treatment of sewage by the LA County Sanitation District. Culver City is a member of the LA County Sanitation District #5.
FISCAL ANALYSIS
Adoption of the proposed resolution will authorize the collection of the sewer user’s service charge for Fiscal Year 2017/2018. The total sewer charge revenue is projected to be $8,673,000.
During the 45 day public notification period, an error was discovered in the Engineer’s Report and Public Notice of the proposed sewer charges. The base charge for the multi-family code was not increased by the CPI of 2.7%. The loss of the sewer charge revenue will be about $63,343. There was not enough time to revise the Engineer’s Report and conduct another 45 day Public Notice in order to meet the County Assessor’s due date of August 10, 2017, for submission of charges. Therefore staff will propose to adjust the base charge for multi-family in next Fiscal Year 2018/19 to compensate for the lack of increase this fiscal year.
