Inc. for the Ballona Creek Rain Garden Project, P-497; and 2. Authorize filing a Notice of Completion; and 3. Authorize the release of the retention funds in the amount of $15,588.32 after the expiration of the 35-day lien period. BACKGROUND/DISCUSSION: On March 26, 2012, the City Council approved a construction contract with J.D.C., Inc. (JDC) to construct the Ballona Creek Rain Garden Project, P-497. The Ballona Creek Rain Garden Project consisted of the construction of two rain gardens, engineered dispersal chambers, curb and gutters, catch basins, and drainage swales. The work also included new native plants and irrigation complementing the existing landscaping and irrigation. The work has been successfully completed on time and under budget. Change Orders The City Council approved a contingency amount of $42,000.00 for the construction contract. There were two (2) change orders approved in the total amount of City of Culver City, California Agenda Item Report $31,119.95 for the quantity adjustments and extra work for the modification of the retaining wall, drainage systems, and other unforeseen conditions encountered during construction. FISCAL IMPACT: Project Budget P-497 Prop 850 Funds (42380000 PZ497) $380,000.00 Available Funds $380,000.00 Final Project Expenses Original Construction Contract $280,646.50 Change Order $31,119.95 Subtotal $311,766.45 Construction Inspection Services $26,160.00 Geotechnical Construction Services (Observation & Testing) $4,500.00 Total Estimated Project Expenses $342,426.45 The remaining funds will return to the fund balance and will be used in future projects. MOTIONS: That the City Council: 1. Accept the work performed by J.D.C., Inc. for the Ballona Creek Rain Garden Project, P-497; and 2. Authorize the Public Works Director/City Engineer to execute the Notice of Completion and submit it to the Los Angeles County Recorder’s office; and, 3. Authorize the City Manager to release $15,588.32 in retention to J.D.C, Inc. after the expiration of the 35-day lien period.
