RECOMMENDATION:
Staff recommends the City Council approve a professional services agreement with
RTI Consulting Inc. to provide Construction Management Services for the Fire
Station No. 3 Project.
BACKGROUND:
The City Council originally approved RCI Consulting, Inc. as the Construction
Manager for the Fire Station No. 3 Project. Work on the fire station began in August
of 2007. The construction manager assigned by RCI Consulting, Inc. for the Fire
Station No. 3 Project was Paul Bilodeau.
Mr. Bilodeau worked full-time at the job site and provided the City with detailed
observations and reports and invaluable recommendations. Tragically, on or about
January 2, 2009, Mr. Bilodeau was found fatally injured by an unknown assailant.
Due to this incident, construction was suspended between January 9, 2009 and
February 23, 2009. During the suspension, Nick Rollins (principal owner of RCI
Consulting, Inc.) and his staff worked vigorously to weatherproof the building, collect
and organize RCI’s files from the construction trailer and transport them to City Hall,
and provided detailed reports on the project status. After this period, Mr. Rollins
informed the City that RCI would not be available to continue as the construction
manager on this project.

Since RCI Consulting, Inc.’s decision not to remain as construction manager came
at the last minute prior to the recommencement of work on February 23, 2009, a
replacement construction manager had to be found immediately. RTI Consulting,
Inc. was contacted and found to be available for the remaining portion of
construction. RTI Consulting, Inc. has previous experience with the City as
construction manager for the Plunge building renovation in 2004. During this
project, Bob Neiwirth (the principal owner of RTI Consulting, Inc.) provided
outstanding services as the construction manager. Staff now recommends entering
into a contract with RTI Consulting, Inc. to continue to provide construction
management services for this project until completion which is estimated to be the
end of June, 2009.
FISCAL ANALYSIS:
Due to the above mentioned work conducted by RCI Consulting after construction
was delayed (i.e. waterproofing, record collection, organization, and removal,
detailed project cost reports, etc.) there is very little savings under their original
contract amount. The proposed not to exceed contract amount of $43,205 (including
contingency amount) will be included in contingency amount that was originally
planned for the entire project. A recent cost estimate of the entire project indicates
that there are sufficient funds in the Fire Station No. 3 (42000832) budget to
accommodate the cost of RTI Consulting, Inc. agreement.

MOTIONS:
That the City Council:
1. Approve a professional services agreement with RTI Consulting, Inc. to provide
construction management services for the Fire Station No.3 Project for a not-to-
exceed amount of $38,205; and,
2. Authorize the Public Works Director/City Engineer to increase the contract by an
amount not-to-exceed $5,000, if necessary; and,

3. Authorize the City Attorney to review/prepare the necessary documents; and,
4. Authorize the City Manager to execute such on behalf of the City.
