RECOMMENDATION
Staff recommends the City Council adopt a resolution certifying and reciting the fact of the all-mailed ballot Special Municipal Election held on August 26, 2025, and stating the results of such Election (Attachment 1).
BACKGROUND/DISCUSSION
SECTION 1501. of the City Charter states:
“The City Council may, at its discretion, call an election for any reason sanctioned by law at any time it deems necessary. Such election shall be known as a special municipal election.”
SECTION 1503 of the City Charter states:
“Unless otherwise provided by this Charter, all City elections shall be held in accordance with applicable provisions of the then current State law.”
SECTION 1505 of the City Charter states:
“The City Council may, by ordinance, authorize the conduct of elections wholly by mail, under which all votes shall be cast in the manner of absentee ballots.”
Elections Code Sections 10263(b) and 10264 provide, in pertinent parts:
10263.(b) Upon the completion of the canvass and before installing the new officers, the governing body shall adopt a resolution reciting the fact of the election and the other matters that are enumerated in Section 10264.
10264. As soon as the result of the election is declared, the elections official of the governing body shall enter on its records a statement of the result. The statement shall show:
(a) The whole number of votes cast in the City
(b) The names of the persons voted for
(c) The measures voted upon
(d) For what office each person was voted for
(e) The number of votes given at each precinct to each person and for and against each measure
(f) The number of votes given in the City to each person and for and against each measure
Pursuant to the City Charter, and Resolution No. 2025-R034 (calling the election) and Ordinance No. 2025-004 (authorizing an all-mailed ballot election), adopted by the City Council on April 14, 2025, the Special Municipal Election was held on Tuesday, August 26, 2025. At that all-mailed ballot Election, Measure CL, a general tax measure to impose a general transactions and use tax (Sales Tax) at the rate of ¼-cent per dollar was approved by the people.
The City Clerk’s Office, in consultation with the City Attorney’s Office, has prepared the Resolution declaring the results of the election held on Tuesday, August 26, 2025, and other matters as are provided for by law. The Certificate of the Canvass of the Election Returns is included with the proposed Resolution (Exhibit A to Attachment 1).
The proposed Resolution further approves the Ordinance that was passed, approved, and adopted by the voters, and deems it adopted and ratified (Exhibit B to Attachment 10).
The voter turnout percentage for this election was 22%.
