RECOMMENDATION:
That the City Council approve a special permit to the Fiesta La Ballona Committee to
allow a petting zoo, pony rides, K-9 dog demonstration and police horse in Veteran’s
Park for entertainment purposes on August 25-27, 2006.
BACKGROUND:
The Fiesta La Ballona (Fiesta) began in 1951 as a week long festival in honor of the
City’s heritage. The Fiesta is a celebration with events that evoke pride and remind
residents of Culver City’s impressive past while enhancing a sense of community.
Two of the most popular attractions for young children are the petting zoo and pony
rides. The police dogs and horse are enjoyed by people of all ages.
Culver City Municipal Code (CCMC) 9.10.055, Section A prohibits animals within
any City public park unless a special permit has been obtained from City Council.
The special permit allows animals for the purposes of conducting entertainment or
exhibitions. Attachment 1 provides a copy of CCMC 9.10.055, Section A. City
Council has approved a special permit for animals for the Fiesta La Ballona event in
the years past.

DISCUSSION:
The Fiesta La Ballona Committee is requesting that the City Council approve a
special event permit to allow a petting zoo, pony rides, K-9 dog demonstration and
police horse in Veteran’s Park on August 25-27, 2006 during the Fiesta La Ballona
celebration. The special event permit would only pertain to the petting zoo, pony
rides, K-9 dogs and police horse and does not include any other animals that are not
a part of the entertainment of the Fiesta.
FISCAL ANALYSIS:
Approval of a special permit allowing entertainment animals will have no additional
fiscal impact to the City.

case of a handicapped person special circumstances
which cause the location of the tree or evenness of
pavement to become a hindrance for vehicle or
handicapped access
8 Whether removal is necessary for
construction of a street improvement project or other
public improvement/repair work
9 The applicant must show by
demonstrable evidence that the alleged damage to
private property is at least Five Thousand Dollars
($5-000-00)--and--a--caused-lay_the_tree_for_which
removal is sought (examples would be but not limited
to engmeermg or architectural reports photographs
estimates of repair), and
10 The Commission must in its decision
declare whether costs of alternatives to removal of the
tree are reasonable and the basis for their evaluation
of alternatives

final within five (5) working days unless an appeal has
been filed by the applicant or a City official with the
City Clerk for a hearing before the City Council Such

Services and Park Commission s decision unless the
appellant shows the Commission s decision is not
supported by substantial evidence
F Any permit granted whether by the Human
Services and Park Commission or the City Council
shall include any or all of the following conditions
1 The cost of removal shall be paid by the
applicant,
2 The cost of replacement shall be paid by
the applicant
3 A determination as to the size and
location of the replacement tree,
4 Such other conditions as the
Commission or Council deems appropriate

§ 9 10 045 CELEBRATIONS IN PARKS,
PERMITS
Except as hereinafter provided no company,
society or organization shall hold or conduct any
picnics celebrations parade service or exercises in
any public park- , without first obtaining permission
from the person or persons duly authorized by the
Human Services Director and agreeing to conform to
the rules contained in the application No person shall
take part m any picmc-celebration parade service or
exercise held or conducted contrary to the provisions
hereof, except that nothing m this Section shall be
construed as preventing mdividual families from using
parks and facilities for picnics and the like when no
reservations have been made and no permit has been
issued therefor covering the date requested

§ 9 10 050 OBSTRUCTING PATHWAYS
PROHIBITED
No person shall assemble collect or gather
together m any walk, dnveway passageway or
pathway in any park or in other places set apart for the
travel of persons or vehicles m or through any park
or occupy the same so that the free passage or use
thereof by persons or vehicles passing along the same
shall be obstructed in any manner

§ 9 10 055 PROHIBITIONS
Within the limits of any public park it shall be
unlawful for any person
A Having charge care custody or control of
any dog, or other animal fowl or reptile to cause
permit or allow the same to be within the limits of
any public park within the City unless such personParks, Public Buildings and Property 111
shall have obtained a special permit from the City
Council to conduct an entertainment or exhibition in
which an animal is a participant

B To carry or discharge any airgun or
firearm, or discharge any missile from a slingshot or
bow, or bring, or have in his possession, or set off or
otherwise cause to explode or discharge or burn any
firecrackers, torpedoes, rockets or other fireworks or
explosives or inflammable material or discharge
them or throw them into any such areas from land or
highadjaceut thereto—This-prohibition-includes any substance compound, mixture or article that in
conjunction with any other substance or compound
would be dangerous from any of the foregoing
standpoints This provision, however, shall not
prevent the holding of fireworks exhibitions or
displays in public parks or places when authorized by
the City Council
C To swim, bathe, wade in, or pollute the
water of any fountain or pond within a park or
playground area
D To build or attempt to build a fire, except
in such areas and under such regulations as may be
designated by the Human Services Director No
person shall drop, throw, or otherwise scatter lighted
matches, burning cigarettes or cigars, tobacco paper
or other inflammable material, within any park area
or on any highway, road or street abutting or
contiguous thereto
E To camp or lodge therein provided that
special permission may be given to youth
organizations for special demonstration purposes to
temporarily mamtam such camp or lodge
F To ride or drive any horse or other animal,
or propel any vehicle, cycle, or automobile elsewhere
than on the roads or drives provided for such
purpose
G To leave a bicycle lying on the ground or
paving, or set against trees, or m any place or
position where other persons may trip over or be
injured by it, or leave a bicycle in a place other than
a bicycle rack when such is provided and there is
space available, or ride a bicycle other than on the

right hand side of the road paving as close as
conditions permit and bicycles shall be kept in single
file when two or more are operating as a group
Bicyclists shall at all times operate their machines
with reasonable regard to the safety of others signal
all turns, pass to the right of any vehicle they are
overtaking and pass to the right of any vehicles they
may be meeting
H To sleep or protractedly lounge on the seats,
or benches or other areas, or engage in loud, riotous,
boisterous, threatening, abusive, insulting or indecent
language, or engage m any disorderly conduct or

attention in any way to any article or service for sale

K To practice, carry on, conduct or solicit for
any trade, occupation business or profession without
the permission of the City Council
L To drive or have any dray, truck, wagon
cart, or other traffic vehicle carrying goods or
regularly used or employed in carrying goods
merchandise, lumber, machinery, oil, manure dirt,
sand or soil or any article of trade or commerce, or
any offensive article or material whatsoever, upon
any road or drive except such as may be especially
provided or designated for such use, or such as may
be authorized by permit from the Human Services
Director
M To take part in or abet the playing of any
games involving thrown or otherwise propelled
objects such as balls, stones arrows javelins, or
a
