RECOMMENDATION:
It is recommended that the City Council discuss whether or not it wishes to direct the
City Manager to place on a future agenda an item for the City Council to take
positions on one or more of the Propositions appearing on the November 6, 2012
Ballot.
BACKGROUND:
At the City Council meeting of September 24, 2012, the City Council directed the
City Manager to place on a future agenda a discussion on whether the City Council,
as a matter of policy, wanted to take positions on one or more of the statewide
propositions appearing on the November 6, 2012 General Election.
Past practice of prior City Councils has been to consider such positions infrequently.
On a few occasions since 2004, the City Council has taken positions on statewide
ballot measures. For example, on September 27, 2004, the City Council adopted
Resolution No. 2001-RO64 supporting Proposition 1A (Protection of Local
Government Revenues. Legislative Constitutional Amendment). At that same City
Council meeting, the City Council considered whether to take a position on
Proposition 71 (California Stem Cell Research and Cures Initiative) and gave
individual viewpoints regarding the issue. Following a discussion amongst the City
Council Members, the motion to adopt a resolution supporting Proposition 71 failed
(1 – 3, with one abstention).

On September 25, 2006, the City Council adopted Resolution No. 2006-R067
Supporting Propositions 1A (Transportation Funding Protection); 1B (Highway Safety,
Traffic Reduction, Air Quality, and Port Security Bond Act); 1C (Housing and
Emergency Shelter Trust Fund Act of 2006); 1D (Kindergarten-University Public
Education Facilities Bond Act); 1E (Flood Control and Drinking Water Structures);
and 84 (Water Quality, Safety and Supply. Flood Control. Natural Resource
Protection. Park Improvements. Bonds. Initiative Statute) on the November 2006
Ballot and directed that copies of the adopted Resolution be sent to Governor Arnold

District, and the League of California Cities.
On September 22, 2008, the City Council adopted a position of support for
Metropolitan Transportation Authority’s Measure R on the November 4, 2008 Ballot.
DISCUSSION:
At tonight’s City Council meeting, the City Council may determine that it wants to
agendize a discussion to take a position on one or more of the statewide ballot
measures appearing on the November 6, 2012 General Election Ballot, which are:
• Proposition 30 - Temporary Taxes to Fund Education. Guaranteed Local
Public Safety Funding. Initiative Constitutional Amendment.
• Proposition 31 - State Budget. State and Local Government. Initiative
Constitutional Amendment and Statute.
• Proposition 32 - Political Contributions by Payroll Deduction. Contributions to
Candidates. Initiative Statute.
• Proposition 33 - Auto Insurance Companies. Prices Based on Driver's History
of Insurance Coverage. Initiative Statute.
• Proposition 34 - Death Penalty. Initiative Statute.
• Proposition 35 - Human Trafficking. Penalties. Initiative Statute.
• Proposition 36 - Three Strikes Law. Repeat Felony Offenders. Penalties.
Initiative Statute.
• Proposition 37 - Genetically Engineered Foods. Labeling. Initiative Statute.

There is no fiscal impact to direct staff to bring back a staff report and proposed
resolution for City Council’s consideration relating to the November 6, 2012 ballot
measures.
