RECOMMENDATION
Staff recommends the City Council (1) approve an amendment to the existing construction contract with Ortiz Enterprises, Inc. in the amount of $470,000 for the Construction of the Culver Boulevard Realignment Project, PZ-460 (the “Realignment Project”) and the Stormwater Treatment Project, PR-002 (the “Stormwater Treatment Project”) (the Realignment Project and the Stormwater Treatment Project are collectively referred to as “Project”); (2) approve an amendment to the existing professional services agreement with Michael Baker International for construction management and inspection services in an amount not-to-exceed $149,592; (3) approve a related budget amendment allocating funding from STPL Metro Local Fund Exchange to PZ-460 project (four-fifths vote requirement); and (4) approve a related budget amendment allocating funding from the Measure CW Clean Beach/Clean Ocean Fund to the PR-002 project (four-fifths vote requirement).
BACKGROUND
The Culver Boulevard Realignment and Stormwater Treatment project broke ground in March 2020 and consists of two major elements of work.
The Realignment Project separates the eastbound and westbound lanes of Culver Boulevard with an 8-foot-wide raised median and provides a 5-foot-wide buffer with colored pavers between the travel lane and parking lane. New traffic signals and dedicated left turn lanes are to be installed at the intersections with Harter Avenue and Huron Avenue. In order to accommodate these improvements, the existing 60-foot-wide median has been reconstructed and moved to the north by approximately 15 feet. The Stormwater Treatment Project consists of a retention basin and filtration system to capture and treat stormwater/urban runoff from approximately 297 acres of drainage area. A portion of the captured run-off will be stored in an underground retention basin and will be used to supplement the required irrigation for the proposed landscaping along Culver Boulevard. The excess captured run-off will be filtered and discharged back into the Harter Avenue storm drain downstream of the project as treated water, in compliance with the City’s Municipal Separate Storm Sewer System (MS4) permit.
On September 23, 2019, City Council approved a contract with Ortiz Enterprises, Inc. in the amount of $18,903.351, and a professional services contract with Michael Baker International for Construction Management and Inspection services in an amount not-to-exceed $1,248,951. On June 8, 2020, Council approved an amendment to the Michael Baker contract in the amount of $218,672 for Labor Compliance and Monitoring Services.
Typically, construction contracts include a contingency of 10%. However, the Culver Boulevard project contract only initially included a contingency of 8%. Because of this, standard unforeseen site issues and delay costs have exceeded the initially authorized not-to-exceed contract amount. The Ortiz contract needs to be increased by $470,000. In order to achieve a durable and quieter driving surface, the final asphalt treatment of Culver Boulevard in the project area will be upgraded from a slurry seal to rubberized asphalt, a sustainable material made of recycled rubber tires. The differential cost of the asphalt upgrade is $350,000 and will be paid from the STPL Metro Local Fund Exchange fund. Additionally, due to feedback from the Citizen Advisory Committee regarding the height and visual impact of the stormwater project’s electrical equipment, a greenscreen fence, landscaping and irrigation connections will be installed around the electrical panels to shield the equipment. The cost of screening and landscaping the electrical panel area is $120,000 and will be paid from Measure CW Clean Water Clean Beach fund.
To account for an extended construction period caused by Covid-related delays in materials procurement and a conflicting Southern California Edison (SCE) utility undergrounding project that prevented the final placement of pavers and asphalt on Little Culver Boulevard as scheduled, the Michael Baker contract must be extended through the new proposed construction completion date of January 31, 2022. The construction management and inspection costs are split 60/40 between the Stormwater and Realignment projects, and therefore $89,755 will be paid from the Measure CW Clean Water Clean Beach fund and $59,837 will be paid from the Metro Local Fund Exchange fund.
FISCAL ANALYSIS
The allocation of additional funding to the projects requires a budget amendment, which requires a four-fifths vote. $409,837 needs to be appropriated from the STPL Metro Local Fund Exchange fund 42000000.211260 to 42080000.730100.PZ460.
$209,755 will be appropriated from the Measure CW Clean Water Clean Beach fund 43400000.343836 to 434.80000.730100.PR002.

MOTION
That the City Council:
1. Approve an amendment to the existing construction contract with Ortiz Enterprises, Inc. for the Culver Boulevard Realignment, PZ-460 and Stormwater Treatment Project, PR-002 in the amount of, $470,000;
2. Approve an amendment to the existing professional services agreement with Michael Baker International for construction management and inspection services for the Culver Boulevard Realignment, PZ-460 and Stormwater Treatment Project, PR-002 in an amount not-to-exceed $149,592;
3. Approval of a Related Budget Amendment Allocating $409,837 From STPL Metro Local Fund Exchange to the PZ-460 Project (four-fifths vote requirement);
4. Approval of a Related Budget Amendment Allocating $209,755 From Measure CW Clean Water Clean Beach to the PR-002 Project (four-fifths vote requirement);
5. Authorize the City Attorney to review/prepare the necessary documents; and
6. Authorize the City Manager to execute such documents on behalf of the City.
