RECOMMENDATION:
Staff recommends the City Council adopt a Resolution:
1. Ordering the Preparation of the Engineer’s Report for the Higuera
Street Landscaping and Lighting Maintenance District - Fiscal Year
2010-2011; and,
2. Declaring its Intention to Order the Levy of Annual Assessments for
Fiscal Year 2010-2011; and,
3. Setting a Public Hearing for June 14, 2010, at 7:00 p.m. in the Mike
Balkman Council Chambers.
BACKGROUND/DISCUSSION:
The Higuera Street landscaping and lighting improvements were installed in 1995 at
the request of the property owners. The Assessment District was formed and the
boundary includes properties on both sides of Higuera Street between Lindblade
Avenue and Hayden Avenue. Each of the properties directly or indirectly benefits
from the public improvements maintained in the District.
This year staff is proposing no increase to the assessment district levy.
Should the City Council adopt this Resolution, a public notice of the required public
hearing will be published and posted no later than Thursday, May 27th, and the City
Engineer will prepare a comprehensive report containing detailed information on the
actual and estimated charges that are proposed. The report will be made available

for public review, at least ten (10) days before the Public Hearing at the City Clerk’s
office.
Adoption of the proposed resolution will schedule a public hearing for June 14,
2010. During the scheduled Public Hearing, the City Council will consider any and
all protests against the proposed levy, review the Engineer’s Report, and then
consider the levy of the proposed assessments for Fiscal Year 2010-2011.
FISCAL ANALYSIS:
There is no General Fund fiscal impact of the proposed action. The preparation of
the Engineer’s Report will be completed by staff, with appropriate charges for staff
time recouped from the assessment district.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CULVER CITY, CALIFORNIA, ORDERING THE
PREPARATION OF AN ENGINEER'S REPORT
PURSUANT TO THE PROVISIONS OF CHAPTER
15.01 OF THE CULVER CITY MUNICIPAL CODE AND
DECLARING ITS INTENTION TO ORDER THE
ANNUAL ASSESSMENT LEVY FOR THE HIGUERA
STREET LANDSCAPING AND LIGHTING
ASSESSMENT DISTRICT AND SETTING THE TIME
AND PLACE FOR THE PUBLIC HEARING.
WHEREAS, the City Council of the City of Culver City desires to conduct
proceedings for considering the annual assessment of an assessment district pursuant
to the terms and provisions of Section 150t070 of Chapter 15.01 of the Culver City
Municipal Code, in what is known and designated as the 'HIGUERA STREET
LANDSCAPING AND LIGHTING ASSESSMENT. DISTRICT;" and
WHEREAS, the City Council of the City of Culver City desires to complete
the proceedings for the annual levy of the assessments as required by Article XIII (C)
and (D) of the Constitution of the State of California (Proposition 218); and
WHEREAS, these proceedings for the annual levy of assessments shall
relate to the fiscal year commencing July 1, 2010 and ending June 30, 2011: and
WHEREAS, the provisions of Section 15.01.055, require a written
engineers report consisting of the following:
1. A diagram of the area proposed to be assessed; and

NOW, THEREFORE, the City Council of the City of Culver City, DOES
HEREBY RESOLVE as follows:
1. The above recitals are all true and correct.
2_ The City Council of the City of Culver City declares its intention to
levy the annual assessment for fiscal year 2010/2011.
3.
The City Engineer is hereby ordered to prepare and file with the
City Clerk, for submission to the City Council, an Engineer's Report relating to said
annual assessment and levy in accordance with the provisions of Section 15.01.055 of
the Culver City Municipal Code.
4. Upon receipt of the City Engineer's report, and in accordance with
the provisions of Section 15.01_070 of the Culver City Municipal Code, the City Clerk is
hereby ordered to give notice of the time and place a public hearing will be held by the
City Council to consider objections and protests.
5. A pubic hearing is hereby set for June 14, 2010 at 7:00 p.m. in the
City Hall Counbil Chambers, located at 9770 Culver Boulevard, Culver City, California
90232.
