RECOMMENDATION
Staff recommends the City Council (1) adopt a resolution reciting the facts and certifying the results of the Special Municipal Election held on November 8, 2016 per California Elections Code Section 10263; and (2) adopt a resolution setting the regular meetings of the City Council for the calendar year 2017.
BACKGROUND/DISCUSSION
ELECTION RESULTS
A Special Municipal Consolidated Election was held on Tuesday, November 8, 2016, which included four (4) Culver City ballot measures comprised of one Ordinance and three Charter amendments the results of which are as follows:
Measure CA (majority approval requirement): Shall Section 607 and Section 700 of the Charter of the City of Culver City be amended to change the appointing authority and the reporting responsibilities of the Fire Chief and Police Chief from the City Council to the City Manager?
Yes: 5,958 35.35%
No: 10,898 64.65%
Measure CB (majority approval requirement): Shall Section 602 of the Charter of the City of Culver City be amended to provide for the ineligibility of a person who has resigned from the City Council to run for the Office of City Council Member for a period of two years from the date of such resignation?
Yes: 11,749 (70.21%)
No: 4,986 (29.79%)
Measure CD (majority approval requirement): Shall Section 608 of the Charter of the City of Culver City be amended to authorize the City Council to determine the dates of Regular Meetings of the City Council?
Yes: 12,201 (72.79%)
No: 4,560 (27.21%)
Measure CW (2/3 approval requirement): CULVER CITY SAFE/CLEAN WATER PROTECTION MEASURE. To protect public health/groundwater supplies and prevent toxins and pollutants from contaminating local waterways, creeks and beaches, by improving storm drains/infrastructure to capture/clean urban runoff; preserving open space; and complying with clean water laws, shall Culver City establish a $99 clean water parcel tax; generating approximately $2,000,000 annually until ended by voters, requiring independent audits, public oversight, low-income senior citizens discounts and local control of funds?

The Los Angeles County’s Registrar Recorder/County Clerk certified the results on December 2, 2016 and the results were declared official by the Los Angeles County Board of Supervisors on December 6, 2016.
The election returns provided by the Los Angeles County’s Registrar Recorder/County Clerk certify passage of the Ordinance by over two-thirds of the voters casting votes in the election with a final vote of 74.14% and shall be in full force and effect on December 22, 2016, 10 days after the certification by the City Council.
The Ordinance, which includes the full text of Measure CW, is included for reference as an attachment and will be signed by Mayor Clarke and sent for codification by the City Clerk.
The charter amendments that were passed, shall be deemed to be ratified, but shall not take effect until accepted and filed by the California Secretary of State, pursuant to California Government Code Section 34460.
The City Attorney, in conjunction with the Deputy City Clerk, prepared the resolution declaring the results for the City of Culver City and declaring other matters as are provided by the Charter of the City of Culver City.
REGULAR MEETING DATES
The amended Charter Section 608 now authorizes the City Council to determine the regular meetings at such times as it shall fix by ordinance or resolution and may adjourn any regular meeting to a date certain, which shall be specified in the order of adjournment and when so adjourned, each adjourned meeting shall be a regular meeting for all purposes.
The Culver City Municipal Code (CCMC), § 3.01.100, states that all official, regular and adjourned meetings of the City Council shall be held in the City Hall on the second and fourth Mondays of each month at 7:00 p.m. And goes on to state that “if any regular meeting shall fall on a legal holiday, no meeting shall be held on such holiday, but shall be held on the next succeeding day thereafter that is not a holiday at 7:00 p.m.”
Consistent with the amended Charter Section 608 and CCMC § 3.01.100, the proposed Resolution sets the City Council’s regular meeting dates for calendar year 2017 and authorizes the City Council, at a regular meeting, to change those dates by resolution.
Exhibit A outlines all of the recommended meeting dates for 2017. It should be noted that there are three dates that are near a holiday. Traditionally, staff has recommended that they be changed or cancelled. April 10, 2017 is the Monday night that begins Passover, which ends at sundown on April 11, 2017. Staff recommends holding this meeting on Tuesday, April 11, 2017. Staff also recommends that Council cancel the second meeting in November and December to accommodate Thanksgiving and Christmas schedules
These are dates proposed by staff and are presented to City Council for discussion and approval.
