RECOMMENDATION

 

Staff recommends the City Council approve a Memorandum of Agreement regarding the administration of and cost sharing for implementing a Coordinated Integrated Monitoring Program (CIMP) for Ballona Creek (BC) watershed in an amount not-to-exceed $138,290 ($125,718 base amount plus $12,572 contingency).

 

 

BACKGROUND

 

In November 2012, the Los Angeles Regional Water Quality Control Board (LARWQCB) adopted a new countywide Municipal Separate Storm Sewer System (MS4) Permit. The MS4 permit is in effect and identifies conditions and requirements that municipalities must comply with in order to protect the area’s water resources. Permit compliance may be obtained by developing and implementing an Enhanced Watershed Management Program (EWMP) and CIMP.

 

In June 2013, Culver City, the County of Los Angeles, and the City of Los Angeles indicated intent to collectively prepare the EWMP and CIMP to achieve compliance with Total Maximum Daily Loads (TMDLs) for the BC watershed.  A cost sharing agreement for EWMP/CIMP plan development was approved by the City Council on November 12, 2013.  The City of Los Angeles is identified as the lead agency and is performing all administrative and project management tasks related to EWMP/CIMP development.

DISCUSSION

 

In June 2014, the BC watershed group submitted the draft CIMP to the LARWQCB for review. After receiving LARWQCB’s comments in March 2015, the group revised and resubmitted the draft CIMP in July 2015, which was conditionally approved on August 7, 2015.

 

The CIMP includes sample collection, in-situ measurements, laboratory analyses, design and construction of automated water sampling stations, source investigations, and water quality data reporting (including annual reports).

 

 

FISCAL ANALYSIS

 

The estimated total cost to implement the CIMP for Ballona Creek is $3,325,000.  The Los Angeles County Flood Control District pays for 5% and then the remainder is split among the remaining jurisdictions according to their drainage area.  The estimated cost for Culver City is $125,718 and will be invoiced as follow:

Contingency will not be invoiced unless there is a need for using it, as agreed upon by the group. Funding for the proposed MOU is provided in the City Council Adopted Budget for Fiscal Year 2015/2016 - Capital Improvement Project budget PZ-497, account number 42080000.730100.

RECOMMENDED MOTION(S)

 

That the City Council:

 

1.                     Approve a Memorandum of Agreement regarding the administration and cost sharing of implementing a Coordinated Integrated Monitoring Program (CIMP) for Ballona Creek (BC) watershed in an amount not-to-exceed $138,290 ($125,718 base amount plus $12,572 contingency); and,

 

2.                     Authorize the City Attorney to review/prepare the necessary documents; and,

 

3.                     Authorize the City Manager to execute such documents on behalf of the City.
