RECOMMENDATION:
Staff recommends the City Council award a contract to FS Construction as the
lowest responsive and responsible bidder for construction of Americans with
Disabilities Act (ADA) Improvements at Veterans’ Memorial Park, P-924.
BACKGROUND:
The Veterans’ Memorial Park Playground Project, P-924, has three major
components: (1) installation of new playground equipment for children ages 5 – 12
and engineered wood fiber safety surfacing (an ADA compliant surfacing material);
(2) installation of an ADA accessible path of travel from the disabled parking spaces
on Barman though the Park to the playground area; and, (3) installation of new
playground equipment for children ages 2 – 5 and engineered wood fiber safety
surfacing. The funding sources and status of the components of the project are as
follows:

On May 26, 2009, the City Council adopted a Resolution allocating funding from the
Community Development Block Grant (CDBG) program to be used for the
enhancement of the accessibility of the playground, including associated paths of
travel, at Veterans’ Memorial Park. The ADA path component of the project will City of Culver City, California

provide for the elimination of architectural barriers, in accordance with the ADA, at
Veterans’ Memorial Park. ADA improvements will allow accessibility for the City’s
disabled population, the elderly, and residents with mobility restrictions.
Improvements will include adding accessible surfacing to complete the path of travel
across the Park from Barman Avenue on the south to the playground area on the
north, and related improvements. The type of surfacing to be used will be
decomposed granite (DG), which is an ADA compliant surfacing material. The City
Council approved the plans and specifications and authorized the advertizing of bids
for this component of the project on January 25, 2010.
DISCUSSION:
On August 12, 2010, the City Clerk’s Office staff publicly opened the bids. Five
contractors responded with the following bid amounts:

* FS Construction submitted a total base bid of $21,500. After correcting a
mathematical error by using the unit prices, as required by the contract document,
the correct total is $20,500.
Staff reviewed the five sets of contractor bid documents and determined FS
Construction submitted the lowest total base bid. Staff reviewed the bid proposal
from FS Construction and found its bid responsive and complete. Its bid bond,
contractor’s license, and worker’s compensation insurance were reviewed and
determined to meet City requirements. FS Construction has completed several
projects for the City of Culver City with excellent performance. Therefore, staff
recommends that the City Council award a contract to FS Construction as the lowest
responsive and responsible bidder for construction of Americans with Disabilities Act
(ADA) Improvements at Veterans’ Memorial Park, P-924. Construction management
and inspection of the project will be conducted by City staff.
FISCAL ANALYSIS:
The Veterans’ Memorial Park Playground Project, P-924, is fully funded by grants
and requires no General Fund monies. The Community Development Block Grant
(CDBG) funds for the ADA accessible path component of the project were allocated
during the Fiscal Year 2009/2010 City budget process; however, no funds were
expended on the project during that period. Funds for the project will be carried over
into Fiscal Year 2010/2011, providing sufficient unencumbered CDBG funds in City of Culver City, California

Account Number 42800924.730100 (CDBG/Vets’ Memorial Park Playground
Improvements) for FS Construction’s base bid of $20,500 and a 10% change order
authority totaling $2,050, if necessary.
MOTIONS:
That the City Council:
1) Award a contract to FS Construction, as the lowest responsive and responsible
bidder, for ADA Improvements at Veterans’ Memorial Park, P-924, in the amount
of $20,500, based on its base bid; and,
2) Authorize the Parks Division Manager to approve change orders in the amount
not-to-exceed $2,050, if necessary; and,
3) Authorize the City Attorney to review/prepare the necessary documents; and,
4) Authorize the City Manager to execute such documents on behalf of the City.
