BACKGROUND/DISCUSSION
On September 22, 2024, Governor Newsom signed Assembly Bill 2561 (AB 2561) into law, to amend the Meyer’s-Milias-Brown Act (“MMBA”), requiring public agencies to publicly report on their job vacancies and recruitment and retention efforts to increase transparency and accountability in hiring.
Under AB 2561, public agencies must present an annual report on vacancies and recruitment and retention efforts at a public hearing before their governing body at least once per fiscal year and prior to adopting the final budget. The report must also include information on any policies or practices that may be affecting the agency’s ability to fill positions. Further, the recognized employee organization for a bargaining unit may make a presentation at the public hearing at which the public agency presents the status of vacancies and recruitment and retention efforts for positions within that bargaining unit.
If vacancies exceed 20% of authorized full-time positions in a bargaining unit, additional information must be provided upon request from the recognized employee organization, including:
• Total number of vacancies in the bargaining unit;
• Total number of applicants;
• Average time to fill positions; and
• Opportunities to improve compensation and working conditions.
Currently, the City of Culver City does not exceed the 20% vacancy threshold in any bargaining unit.
FISCAL IMPACT
None.
