RECOMMENDATION
Staff recommends that the City Council adopt an ordinance to incorporate the Citywide Residential and Mixed Use Objective Design Standards by reference and ensure consistency with Culver City Municipal Code (CCMC) Title 17 - Zoning, as stated in Exhibit A of the Ordinance (Attachment No. 1).
BACKGROUND
On February 12, 2025, the Planning Commission recommended the City Council approve the Citywide Residential and Mixed Use Objective Design Standards (ODS), associated Zoning Code Amendment (ZCA) P2024-0310-ZCA, and exemption from CEQA.
On March 17, 2025, the City Council unanimously introduced the proposed ordinance (Attachment 1) for Zoning Code Amendment P2024-0310-ZCA, and adopted a resolution approving the Citywide Residential and Mixed Use ODS.
The California legislature has adopted several housing and land use laws to address the state's housing crisis, including Senate Bill (SB) 35 and SB 330 which require approval of housing developments based on only "objective standards," certain qualifying criteria, and within specified timeframes.
The City's Housing Element, certified October 10, 2022, includes programs to facilitate housing, including developing ODS. The Land Use and Community Design Element of the General Plan, effective October 9, 2024, also includes policy goals and implementation actions related to the adoption of ODS.
The ZCA incorporates a reference to the ODS and makes minor revisions to residential and mixed use standards to ensure alignment and consistency between the Zoning Code and the ODS, as shown in Exhibit A of the proposed ordinance (Attachment 1).
The proposed ordinance is presented for adoption by the City Council.
ENVIRONMENTAL DETERMINATION
Pursuant to the California Environmental Quality Act (CEQA) Guidelines, the ZCA related to the ODS is exempt per Section 15061(b)(3), because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. On March 17, 2024, the City Council determined that no further environmental analysis is required.
FISCAL ANALYSIS
The proposed Zoning Code Amendment has no anticipated fiscal impact to the City.
