RECOMMENDATION:
Staff recommends the City Council discuss and provide comments and
recommendations to Mayor Sahli-Wells regarding a mayoral appointment to the
Oversight Board established by AB 1X 26 (the Redevelopment Agency Dissolution
Bill) to fill the vacant seat of the representative of the recognized employee
organization (the Culver City Management Group “CCMG”) representing the largest
number of former Redevelopment Agency employees employed by the Successor
Agency. This seat was formerly occupied by Mr. Nick Kimball, a member of the
CCMG at that time.
BACKGROUND:
Pursuant to AB 1X 26 (AB 26), the Redevelopment Agency Dissolution Bill, the
former Culver City Redevelopment Agency (Former CCRA) was dissolved effective
at 12:01 AM on February 1, 2012. As provided in AB 26, on January 9, 2012, the
City Council adopted Resolution No. 2012-R001 affirmatively electing to have the
City serve as the Successor Agency to the Culver City Redevelopment Agency
(Successor Agency).

AB 26 (specifically, Section 34179 of the California Health and Safety Code) also
established an Oversight Board comprised of seven members, including one
member selected as follows:
? One member representing the employees of the former redevelopment
agency appointed by the mayor or chair of the board of supervisors, as
the case may be, from the recognized employee organization representing
the largest number of former redevelopment agency employees employed
by the successor agency at that time.
In this case, the CCMG represents the largest number Former CCRA employees.
On February 13, 2012, the City Council adopted Resolution No. 2012-R022, which
imposes a duty on the Mayor of Culver City to consult with and receive the approval
of the City Council prior to making appointments pursuant to authority granted in
state law. This Resolution, in essence and excepting cases of emergency, requires
the Mayor to consult with and receive the approval of the City Council prior to
making Mayoral appointments pursuant to authority conferred upon the Mayor by
State Law.
After considering public comment and discussing the item, on February 13, 2012,
the City Council took the following action:
MOVED BY MAYOR O’LEARY, SECONDED BY COUNCILMEMBER COOPER
AND UNANIMOUSLY CARRIED, THAT THE CITY COUNCIL PROVIDE
COMMENTS AND RECOMMEND THAT THE MAYOR APPOINT
COUNCILMEMBER WEISSMAN AND SENIOR MANAGEMENT ANALYST
NICK KIMBALL TO SERVE ON THE OVERSIGHT BOARD ESTABLISHED BY
AB 1X 26.
Shortly thereafter, then Mayor O’Leary appointed Mr. Kimball, a member of the
CCMG at that time, (and Council Member Weissman) to the Oversight Board. Mr.
Kimball served in this capacity until his departure from Culver City employment on
Thursday, July 17, 2014.
DISCUSSION:
Pursuant to Resolution No. 2012-R022, the City Council may wish to consider
providing its advice and consent to the Mayor regarding a successor to Mr. Kimball.
To assist the Mayor in appointing a duly qualified person as Mr. Kimball’s successor,
staff has presented the following name for consideration:

Should the City Council concur in this nomination, a letter signed by the Mayor will
be prepared announcing the appointment of Ms. Barnes to the Oversight Board. Ms.
Barnes would then participate in the Regular Meeting of the Oversight Board
scheduled for Thursday, September 11, 2014.
FISCAL ANALYSIS:
The discussion of this topic does not create a fiscal impact to the City. Section
34179(c) provides that the Successor Agency shall pay for all of the costs of
meetings of the Oversight Board and may include such costs in its administrative
budget.
