City of Culver City, California City Council Agenda Item Report RECOMMENDATION: Staff recommends the City Council approve an amendment to the professional services agreement with Nickerson Company, to support the Public Works Department for general public works inspection, for an additional not-to-exceed amount of $40,000 with the amended agreement expiring on October 31, 2007. BACKGROUND: On October 10, 2005, the City Council approved professional services agreements with Project Partners, Berryman and Henigar, and Nickerson Company for public works inspection services for a total aggregate not-to-exceed cost of $65,000. These agreements originally expired on June 30, 2006. The purpose of the agreements was to alleviate the workload of the Public Works Inspector due to the Symantec development and several large utility projects. On May 22, 2006, the City Council approved amending the existing agreements with Project Partners, Berryman and Henigar, and Nickerson Company for a total aggregate not-to-exceed cost of $65,000 with the amended agreements to expire on June 30, 2007. DISCUSSION: The existing agreements not-to-exceed cost has been exhausted. The Symantec development, located at the corner of Slauson Boulevard and Bristol Parkway, has required a tremendous amount of public works inspection such as grading, site drainage, erosion control, sewer main, storm drain, and street construction. Vern Nickerson of Nickerson Company of Manhattan Beach, a retired Culver City Senior Public Works Inspector, has been conducting these general public works inspections due to his company having the lowest hourly rate of $75 an hour, his historical knowledge of Culver City soil conditions and experience with large building projects, and his availability. He has done an excellent job. Staff is recommending extending the professional services agreement with Nickerson Company of Manhattan Beach. The following inspections will be required for the Symantec project: Underground Utilities Water, Gas, Telephone, and Sewer a. Install fire water line – work in progress b. Install domestic water line c. Install domestic sewer line – work in progress d. Install underground telephone line Offsite Work Street improvements a. Street asphalt reconstruction where damaged. b. New sidewalks, drive approaches, curbs, and gutters c. Street trees in existing tree wells d. Roadway striping and signage e. Sewer construction – work in progress Onsite Work South, North, East, Central Areas, and Service Yard a. Miscellaneous drainage inlets b. Roadway curbs, gutters, aprons and paving – South c. Stone paving – Central d. Roadway concrete ribbons and paving – East e. Post construction storm water management inspection Major public works improvements at the Symantec project are expected to be completed by the end of October 2007. Also, it is expected that there will be other general public works inspections required throughout the City during this period City of Culver City, California City Council Agenda Item Report The proposed agreement will expire on October 31, 2007. The City retains the right to terminate the agreement upon thirty days’ notice at any time during the term of agreement. Also, the City will have the right to contract with other inspectors when it is in the City’s best interest. FISCAL ANALYSIS: Nickerson Company’s hourly rate charged for public works inspection services is $75. There are sufficient funds in both Sewer operating ($20,000), and Engineering operating division ($20,000), which can be transferred to fund the additional contract service in the amount of $40,000. The transfer can be processed administratively. MOTIONS: That the City Council: 1. Approve an amendment to the professional services agreement with Nickerson Company for general public works inspection services for a total additional not-to-exceed cost of $40,000 with the amended contract expiring on October 31, 2007; 2. Authorize the City Attorney to prepare the necessary documents and the City Manager to execute such documents on behalf of the City.
