RECOMMENDATION:
Staff recommends the City Council approve the Second Amendment to the Existing
Joint Use Agreement with the Culver City Unified School District (CCUSD) extending
the term thereof for an additional six months (to June 30, 2012).
BACKGROUND:
The City and the CCUSD have been the parties to a Joint Use Agreement
(Agreement) for several years. Under the terms of the Agreement, either party may
terminate the agreement by providing the other party with at least six months’ notice.
The CCUSD provided such timely notice and, in accordance with the terms of the
Agreement, the Agreement would have expired on June 30, 2011. On June 13,
2011, the City Council approved an amendment to the Agreement extending the
term to December 31, 2011.
DISCUSSION:
Since receipt of the notice from CCUSD and during the extended term, the City
Manager, Assistant City Manager, and Parks, Recreation, and Community Services
Director have met with the Superintendent and the Assistant Superintended several
times to informally discuss how the two parties should proceed. From these meetings,
it is evident that the terms under which the Joint Use Agreement was originally
formulated have undergone changes over the past years. While both parties have
expressed a desire to continue working together cooperatively to provide services and
facilities to our mutual customers and constituents, the number of issues that have

arisen during these discussions have led both the City Manager and the
Superintendent to recommend to the City Council and CCUSD Board a second six
month extension to the existing Agreement.
FISCAL ANALYSIS
There is no fiscal impact associated with this agenda item.
MOTION:
That the City Council:
1. Approve an Amendment to the Existing Joint Use Agreement with the Culver
City Unified School District Extending the Term Thereof for an Additional Six
Months (to June 30, 2012); and,
2. Authorize the City Attorney to review/prepare the necessary documents;
and,
3. Authorize the City Manager to execute such documents on behalf of the
City.
