RECOMMENDATION
Staff recommends the City Council approve a Memorandum of Agreement (MOA) between the City of Culver City and the City of Los Angeles, County of Los Angeles and Los Angeles County Flood Control District (LACFCD) regarding the administration and cost sharing for implementing the Coordinated Integrated Monitoring Program (CIMP) and Watershed Management Program (WMP) for the Marina Del Rey Watershed.
BACKGROUND/DISCUSSION
On December 28, 2012, the Los Angeles County Municipal Separate Storm Sewer System Permit (MS4 Permit) became effective in accordance with the Clean Water Act. The Los Angeles MS4 Permit covers unincorporated areas of Los Angeles County, the Los Angeles County Flood Control District, and 84 cities within Los Angeles County, including the City of Culver City. Culver City takes a regional approach regarding compliance, by partnering with other agencies within the watershed to accomplish annual reporting, water quality monitoring, project implementation and other tasks. The Marina Del Rey Watershed Management Group (WMG) is comprised of Culver City, County of Los Angeles, the Los Angeles County Flood Control District (LACFCD), and the City of Los Angeles. Most of Culver City lies in the Ballona Creek Watershed, which is managed by the Ballona Creek WMG, led by the City of Los Angeles.
The cities of Culver City, Los Angeles, the County of Los Angeles, and the LACFCD first entered into a predecessor MOA in 2013 and renewed the agreement in 2016 and 2019. A new five-year agreement has been drafted and is ready for approval by the various agencies.
The MOA lays out tasks and costs for each agency and is administered by the County of Los Angeles. The MOA’s scope of work is to be led by the County of Los Angeles and includes:
- Monitoring Services - receiving water, stormwater outfall, and non-stormwater outfall monitoring; data management; capital, operation and maintenance activities; and purchasing, maintaining and replacing equipment necessary for monitoring activities.
- WMP Related Tasks - annual reporting; report of waste discharge (ROWD); adaptive management; trash monitoring and reporting plan (TMRP); WMP revisions; website management; California Stormwater Quality Association (CASQA) membership.
- Contract Administration - facilitate the development of agreements; manage procurements, contracting and contract administration; distribution of invoices and collection of invoices.
FISCAL ANALYSIS
The total cost to Culver City for the five-year term of the MOA is $157,176 over Fiscal Years 2024-2025 through 2028-2029. The Adopted Budget for Fiscal Year 2024-2025 includes $29,049 for the first year of the MOA in CIP Project PZ497 (Stormwater Discharge Program/NPDES), which can be found on page 481 of the budget book in the Urban Runoff Mitigation Fund (Fund 434) section. Funding for future years of the MOA will be included in future fiscal-year budgets in CIP Project PZ497, Stormwater MS4 Permit Compliance Program.

MOTION
That the City Council:
1. Approve a Memorandum of Agreement between the City of Culver City and the City of Los Angeles, County of Los Angeles and Los Angeles County Flood Control District Regarding the Administration and Cost Sharing for Implementing the Coordinated Integrated Monitoring Program (CIMP) and Watershed Management Program (WMP) for the Marina Del Rey Watershed;
2. Authorize the City Attorney to review/prepare the necessary documents; and
3. Authorize the City Manager to execute such documents on behalf of the City.
