Accept the work performed by Palp, Inc. dba Excel Paving Company for the Pedestrian Improvements at Intersections with Bus Stops Project, PZ-950, Federal Aid No. RPSTPLE 5240 (029); and, 2. Approve an amendment to the contract with Palp, Inc. dba Excel Paving Company, to increase the construction contract an additional $44,985.28 for the Pedestrian Improvements at Intersections with Bus Stops Project, PZ-950; and, 3. Authorize filing a Notice of Completion; and, 4. Authorize the release of the retention funds in the amount of $47,694.66 after the expiration of the 35-day lien period. BACKGROUND/DISCUSSION: On September 23, 2013, the City Council awarded a contract to Palp, Inc. dba Excel Paving Company to construct the Pedestrian Improvements at Intersections with Bus Stops Project, PZ-950; Federal Aid No. RPSTPLE 5240 (029) (the “Project”). City of Culver City, California Agenda Item Report The Project consists of constructing pedestrian safety improvements at eight (8) intersections. The improvements include new Americans with Disabilities Act (ADA) compliant curb ramps with truncated domes, highly visible crosswalk and pavement markings, accessible pedestrian push buttons, more versatile vehicle video detection and bicycle detection devices, and reconstruction of damaged concrete pavement at the intersection of Washington Boulevard and Inglewood Boulevard. The improvements completed at the following intersections were on major arterials and were selected due their high transit and pedestrian activities: 1) Sepulveda Boulevard and Washington Boulevard 2) Sepulveda Boulevard and Sawtelle Boulevard 3) Washington Boulevard and Robertson Boulevard/Higuera Street 4) Washington Boulevard and Landmark Avenue 5) Washington Boulevard/Washington Place/Zanja Street 6) Washington Boulevard and Inglewood Boulevard 7) Washington Boulevard and Centinela Avenue 8) Washington Boulevard and National Boulevard Change Orders The City Council approved a contingency amount of $82,628.00 for the construction contract. However, there were seven (7) change orders approved in the total amount of $127,613.28 which is $44,985.28 above the previously approved contingency amount for the Project. The change orders were due to unanticipated extra work and additional materials quantities required to satisfactorily complete the Project. Unanticipated extra work included: lowering of shallow traffic signal conduits to accommodate the new ADA ramps. additional traffic restriping, use of a temporary traffic signal during Phase 3 of intersection reconstruction at Inglewood Boulevard and Washington Boulevard, the partial removal of an abandoned concrete foundation in conflict with a reconstructed curb ramp, and repair of a perimeter block wall adjacent to reconstructed curb ramp that was required as a result of the ramp construction. The quantity adjustments were predominantly due to the additional subgrade removal due to poor soil conditions and additional concrete roadway pavement reconstruction areas. FISCAL IMPACT: Staff proposes that the additional funding come from PZ-863 Street paving program. There are sufficient funds available within the project budget to cover the required increase in the construction contingency. A total of $25,640.85 of unspent funds from Construction Management/Inspections Services and Geotechnical Construction Services can be applied toward construction, and $20,800 are available under 42380000.730100.PZ950. MOTIONS: That the City Council: 1. Accept the work performed by Palp, Inc. dba Excel Paving Company for the Pedestrian Improvements at Intersections with Bus Stops Project, PZ-950, Federal Aid No. RPSTPLE 5240 (029); and, 2. Authorize the Public Works Director/City Engineer to execute the Notice of Completion and submit it to the Los Angeles County Recorder’s office; and, City of Culver City, California Agenda Item Report 3. Approve a contract amendment to increase the construction contract an additional $44,985.28 to supplement the construction contingency of Pedestrian Improvements at Intersections with Bus Stops Project, PZ-950, Federal Aid No. RPSTPLE 5240 (029); and, 4. Authorize the City Attorney to review/prepare the necessary documents; and, 5. Authorize the City Manager to execute such documents on behalf of the City; and, 6. Authorize the City Manager to release $47,694.66 in retention after the expiration of the 35-day lien period.
