RECOMMENDATION:
Staff recommends that the City Council accept the work performed by the contractor,
FS Construction, and authorize filing a Notice of Completion for the Curb, Gutter,
and Sidewalk Replacement Project, P-428. It is also recommended that the
retention funds in the amount of $15,929.52 be released to the contractor after the
thirty-five day lien period.
BACKGROUND/DISCUSSION:
On February 14, 2005 the City Council awarded a construction contract to
FS Construction for the replacement of uplifted, damaged or deteriorated sidewalks,
drive approaches, and curb and gutter along selected streets. Due to the favorable
low bid, Council also authorized staff to negotiate additional work not exceeding the
project budget of $160,000.
FS Construction repaired sidewalk, curb and gutter, and drive approaches in
accordance with the original contract. The original contract amount for the project
was $111,425.00 and the final construction cost was $159,295.20. There were five
(5) change orders issued in the total amount of $47,870.20 for additional curb,
gutter, sidewalk, and drive approach repair locations that were added to the project.
The additional work was performed along Sawtelle Boulevard, Wrightcrest Drive,
Tuller Avenue, Selmarine Drive, Grayridge Drive, Overland Avenue, Port Road,
Flaxton Avenue, Galvin Avenue, Globe Avenue, Jasmine Avenue, Mildred Avenue
and Rosabell Avenue.
The project was designed, managed, and inspected by City Engineering Division
staff.

FISCAL ANALYSIS:
Adequate Gas Tax and General Fund money was appropriated for this project,
including change orders, in Fiscal Year 2004/05 within the Capital Improvement
Program Budget P-428 (Curb, Gutter, and Sidewalk Replacement Project, Business
Unit 41800428 and 42000428).

MOTIONS:
That the City Council:
1) Accept the work performed by the contractor, FS Construction, for the Curb,
Gutter, and Sidewalk Replacement Project, P-428;
2) Authorize the issuance of a Notice of Completion;
3) Authorize the Public Works Director to sign and submit the necessary documents
to the Los Angeles County Recorder’s Office; and,
4) Authorize the release of $15,929.52 to FS Construction following the 35-day lien
period.
