RECOMMENDATION:
Staff recommends the City Council adopt a Resolution granting a Fireworks Permit
jointly to the Exchange Club and Pyro Spectaculars for a fireworks display on July 4,
2006.
BACKGROUND/DISCUSSION:
The Culver City Municipal Code provides for the process to be used for the City to
grant a permit for fireworks displays. One requirement is that should the Council
determine to grant such a permit, that it be done through adoption of a resolution.
The Exchange Club and Pyro Spectaculars have applied jointly for a permit and
request the City Council’s approval thereof. Staff has reviewed the permit
application and finds all of the requirements of the Municipal Code have been met.
Therefore, staff recommends approval of the application.
In prior years, the City Council has determined to contribute funds to this event. In
Fiscal Year 2006/2007, the amount estimated to be contributed was $18,000.
Council may wish to determine the exact amount, if any, it wishes to contribute. The
amount would be included in the final wording of the Resolution.
The City Council should also note, in accordance with past practice, the Resolution
includes a provision for the City to indemnify and hold harmless the Exchange Club
for any liability in excess of $1,000,000.

FISCAL ANALYSIS:
The amount of funds contributed is subject to the City Council’s determination. The
proposed budget for Fiscal Year 2006/2007 contains $18,000 for this purpose.
Should Council determine to provide funds greater than this amount, a budget
amendment would be necessary (and a four-fifths vote is required for a budget
amendment).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CULVER CITY CALIFORNIA, GRANTING A PERMIT AND
AUTHORIZING A PAYMENT, NOT TO EXCEED $18,000,
TOWARD THE ANNUAL INDEPENDENCE DAY
FIREWORKS DISPLAY SPONSORED BY THE CITY OF
CULVER CITY AND THE CULVER CITY EXCHANGE CLUB
TO BE HELD ON JULY 4 2006
WHEREAS the Culver City Exchange Club has conducted, on a continuing
basis, a fireworks display every Fourth of July,
WHEREAS pursuant to Culver City Municipal Code Section 9 02 210, the
City Council, by resolution, may grant a permit to conduct a public display of fireworks
WHEREAS, the Exchange Club has duly applied for and met all application
requirements for a permit to conduct a public fireworks display and
WHEREAS, this service organization has requested assistance from the City
of Culver City to defray the expenses involved in carrying out the display for 2006
NOW, THEREFORE, the City Council of the City of Culver City, California,
DOES HEREBY RESOLVE as follows|109| A permit to conduct a public display of fireworks hereinafter 'The
Event, is hereby granted to the Culver City Exchange Club and its contractor Pyro
Spectaculars, for the Event to be conducted at Helms Field on July 4 2006, subject to all
of the conditions set forth in Section 9 02 220 of the Culver City Municipal Code|109| The City Council does hereby authorize a sum up to $18,000, to be
paid toward the cost of the Event|109| All items of expense shall first be approved and payment authorized by
the Chief Administrative Officer

284 The Event shall have no partisan political content and shall not be
used as a platform for political candidates|109| The Exchange Club on all of its literature, advertising and promotion
for the Event shall identify the City of Culver City as a co-sponsor of this Event and the
participation of the City of Culver City shall be given equal recognition with the Exchange
Club in all matters relating to the Event|109| The Exchange Club shall use its best efforts to insure the consumption
of alcoholic beverages does not occur during the Event
7 The City of Culver City hereby agrees to indemnify and hold harmless
the Culver City Exchange Club its officers and members from any and all liability in excess
of the $1 000 000 00 insurance policy procured by Pryro Spectaculars pursuant to Section
9 02 215(C) of the Culver City Municipal Code
