City of Culver City, California City Council Agenda Item Report RECOMMENDATION: Staff recommends that the City Council appoint and/or reappoint members to the Planning Commission, Parks and Recreation Commission, Civil Service Commission, Cultural Affairs Commission, Disability Advisory Committee, the Landlord-Tenant Mediation Board and the Baldwin Hills Community Advisory Panel. BACKGROUND: In order to fill vacancies on the various commissions, committees and boards, staff has taken the following steps to provide public notice: • Advertisements ran in the Culver City News on May 6 and May 13, 2010. [Due to an error by the newspaper, advertisements scheduled to run on May 20 and May 27, 2010 did not run.] • Advertisements ran in the Culver City Observer on May 6, May 13, May 20 and May 27, 2010. • Notice was posted on the City’s web site starting on May 6, 2010. • Letters were sent to commission/committee/board members who were eligible to apply for reappointment. • Announcements were made at Council Meetings regarding the application period and deadline. Office No. 5, currently held by Anthony Pleskow, expires on June 30, 2010. Mr. Pleskow was appointed to the Commission in 2008 to fill an unexpired term. Mr. Pleskow submitted a new application indicating his interest to again serve on the Planning Commission. A total of 2 people submitted timely applications indicating an interest in serving on the Planning Commission. Parks and Recreation Commission – One seat is available for appointment. Office No. 3, currently held by Marianne Kim, expires on June 30, 2010. Ms. Kim was appointed to the Commission in 2008 to fill an unexpired term. Ms. Kim submitted a new application indicating her interest to again serve on the Parks and Recreation Commission. Ms. Kim’s application was the only one received for the Parks and Recreation Commission. Civil Service Commission – One seat is available for appointment. Office No. 1, currently held by Michael Whitaker, expires on June 30, 2010. Mr. Whitaker was appointed to the Commission in 2006. Mr. Whitaker submitted a new application indicating his interest to again serve on the Civil Service Commission. A total of 2 people submitted timely applications indicating an interest in serving on the Civil Service Commission. Cultural Affairs Commission – One seat is available for appointment. Office No. 5, currently held by Clement Hanami, expires on June 30, 2010. Mr. Hanami did not submit an application seeking reappointment. A total of 5 people submitted timely applications indicating an interest in serving on the Cultural Affairs Commission. Disability Advisory Committee - Two seats are available for appointment. Office No. 1, held by Robyn Tenensapf, expires on June 30, 2010. Ms. Tenensapf submitted an application seeking reappointment. Office No. 5, held by Dr. Jay Shery, also expires on June 30, 2010. Dr. Shery submitted a new application indicating his interest to again serve on the Disability Advisory Committee. A total of 5 people submitted timely applications indicating an interest in serving on the Disability Advisory Committee. City of Culver City, California City Council Agenda Item Report Landlord-Tenant Mediation Board: Please note that there are no term limits for the Landlord-Tenant Mediation Board. Tenant Representative – Three seats are available for appointment. One application was received for this position. Landlord Representative – Two seats are available for appointment. Mary Ellen Fernandez was reappointed to the Board in 2007. Ms. Fernandez filed an application seeking reappointment. A total of 5 timely applications were received for this position. Member at Large Representative – Two seats are available for appointment. One application was received for this position. Tenant Alternate – One seat is available for appointment. No applications were received for this position. Baldwin Hills Community Advisory Panel – One Member seat and one Alternate seat is available for appointment. One application was received for this position. Please note that the City Council has the option of appointing one or more of its members to this panel. FISCAL ANALYSIS: For new appointees to the Landlord-Tenant Mediation Board, there will be 30 hours of professional mediation training at a cost of $625 each and AB 1234 Ethics training. These costs would be absorbed in existing Housing Division Budget appropriations. For new appointments to all other commissions, committees or boards, individuals who have not already completed AB 1234 Ethics training must do so, along with Brown Act training. Sufficient funds for training has been included in the Non-Departmental Division proposed 2010-2011 budget and will be available when the budget is approved by the City Council. PRCS Commission touches on a broad array of quality-of-life issues that I consider to be interesting, challenging and rewarding. PRCS plays an important role in providing social and recreational services to Culver City stakeholders (such as seniors and teens) who would otherwise have limited access to similar services/facilities in the community. Therefore, I'm interested in continuing to serve on the PRCS Commission because I'd like to work with staff and community members in an ongoing effort to promote healthy living and socializing opportunities in the area. 18. What is there specifically in your background, training education or interests which qualify you as an appointee? My most recent experience as a PRCS Commissioner the last two years has best prepared me to continue as an appointee. I'm already familiar with many of the PRCS issues (some of which are ongoing) and am better prepared to work through the broader issues and trends as the Commission moves forward in its responsibilities. On a personal level, I've been a _frequent user of PRCS facilities and services for many years. I've played in recreational softball leagues and jog around parks in Culver City. The ongoing maintenance and improvement of field conditions is very important to me as a system user. Additionallyy. I have a very personal interest in civic education programs. I was fortunately able to work with the Culver City Teen Center staff in organizing a "youth empowerment day" where Culver City High School students were taught about various opportunities for community and civil service. Lastly, my professional background in government strongly supports my role as a PRCS Commissioner. In summary, my background has allowed me to better understand the nexus between local and statewide policy matters that affect how Culver City plans to provide recreational and social services in the long term. 19. What do you see as the objectives and goals of the body to which you seek appointment? I think the PRCS Commission has a dual role in serving the Culver City community. The first objective should be to work with city staff in efforts to deliver excellent public facilities/services and ensure equitable access for all residents. A second important objective should be to provide citizens' oversight on behalf of community stakeholders 20. How would you recommend the objectives and goals of the body be changed or augmented? City Charter provides in some detail the Commission's responsibility with regard to matters of community beautification. As part of this role, P.RCS Commission is tasked with providing input regarding the variety of trees that should be planted on residential streets far away from the centers of activity for most PRCS services. The PRCS Commission lacks the technical expertise to advise City Council on tree varieties. Given that the City staff and PRCS Commission time is limited, I would recommend removing this responsibility. 21. How would you help achieve the body's established objectives and goals? Ensuring coordination with major stakeholders and related city departments in planning processes of interest to this body, encouraging more public input from community/residential groups that have traditionally been less vocal, seeking out resources to enhance effective community service programs, and trying to make community service programs more effective for non-English speaking senior and other residents. 22. What special qualifies can you bring to the body to which you seek appointment? I served on the Culver City Redevelopment Board citizens' advisory body and understand the quality- of-life issues that pertain to the environment surrounding our homes. I currently sit on the body to which I seek appointment, which means I've already been exposed to the ongoing PRCS issues that have been discussed for the past several years. There is also a direct relationship between the type of work FRCS staff performs as a city department and my professional role in government relations. I'm the only current FRCS Commissioner who has worked for city government and currently sit on advisory committees for regional and local public agencies I'm already familiar with state and regional decision making processes as a public policy analyst, and hope to apply my professional experiences to the objectives of this body. The meetings I have attended typically have lasted 2 hours. Depending on the agenda items, and issues I would estimate spending approximately 10 hours per meeting, imless more time was warranted. 17. Why are you interested in appointment to a City Commission, Board, Committee or Task Force? I have years of personal experience as a direct caregiver for a family member with multiple disabilities. During that time, I have had countless experiences — many positive, some not so — in addressing issues that most of the public is not aware of, until they or a loved one becomes disabled, or there is an event that raises awareness of the issues. In the past two years I have had the privilege to be involved in working with city staff on several disability access issues, including a proposed move of the handicapped section at the summer concert series, and with public works on a hazardous curb cut. I hope to be able to become more involved in promoting awareness of these and other issues through participation with DAC. 18. What is there specifically in your background, training, education or interests which qualifies you as an appointee? I have years of personal experience as a direct caregiver for a family member with multiple disabilities, with relatives and in the process became a volunteer advocate with National Family Caregiver Association. I am also a member of ACOR, and in that capacity bring my interest in development, along with an in-depth self study of ADA, universal design guidelines; "Visitability" and "Liveable Communities" programs. 19. What do you see as the objectives and goals of the body to which you seek appointment? I have attended meetings and Socialite gatherings — and believe that there is no better way to say it than the published goals & objectives. Advise the City Council on all matters affecting persons with disabilities in the community. Review community policies, programs and actions which affect persons with disabilities and make appropriate recommendations to the City Council. Render advice and assistance as requested to other City boards and commissions, to City departments and to private agencies on matters affecting persons with disabilities. Identify the needs of persons with disabilities and create a public awareness of these needs in areas such as employment, housing, transportation, media, physical and communication accessibility and other needed areas. Promote the total integration of persons with disabilities into all aspects of community life. C. Yanda June 201020., How would you recommend the objectives and goals of the body be changed or augmented? I suspect that given the economic climate, city budget constraints and a reduction in social program funding, this question has no simple answer. I would start by recommending that the DAC reach out to the other commissions and develop the advisory role Likewise the DAC may become more proactive in advising all city departments, and acting as a touchstone committee for the RDA and City Council. As a member of CERT, and the founder of a very new neighborhood watch group, outreach to CCFD (& CERT) and CCPD. This type of availability may also be valuable as a tool and source for those departments as needed. 21. How would you help achieve the body's established objectives and goals. I have the time, determination and patience to help with the DAC' s established goals. 22. What special qualities can you bring to the body to which you seek appointment? As a family caregiver, I understand that no one can do it alone and be successful — I can bring my viewpoint, can-do attitude, and willingness to contribute for the benefit of all. I am not homophobic. I am not discriminatory. How could I be? I am an R.N. and I keep my license active. I worked at Brotman hospital for 6 years on a Med-Surg floor. I certainly did not discriminate against any of my patients. They were from all walks of life -- old, young, gay, straight, black, white, Jewish, Christian, etc. I certainly was not homophobic or biased when I ran my successful Tanning Salon for 12 years in Marina del Rey. I had customers from all classifications and walks of life. As far as being a landlord, my husband and I had gay tenants for several years and they were two of our best tenants ever, therefore, as a Landlord-Mediator it is clear that I would certainly be unbiased. spoke with Mr. Scott on December 10th and received the agenda for December 14th. My husband and I then listened to the November 23rd Council Webcast on our computer. I had no previous information that a Marvin Brown spoke before the City Council on that date against my letter to the CC News editor on the 19th of November. He called. me homophobic and m isrepresented whet I said in my letter. I did not say that I was "happy" that I didn't vote for "them". I do not know Marvin Brown and, as far as I know, he does not know me. It seems to me that perhaps someone told him that I am on the Landlord-Tenant Mediation Board and asked him to speak out against me! My goodness!! I would never say or do anything that would cause Culver City to be sued. I feel that Mr. Brown is insulting my intelligence by inferring that I might do so. I wrote the letter while I was still in the hospital after my 5 1/2 hour spinal surgery. What struck me "in my face" was when I read the November 5th CC News where Karlo proclaimed the election meant a lot for "diversity in Culver City, as we will now have two school board members from the LGBY community", referring to himself and Ms. Papalis. It seems that if he felt that people needed to know that, why didn't he run his campaign on the same issues. Like Mr. Resnick wrote in his letter to the CC News on December 3rd, "I thought Silbiger was voted in to represent the Culver City community to work on school issues, not to politicize his or anyone else's sexual orientation". That is actually what I was thinking and trying to express when I wrote my letter. I respectfully ask you to let me continue to serve on the Landlord-Tenant Mediation Board. I spent many years as a renter/tenant and have been involved in managing a 4 unit apartment building in Los Angeles (not Culver city) for our family, as well. As a commercial real estate professional, I consult both office & retail landlord and tenant Clients (no residential) about properties and rents and understand the demands, needs, trends, and economics of the real estate market. Culver City is'near and dear" to me and my family, so this is an opportunity for me to be involved in a way which capitalizes on both my profes4onal experience and personal interest. 19. What do you see as the objectives and goals of the body to which you seek appOinttnere I understand the Board's chief task it to mediate rental itcreaSes in our non-rent-controlled city. I see this as an important role, where our city's position on rental rates hat to be fairly balanced with tenants' needs to be able to live Comfortably and to have quiet enjoyment of their homes. On a cane-by-case basis, I look forward to being a fair voice of reason by studying, reviewing, and discussing materials and commentary, and collaborating with the Board to provide feedback, comments, and suggestions to the Staff / Housing Division, Owners, and Tenants. 20: How would you recommend the objectives and goals of the body be changed or augmented? I would not presume to suggest how they should be changed at this point, having not been privy to its inner workings, but rather see how effectively the Board attains its goals and objectives as a Board member. If it became apparent that changes needed to be made, I would work within the Board to try to make the group more effective, and/or discuss my suggestions for improvetent with Staff, so that they may help direct the Committee to be more effective. I do think it worthwhile to see what other issues between Tenants and Landlords might be mediated by the Board as a resource rather than solely concentrating on rental rate disagreements. 21. ifow would you help achieve the body' established objectives and goals?
