RECOMMENDATION:
Staff recommends the City Council continue the Public Hearing to September 17,
2007 for further comment by the applicant and public, and discussion by the Council
regarding the appeal of the Planning Commission’s denial of the Site Plan Review,
Administrative Use Permit and Administrative Modification for a proposed mixed use
development at 9900 Culver Boulevard.
PROCEDURE:
1. Mayor calls on staff for a brief staff report.
2. Mayor announces the public hearing is still open to allow for public comment, if
any. (At the Council meeting of August 6, the Council did not close the Public
Hearing, but continued it to this evening.)
The following procedures will be carried-over to the evening of September 17, 2007:
3. Receive further comment from the applicant and public.
4. Mayor seeks a motion to close the public hearing after all testimony has been
presented.
5. Council discusses the matter and arrives at its decision.

BACKGROUND/DISCUSSION:
On July 9, 2007, the Council held a public hearing to consider the appeal of the
Planning Commission’s denial of the Site Plan Review, Administrative Use Permit
and Administrative Modification for a proposed mixed use development at 9900
Culver Blvd. The public hearing was continued to July 23, 2007, for further
consideration, during which it was again continued to August 6, 2007.
Staff was subsequently informed by the appellant that he will not be available for the
August 6
th
hearing, and that he does not wish for the appeal to be considered in his
absence. Staff therefore recommended that the appeal be continued to September
10, 2007. Due to on going discussions between Agency staff and the appellant, staff
recommends the appeal be continued to September 17, 2007.
FISCAL ANALYSIS:
The continuation of this item will have no fiscal impact to the City. The detail of fiscal
impact will be provided on September 17
th
report.

That the City Council:
After receiving public comment, if any, regarding the appeal of the Planning

the hearing to September 17, 2007 for further comment by the applicant and
public, and discussion and decision by the Council.
