City of Culver City, California Agenda Item Report RECOMMENDATION: Staff recommends the City Council adopt a Resolution designating the Los Angeles County Department of Public Health as the solid waste management enforcement agency within the City of Culver City and rescinding Resolution No. CS-7570. BACKGROUND/DISCUSSION: The Z’berg-Kapiloff Solid Waste Control Act of 1976 (the “Act”) requires that there shall be designated in each county an enforcement agency to carry out the provisions of the Act. On October 24, 1977, the City Council, by Resolution No. CS- 7570, designated the Los Angeles County Department of Health Services (“DHS”) as the agency to undertake the enforcement of the Act, as a complement to other health services which the County provides for the City. In July of 2006, DHS reorganized and the Los Angeles County Department of Public Health (“DPH”) was formed. Within DPH is the Los Angeles County Department of Environmental Health, Solid Waste Management Program (SWMP) Local Enforcement Agency (LEA), which is currently authorized and designated by the City under DHS to enforce all laws and regulations relating to solid waste disposal, handling and transport within the Culver City jurisdiction. In April 2009, the City received a request from the County of Los Angeles, Bureau of Environmental Protection Solid Waste Management Program, that the City provide the designation for SWMP to act as the LEA within the City under DPH (rather than the formerly known DHS) and provide a certified copy of this designation to the County. The Los Angeles County Department of Public Health, Environmental Health, Solid Waste Management Program is hereby designated as the Local Enforcement Agency (LEA), pursuant to California Government Code Section 66795, to enforce all laws and regulations relating to solid waste disposal, handling and transport within the Culver City jurisdiction.2. The City Clerk is hereby directed to provide a certified copy of this Resolution to Los Angeles County Department of Public Health, Environmental Health, Solid Waste Management Program. 3.
