RECOMMENDATION

Staff recommends that the Martin Luther King Jr. Celebration and Juneteenth Celebration Advisory Committee adopt motions to (1) Appoint / Reappoint Members to Serve on the Martin Luther King Jr., Celebration and Juneteenth Celebration’s Ad Hoc Subcommittees; and (2) Review and Dissolve Any Ad Hoc Subcommittees that Have Completed Their Purpose or Are No Longer Necessary (3) Receive and File Updates, if any.

BACKGROUND

At the beginning of each new fiscal year, the Martin Luther King Jr. Celebration and Juneteenth Celebration Advisory Committee (“Advisory Committee”) reviews the list of ad hoc subcommittees and appoints or reappoints members, as appropriate.

Over the past several years, as the Advisory Committee has considered appointments to its ad hoc subcommittees, it has remained mindful of the requirements of the Ralph M. Brown Act (“Brown Act”) and the important distinction between a standing committee and an ad hoc subcommittee.

Standing committees are required to comply with the applicable provisions of the Brown Act, including requirements related to public notice and public participation. Ad hoc subcommittees, however, generally are not subject to those requirements when they meet the applicable Brown Act criteria.

Under the Brown Act, a standing committee generally has continuing subject-matter jurisdiction or a meeting schedule established by charter, ordinance, resolution, or other formal action of the legislative body. In contrast, an ad hoc subcommittee generally serves a limited or single purpose, is not intended to be permanent, and is dissolved once its specific task has been completed.

DISCUSSION

As each appointment is considered, staff recommends that the Advisory Committee provide any necessary updates regarding the purpose, membership, or status of the applicable ad hoc subcommittee. The Advisory Committee may also consider dissolving any ad hoc subcommittee whose work has been completed or is no longer necessary.

The Advisory Committee may further consider establishing the MLK Jr. Champion Awards Design Subcommittee and the MLK Jr. Champion Awards Nominating Subcommittee described above, provided that each subcommittee is limited to a specific purpose and is dissolved upon completion of its assigned work.

Please refer to the attached list of current appointments (Attachment 1).
