RECOMMENDATION:
Staff recommends the City Council discuss the licensing, vaccination, alteration and
microchipping of cats, and cat licensing fees and fee exemptions, and consider first
reading and/or adoption of related ordinances/resolution if deemed appropriate.
BACKGROUND:
At the September 11, 2006 City Council meeting, the City Council introduced
Ordinance 2006-010 for first reading. On September 25, 2007, upon second
reading, Ordinance 2006-010 was adopted and, by its terms, will become effective
on July 1, 2007. Ordinance 2006-010 re-adopted Title 10 of the Los Angeles County
Code (Title 10) as the animal control ordinance in the City of Culver City. As part of
the re-adoption of Title 10, cat licensing and vaccination will become required in the
City of Culver City along with the requirement to license, alter, vaccinate, and
microchip dogs on July 1, 2007. At the meeting of September 11, 2006, the City
Council expressed its initial intent to consider requiring microchipping and alteration
of cats and directed staff to return to the City Council with a proposed Ordinance
once it was determined the County of Los Angeles could provide the relevant
services. Since the September 11, 2006 meeting, staff has confirmed the County
could provide services relevant to the enforcement of mandatory cat alteration and
micro-chipping
As part of improving customer service and in anticipation of the effective date of the
new licensing requirements on July 1, 2007, on February 26, 2007, the City Council

approved an in-house pet licensing program and the establishment of a licensing,
microchip, and spay/neuter amnesty program (amnesty program) for dog and cat
owners who license their pets during the amnesty period (April 1, 2007 to June 29,
2007).
DISCUSSION:
In preparation for the amnesty program, staff notified residents of the program and
announced the County-run low cost dog vaccination and free dog microchipping
clinics scheduled for April and June 2007. The notification announced the
requirement for pet owners to license their dogs and cats with a new Culver City
license. To qualify for the amnesty program, dogs and cats were required to be
altered, vaccinated, and microchipped prior to licensure (and in anticipation of the
new requirements becoming effective on July 1).
Since the beginning of the Amnesty Period on April 1, 2007 and at the dog licensing
clinic on April 21, staff has received a number of communications from residents
inquiring about the new pet licensing requirements. Some have expressed concern
relating to the new requirements primarily related to the following: 1) pet owner
income limitations; 2) multiple cats who never leave the residence; 3) costs
pertaining to veterinarian appointments for vaccination, microchipping and alteration;
and 4) no clinic offered by the County for low cost vaccinations or free microchipping
for cats.
At this time, Council is asked to consider the proposed requirements for cat
microchipping and alteration, to be introduced in proposed ordinances this evening.
Cat licensing and cat vaccination are already included in Title 10 as adopted by the
City Council on September 25, 2007 and as is currently scheduled to become
effective on July 1, 2007.
The following is a point-by-point discussion of the additional items related to cat
licensing:
Cat Microchipping
Cat microchipping is not required under Title 10. The County currently offers free
microchipping as part of a grant through the Animal Found Foundation for dogs
only, and according to the County, the grant funded program for free microchipping
cannot be extended to cats. The County charges a fee of $20 for cat microchipping
at a County shelter. Based upon preliminary information, the City could offer an
annual cat microchipping clinic in Culver City at a cost of around $25 per cat. And, City of Culver City, California

while it is possible to offer a cat licensing clinic, the logistics of doing so would be
more complicated as compared to holding one for dogs.
Cat Alteration
Cat alteration is not required under Title 10. The City Council may decide to adopt
the same standards for alteration exemptions as exist for dogs (including a breeder’s
exclusion) in Title 10.Cat License Fee
Currently the City’s ordinance has a voluntary $10 cat license fee for an altered or
unaltered cat. The license fee for an altered dog is $20 and $40 for qualified
unaltered dogs (e.g. a breeding certificate from a licensed veterinarian.) The City
Council may wish to consider a mandatory $10 fee for altered cats and a $20 fee for
unaltered cats, if alteration exemptions meet the County Code exemptions that
currently exist for dogs. Alternatively, City Council may elect to adopt one uniform
pet license fee of $20 for altered dogs or cats, and $40 for unaltered dogs or cats
(which qualify under the alteration exclusions). This would represent a 100%
increase in the previous voluntary cat license fee.
Cat License Penalty Fee
A penalty fee may be adopted for cat licenses that are in arrears. There is currently
a $25 penalty for dog licenses in arrears, but no penalty fee is set for expired cat
licenses.
Senior Citizen/Qualified Disabled License Fee Exemption
Under Resolution 2005-R006 adopted by the City Council on February 28, 2005, the
City Council provided a “Senior Citizen/Qualified Disabled License Fee Exemption”
under the following circumstances:
(1) “Residents of Culver City aged 60 years old whose total adjusted gross
income, as used for purposes of the California Personal Income Tax Law,
was no more than $18,200 for the least calendar year and the combined
adjusted gross income of all members of the household in which an
individual resides was no more than $21, 500 are exempt from paying a
license fee for the first dog with all subsequent dogs requiring a license and
tag fee of $10.00 for an unaltered dog and $5.00 to license an altered dog”
and,
(2) Culver City residents who meet the criterion of Disability as established by
the Social Security Administration’s Supplemental Security Income (SSI) City of Culver City, California

Program for the Aged, Blind, and Disabled…shall be subject to the same
exemption…”
Currently there is no comparable cat license fee exemption in a City ordinance. The
Council could decide to offer the same provisions to cat owners.
Accompanying this staff report are a number of ordinances and a resolution

Should the City Council adopt any of the above items, any fees associated with such
an adoption would be included in the final fee resolution presented to the City
Council in June.
FISCAL ANALYSIS:
Currently, the General Fund pays for the animal care and control program, which
includes the City’s contract with the County of Los Angeles for field and shelter City of Culver City, California

services. Additionally, on February 26, 2007, the City Council authorized a budget
amendment in the amount of $20,000 to fund the purchase and start-up costs for a
pilot in-house City pet licensing program. Staff will be returning to the City Council
on July 23, 2007 with a report on the results of the first quarter (April-June) of the
animal licensing program.
According to the County, it is estimated that 5% of Culver City households have
cats. However, participation in the cat licensing program, although mandatory,
would not necessarily yield 100% compliance. Actual compliance would affect the
revenues received by cat licensing. If the City Council determines that the City
should offer cat microchipping vaccination clinic(s), staff would return at a later date
with details on offering such a program. It is expected that there will be fiscal impact
for the implementation of this program.

CONTROL ORDINANCE.
WHEREAS, since 1998, the City of Culver City has contracted with the
County of Los Angeles Animal Care and Control (the "County") for licensing, sheltering and
animal control services; and
WHEREAS, in 1998, by Ordinance No. 98-005, the City adopted, by
reference, Title 10 of the Los Angeles County Code (known as the "Animal Control
Ordinance") in order to avail itself of the services of the County; and
WHEREAS, in 2003, by Ordinance No. 2003-002, the City readopted, by
reference, the Animal Control Ordinance, as amended in 2003, to include the provisions of
Chapter 10.37, Potentially Dangerous and Vicious Dogs; and
WHEREAS, the County has recently adopted additional amendments to the
Animal Control Ordinance, including provisions relating to its Mandatory Spay and Neuter
Program for Dogs, and mandatory microchipping of dogs; and
WHEREAS, the County has not adopted provisions relating to the mandatory
microchipping or spay and neutering of cats; and
WHERAS, the City desires to adopt regulations pertaining to the mandatory

microchipping and spay and neutering of cats; and
WHEREAS, the City seeks to amend its animal control regulations to clarify:
1) that all fees and fee exemptions for dog and cat licensing shall be established by
resolution of the City Council; and 2) certain provisions of Chapter 9.01 of the Culver City
Municipal Code shall preempt the County's Animal Control Ordinance.
NOW THEREFORE, the City Council of the City of Culver City, California,
DOES HEREBY ORDAIN as follows:
SECTION 1. Chapter 9.01 of the Culver City Municipal Code is hereby
amended to add Subchapter 9.01_400, et seq. as follows:

§ 9.01.400 DEFINITIONS.
Terms defined herein shall have the following meanings when used in
this Subchapter:
Department shall mean the administrative offices of the City of Culver
City.
Competition Cat includes a cat which is used to show, to compete or
to breed, which is of a breed recognized by and registered with the American
Cat Fanciers Association (ACFA), Cat Fanciers Association (CFA), The

International Cat Association (TICA), or other valid registry approved by the
department and meets one of the following requirements:
A. The cat has competed in at least one cat show sanctioned by a
national registry or approved by the department, within the last 365 days;
B. The cat has earned a title from a purebred cat registry referenced
above or other registry approved by the department; or
C. The owner or custodian of the cat is a member of a purebred cat
breed club, approved by the department, which maintains and enforces a
code of ethics for cat breeding that includes restrictions from breeding cats
with genetic defects and life threatening health problems that commonly
threaten the breed.
Hobby Breeder shall mean any person, except for a person
possessing a valid kennel license, who owns and breeds a cat and sells the
• offspring for pay or for other compensation.
§ 9.01.405 LICENSE REQUIRED.
A. Every person owning or having custody or control of any cat
over the age of four months in the City of Culver City shall obtain a license for
each of such cats in accordance with the provisions of Chapter 10.20 of Title
10 of the Los Angeles County Code ("LACC"), as adopted and incorporated
by reference by Section 9.01.500 of this Chapter; and shall pay the fees for
such licenses as set forth in Section 9.01.425 of this Subchapter.
§ 9.01.410 LICENSE FEE; EXEMPTIONS; TERM.
A. License fee. There shall be an annual cat license fee. The
amount, time of payment, prorating schedule, if any, and penalty for late
payment, if any, of said fee shall be established by resolution of the City
Council.

B. Exemptions. The license fees established by Subsection A of
this Section shall not apply to any individual who qualifies for an exemption.
The criteria for such exemptions and process for application of an exemption
shall be established by resolution of the City Council.
C. Term. Every license and tag issued pursuant to this Subchapter
shall be for the period from October 1st to and including September 30th of
the following year of twelve months beginning on the first day of the month in
which the animal is licensed and continuing until the last day of the month
twelve months thereafter.
§ 9.01.415 MANDATORY SPAYING, NEUTERING OF CATS.
A. No person may own, keep, or harbor a cat over the age of four
months in violation of this section. An owner or custodian of an unaltered cat
must have the cat spayed or neutered or obtain an unaltered cat license in
accordance with Section 9.01.410.
B. Exception. The owner or custodian of a cat which is unable to
be spayed or neutered without a high likelihood of suffering serious bodily
harm or death due to age or infirmity, must obtain written confirmation of that
fact from a licensed veterinarian. The writing must also state the date by
which the cat may be safely spayed or neutered. If the cat is unable to be
spayed or neutered within 30 days, the owner or custodian must apply for an
unaltered cat license.
C. Hobby Breeding. The provisions of this Section shall not apply
to a person who is a hobby breeder, as defined in Section 9.01.400, and has
obtained an animal breeding license in accordance with the provisions of
Section 10.20.045 of Title 10 of the LACC.

§ 9.01.420 UNALTERED CAT LICENSE.
An owner or custodian of an unaltered cat over the age of four months
must obtain an annual unaltered cat license for the cat. The license shall be
issued if the department has determined that all of the following conditions
are met::
A. The cat is one of the following: a competition cat as defined in
Section 9.01.400; or a cat which is unable to be spayed or neutered as set
forth in Section 9.01.410.
B. The owner or custodian has submitted the required application
and has paid the fee set forth in Section 9.01.410 of this Chapter.
§ 9.01.425 MICROCHIPPING OF CATS REQUIRED.
A. All cats over the age of four months must be implanted with an
identifying microchip. The owner or custodian is required to provide the
microchip number to the department, and shall notify the department and the
national registry applicable to the implanted chip, of a change of ownership of
the cat, or a change of address or telephone number.
B. Exception. The owner or custodian of a cat which is unable to
be implanted with an identifying microchip without a high likelihood of
suffering serious bodily harm or death due to age or infirmity, must obtain
written confirmation of that fact from a licensed veterinarian and submit such
documentation to the department.
SECTION 2. Section 9.01.305(B) of the Culver City Municipal Code is hereby

Control Ordinance and this Chapter pertaining to animal control, the Animal Control
Ordinance as adopted shall prevail. This Subsection shall not apply to Section

Subchapter 9.01.400, et seq.
SECTION 6. Pursuant to Section 619 of the City Charter, this Ordinance
shall take effect thirty (30) days after the date of its adoption. Pursuant to Sections 616
and 621 of the City Charter, prior to the expiration of fifteen (15) days after the adoption,
the City Clerk shall cause this Ordinance, or a summary thereof, to be published in the
Culver City News and shall post this Ordinance or a summary thereof in at least three
places within the City.

SECTION 7. The City Council hereby declares that, if any provision, section,
subsection, paragraph, sentence, phrase or word of this ordinance is rendered or declared
invalid or unconstitutional by any final action in a court of competent jurisdiction or by
reason of any preemptive legislation, then the City Council would have independently
adopted the remaining provisions, sections, subsections, paragraphs, sentences, phrases
or words of this ordinance and as such they shall remain in full force and effect.

The criteria for such exemptions and process for application of an exemption
shall be established by resolution of the City Council.
C. Term. Every license and tag issued pursuant to this Subchapter
shall be for the period from October 1st to and including September 30th of
the following year of twelve months beginning on the first day of the month in
which the animal is licensed and continuing until the last day of the month
twelve months thereafter.
§ 9.01.415 MICROCHIPPING OF CATS REQUIRED.
A. All cats over the age of four months must be implanted with an
identifying microchip. The owner or custodian is required to provide the
microchip number to the department, and shall notify the department and the
national registry applicable to the implanted chip, of a change of ownership of
the cat, or a change of address or telephone number.
B. Exception. The owner or custodian of a cat which is unable to
be implanted with an identifying microchip without a high likelihood of
suffering serious bodily harm or death due to age or infirmity, must obtain

written confirmation of that fact from a licensed veterinarian and submit such
documentation to the department.
SECTION 2. Section 9.01.305(B) of the Culver City Municipal Code is hereby
amended to read as follows (insertions indicated by underline; deletions indicated by
strikethrough):
B. Exemptions. The license fees established by Subsection
A of this Section shall not apply to any individual who qualifies for an exemption as
established by resolution of the City Council.
1. The license fccs established by Subsection A. of this Section shall
meets the criteria of disability as established by the Social Security Administration's
Supplemental Security Income Program for the Aged, Blind and Disabled (Title XVI
of the Social Security Act as amended), without regard to the age of such disabled
individual.

the City Clerk shall cause this Ordinance, or a summary thereof, to be published in the
Culver City News and shall post this Ordinance or a summary thereof in at least three

SECTION 7. The City Council hereby declares that, if any provision, section,
subsection, paragraph, sentence, phrase or word of this ordinance is rendered or declared
invalid or unconstitutional by any final action in a court of competent jurisdiction or by

WHEREAS, since 1998, the City of Culver City has contracted with the
County of Los Angeles Animal Care and Control (the "County") for licensing, sheltering and
animal control services; and
WHEREAS, in 1998, by Ordinance No. 98-005, the City adopted, by
reference, Title 10 of the Los Angeles County Code (known as the "Animal Control
Ordinance") in order to avail itself of the services of the County; and
WHEREAS, in 2003, by Ordinance No. 2003-002, the City readopted, by
reference, the Animal Control Ordinance, as amended in 2003, to include the provisions of
Chapter 10.37, Potentially Dangerous and Vicious Dogs; and
WHEREAS, the County has recently adopted additional amendments to the
Animal Control Ordinance, including provisions relating to its Mandatory Spay and Neuter
Program for Dogs, and mandatory microchipping of dogs; and
WHEREAS, the County has not adopted provisions relating to the mandatory
microchipping or spay and neutering of cats; and
WHERAS, the City desires to adopt regulations pertaining to the mandatory

spay and neutering of cats; and
WHEREAS, the City seeks to amend its animal control regulations to clarify:
1) that all fees and fee exemptions for dog and cat licensing shall be established by
resolution of the City Council; and 2) certain provisions of Chapter 9.01 of the Culver City
Municipal Code shall preempt the County's Animal Control Ordinance.
NOW THEREFORE, the City Council of the City of Culver City, California,
DOES HEREBY ORDAIN as follows:
SECTION 1. Chapter 9.01 of the Culver City Municipal Code is hereby
amended to add Subchapter 9.01.400, et seq as follows:

§ 9.01.400 Definitions
§ 9.01.405 License Required
§ 9.01.410 License Fee; Exemptions; Term
§ 9.01.415 Mandatory Spaying, Neutering of Cats
§ 9.01.420 Unaltered Cat License
§ 9.01.400 DEFINITIONS.
Terms defined herein shall have the following meanings when used in
this Subchapter:
Department shall mean the administrative offices of the City of Culver
City.
Competition Cat includes a cat which is used to show, to compete or
to breed, which is of a breed recognized by and registered with the American
Cat Fanciers Association (ACFA), Cat Fanciers Association (CFA), The
International Cat Association (TICA), or other valid registry approved by the
department and meets one of the following requirements:

A. The cat has competed in at least one cat show sanctioned by a
national registry or approved by the department, within the last 365 days;
B. The cat has earned a title from a purebred cat registry referenced
above or other registry approved by the department; or
C. The owner or custodian of the cat is a member of a purebred cat
breed club, approved by the department, which maintains and enforces a
code of ethics for cat breeding that includes restrictions from breeding cats
with genetic defects and life threatening health problems that commonly
threaten the breed.
Hobby Breeder shall mean any person, except for a person
possessing a valid kennel license, who owns and breeds a cat and sells the
offspring for pay or for other compensation.
§ 9.01.405 LICENSE REQUIRED.
A. Every person owning or having custody or control of any cat
over the age of four months in the City of Culver City shall obtain a license for
each of such cats in accordance with the provisions of Chapter 10.20 of Title
10 of the Los Angeles County Code ("LACC"), as adopted and incorporated
by reference by Section 9.01.500 of this Chapter; and shall pay the fees for
such licenses as set forth in Section 9.01.425 of this Subchapter.
§ 9.01.410 LICENSE FEE; EXEMPTIONS; TERM.
A. License fee_ There shall be an annual cat license fee. The
amount, time of payment, prorating schedule, if any, and penalty for late
payment, if any, of said fee shall be established by resolution of the City
Council.
B. Exemptions. The license fees established by Subsection A of
this Section shall not apply to any individual who qualifies for an exemption.

§ 9.01.415 MANDATORY SPAYING, NEUTERING OF CATS.
A. No person may own, keep, or harbor a cat over the age of four
months in violation of this section. An owner or custodian of an unaltered cat
must have the cat spayed or neutered or obtain an unaltered cat license in
accordance with Section 9.01.410.
B. Exception. The owner or custodian of a cat which is unable to
be spayed or neutered without a high likelihood of suffering serious bodily
harm or death due to age or infirmity, must obtain written confirmation of that
fact from a licensed veterinarian. The writing must also state the date by
which the cat may be safely spayed or neutered. If the cat is unable to be
spayed or neutered within 30 days, the owner or custodian must apply for an
unaltered cat license.
C. Hobby Breeding. The provisions of this Section shall not apply
to a person who is a hobby breeder, as defined in Section 9.01.400, and has
obtained an animal breeding license in accordance with the provisions of
Section 10.20.045 of Title 10 of the LACC.
§ 9.01.420 UNALTERED CAT LICENSE.
An owner or custodian of an unaltered cat over the age of four months
must obtain an annual unaltered cat license for the cat. The license shall be

issued if the department has determined that all of the following conditions
are met::
A. The cat is one of the following: a competition cat as defined in
Section 9.01.400; or a cat which is unable to be spayed or neutered as set
forth in Section 9.01.410.
B. The owner or custodian has submitted the required application
and has paid the fee set forth in Section 9.01.410 of this Chapter.
SECTION 2. Section 9.01.305(B) of the Culver City Municipal Code is hereby

RESOLUTION NO. 2007-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CULVER CITY, CALIFORNIA, ESTABLISHING AN ANNUAL
FEE SCHEDULE FOR DOG AND CAT LICENSES, FEE
EXEMPTIONS AND RELATED PROCEDURES; AND
RESCINDING RESOLUTION NO. 2005-R006.
WHEREAS, Resolution No. 2005-R006 established an annual dog license fee
and exemptions; and
WHEREAS, it is the intent of the City to also require the payment of an annual
license fee for cats, and allow for certain exemptions for such fee; and
WHEREAS, after giving the public an opportunity to be heard and considering
all information before it, the City Council approved the adoption of said fees as set forth
below; and
WHEREAS, the fees established herein are based upon the reasonable cost of
providing the services and regulatory activity for the City's animal control program.
NOW, THEREFORE, the City Council of the City of Culver City, California,
DOES HEREBY RESOLVE as follows:
1. ANNUAL DOG AND CAT LICENSE FEES:
A. Pursuant to Sections 9.01.305 and 9.01.410 of the Culver City
Municipal Code, the City Council hereby establishes an annual dog and cat
license and tag fee of $ , except that the fee shall be $ if a
certificate is presented from a licensed veterinarian that the dog has been
spayed or neutered and microchipped. A fee of $ shall be charged
for all replacement tags.B. The fee shall be collected and tags issued by the City of Culver
City.
2. FEE EXEMPTIONS:
A. Senior Citizens. Residents of Culver City aged 60 years or older,
whose total adjusted gross income, as used for purposes of the California
Personal Income Tax Law, was no more than $18,200 for the last calendar
year, and the combined adjusted gross income of all members of the
household in which an individual resides was no more than $21,500, are
exempt from paying a license fee for the first dog, with all subsequent dogs
requiring a license and tag fee of 50% of the fees established in Section 1 of
this Resolution. The income amounts set forth in this Section shall be subject
to adjustment as provided from time to time by the County of Los Angeles
setting the income qualifications for "low income" or from some other bona-fide
source, both subject to the approval of the City Manager.
B. Disability. Culver City residents who meet the criteria of Disability,
as established by the Social Security Administration's Supplemental Security
Income (SS!) Program for the Aged, Blind and Disabled (Title XVI of the Social
Security Act as amended), without regard to age, are exempt from paying a
license fee for the first dog, with all subsequent dogs requiring a license and tag
fee of 50% of the fees established in Section 1 of this Resolution
C. Armed Forces, Law Enforcement and Service Dogs. A license
and tag of indefinite duration shall be issued, without fee, for any dog which has
been honorably discharged from the armed forces of the United States, or for|101010101010101010 10

2any dog during such time as the dog is serving as a law enforcement dog, or for
any dog during such time as the dog is owned and used by a disabled person
as a certified service dog.
3. PENALTY FOR LATE PAYMENT:
A penalty in the amount of $ shall be added to the
license fee for:
A. Any existing license for which the licensing period of one
year has elapsed. The penalty shall be added to the license fee starting on the
first day that the license is considered expired and has not been renewed.
B. Any new license that is not paid within thirty (30) days of
the invoice notice.
4. EFFECTIVE DATE:
The annual dog and cat license fees established by Section 1
above shall be effective commencing July 1, 2007.
5. Resolution No. 2005-R006 is hereby rescinded.
6. Except as otherwise provided herein, this Resolution shall
become effective immediately upon its adoption.

GENERAL PROVISIONS
§ 9.01.005 PENALTIES FOR VIOLATION OF CHAPTER.
A.
Any person who violates or fails to comply with any provision of this Chapter shall be guilty of an infraction
which shall be punishable by a fme, only, not to exceed Two Hundred Fifty Dollars ($250.00).
B.
Any violation which would otherwise be an infraction is a misdemeanor if a defendant has been convicted of
three or more violations of this Chapter within the 12-month period immediately preceding the violation and such prior
convictions are admitted by the defendant or alleged in the accusatory pleading. For this purpose, a bail forfeiture shall b
deemed to be a conviction of the offense charged.

§ 9.01.010 DEFINITIONS.
Whenever in this Chapter the following terms are used, they shall have the meaning ascribed to them, unless it is
apparent from the context thereof that some other meaning is intended:
CONTRACTOR or POUNDMASTER. Agency with which the City has contracted to perform the duties of
poundmaster and animal regulations.
DOG. Any dog of any age, including female as well as male.
DOMESTIC ANIMAL. Any horse, pony, mule, jack, jenny, cow, bull, calf, heifer, sheep, goat, swine, rabbit, as well
as any livestock and any other domesticated animal other than a household pet.
HOUSEHOLD PET. Any cat, dog, canary, parrot and any other kindred animal and bird usually and ordinarily kept 2
a household pet.
IMPOUNDED. Having been received into the custody of any pound authorized under the provisions of this Chapter.
KENNEL. Any lot, building, structure, enclosure, or premises whereupon or wherein four or more dogs are kept or
maintained for any commercial purpose, including places where dogs are boarded, kept for sale, or kept for hire.
PERSON. Includes a firm, partnership, corporation, trust, or any association of persons.
POULTRY and DOMESTIC FOWL. Any pigeon, chicken, duck, goose, turkey and all other domesticated fowl other
than a household pet.
POUNDKEEPER. Any person or any duly authorized agent of any such person in charge at any time of any pound.
UNLICENSED DOG. Any dog for which the license for the current year has not been paid, or to which the tag for th(
current year provided for in this Chapter is not attached.
WORKING HOURS. Hours during which the office or place of business of any poundkeeper is open for the business
of receiving, impounding, or caring for animals, and does not include any time during which such office or place of
business is closed.

It shall be unlawful for any person owning or having charge, care, custody, or control of any pig, hog, cow, bull, stee]
horse, mule, jack, jenny, hinny, sheep, or other livestock, including poultry, to wilfully or knowingly permit the same to
run at large upon any highway, street, lane, alley, court or other public place, or in or upon any cultivated or improved
land owned by any person, other than the owner of such animal, unless the consent of the owner of such land is first
obtained.

§ 9.01.020 ANIMALS OTHER THAN HOUSEHOLD PETS; PERMIT REQUIRED; BUSINESS
EXCLUSION.
A. It shall be unlawful for any person, firm, company or corporation to keep or maintain, or have in possession or
under control, any animals, fowl or reptiles, other than household pets, in the City, without having applied for and
received a permit as hereinafter provided, which permit shall be revocable at any time it is made to appear to the City
Council that the keeping of such animals, fowl or reptiles is, or may become, detrimental to the public health, safety,
and/or general welfare. ('65 Code, § 5-3) (Ord. No. CS-415 § 6.1)
B. 1. Each duly licensed pet or animal shop, establishment or business shall be excluded from Subsection A. of
this Section except to the extent that any such business shall be required annually to obtain and maintain in force a single
permit for the keeping of animals, fowls, or reptiles, other than household pets. Such permit shall be issued by the City
Clerk upon proper showing that the applicant is the owner of the business and that the business is duly licensed under the
applicable City ordinances to conduct business within Culver City. This provision shall not be construed to apply to any
person, corporation or business entity other than those legally engaged in the purchase and sale of animals, fowl or
reptiles to the general public.
2. Any animal business, as above described, shall make a quarterly report to the City Clerk of all animals, fowl c
reptiles, other than household pets, as herein used and defined, sold to persons residing within Culver City and no animal
dealer shall deliver such an animal, fowl, or reptile to a purchaser without obtaining accurate information with respect to
the purchaser's full name, address and exact location where the creature will be kept.

§ 9.01.025 PERMIT FOR DOGS AND CATS.
Notwithstanding any other provision of this Chapter, no person shall keep or permit to be kept on any or in any lot,
building, structure or premises more than three (3) dogs over the age of four (4) months or more than three (3) cats over
the age of four (4) months without first having applied for and received a permit as provided herein.

§ 9.01.030 APPLICATION FOR PERMIT; APPEAL UPON DENIAL.
A. Application for permit.
1. All applications for permits to keep animals, fowl or reptiles shall be filed with the City Clerk, shall be
accompanied by a fee of Fifty Dollars ($50.00) and shall state the number and kind of animals, fowl or reptiles as well as
such other information required by the City Clerk. Signatures of at least one (1) adult resident of each dwelling or
apartment unit within a radius of two hundred (200) feet, indicating approval or disapproval, shall be appended to such
applications. Upon receipt of application, a copy thereof shall be referred to the City's health agency and Police
Department for investigation and report.
2. Upon receipt of said reports, the City Clerk shall cause notices to be posted within a radius o
(300) feet from the address wherein said animals, fowl or reptiles are proposed to be kept, and not more than 0)

feet apart. Permit will be granted providing no written objections are filed within ten days and approval is received from
the City's health agency and Police Department.

B. Appeal to City Council. In the event of the denial of an application, the applicant may appeal to the City Counc
by filing with the City Clerk a written request for hearing before the City Council within ten (10) days from receipt of
notice of denial. ('65 Code, § 5-6)

§ 9.01.035 AN IMAL ANNOYANCE PROHIBITED.
It shall be unlawful for any person to harbor or keep any animal, bird or fowl which disturbs the peace or causes
annoyance or disturbance to the neighborhood or reasonably interferes with the peace, comfort or repose of any person c
persons in the quiet enjoyment of his or their property, by repeated or continuous barking, howling, whining, or making
other sounds common to their species, between the hours of 10:00 p.m_ and 8:00 a.m. and such disturbance shall be
deemed to constitute the maintenance of a nuisance. Provided, however, that the prohibitions contained in this Section
shall not apply to a licensed kennel owner or hospital or other place in which animals, birds or fowl are kept pursuant to
license or permit issued by governmental agencies.

§ 9.01.040 ANIMAL EXPERIMENTATION PROHIBITED.
Nothing in this Chapter shall be construed to permit the transfer, disposal or otherwise surrendering of any animal
obtained from within the City to any research institution, person or other agency for experimentation, whether medical it
nature or otherwise. It shall be unlawful for any person having the care, custody or possession of such animal to wilfully
permit the violation of this Section.

§ 9.01.045 ANIMALS AND FOWL IN OR NEAR CERTAIN ESTABLISHMENTS PROHIBITED.
It shall be unlawful for any person to keep or maintain any rabbits, fowl, or birds (other than canaries, parrots or
similar species), within 35 feet of any food establishment, school, church, hospital or any residence or dwelling house,
apartment or hotel, or other building or structure occupied for any purpose by human beings. Nor shall any animal or foN
be kept in any sandwich packing or box lunch establishment, bakery, restaurant or lunch stand or within 35 feet of any
door, window, ventilator or air shaft of such places. All fowl and animals shall be securely kept within their enclosures
and shall not be permitted to run at large at any time.

§ 9.01.050 APIARY OR RIDING ACADEMY; PERMIT REQUIRED.
It shall be unlawful for any person, firm or corporation to conduct or manage any riding academy business or the
keeping of bees, or an apiary, unless a permit has been obtained in the manner required for the obtaining of permits from
the cil generally. Nothing, however, shall be construed herein to prohibit the keeping of bees in a hive or box
locate a school house for the purpose of study or observation.

§ 9.01.055 KEEPING OF CARRIERS OF COMMUNICABLE DISEASES.
It shall be unlawful for any person, firm or corporation to keep, or allow to be kept, any domestic fowl or animal whi
has a communicable disease of any kind, unless such animal is securely tied or kept confined away from all other anima
fowl, or human beings.

§ 9.01.060 RIDING OR DRIVING OF HORSES OR OTHER ANIMALS UPON PUBLIC
STREETS; EXCEPTIONS.
A. No person shall use the public streets, alleys, or other public places of the City, or any portion thereof, as a brid
or equestrian path, or shall ride or cause to be driven any horse thereon, or shall drive any loose cattle, horses, mules,
sheep, goats or swine, in, upon, or along any such streets, alleys or public places. ('65 Code, § 5-13)
B. The Chief of Police may designate, by legible signs, street crossings and other locations over which horses may
be ridden to allow ingress or egress to and from bridle paths. He may also issue temporary permits for the purpose of
transporting horses, cattle, or other animals, from one location to another inside or outside the boundaries of the City, su
permit to designate streets to be utilized with least danger or inconvenience to the public. ('65 Code, § 5-14) (Ord_ No.

§ 9.01.065 VICIOUS DOGS.
It shall be unlawful for any person to keep within the City a vicious dog. Proof that any dog has bitten a person and
that the person keeping such dog probably had knowledge thereof shall be deemed to be prima facie evidence that the &
is vicious; provided, however, that this test shall not be exclusive and for the purposes of this Section, a dog may be
shown to be vicious even though it is not proven to have bitten any person.

IMPOUNDMENT GENERALLY
§ 9.01.200 DUTIES OF POUNDMASTER.
The duties of the Poundmaster shall include the following:
A. To capture and take into custody all unlicensed dogs; dogs and other animals running at large contrary to the
provisions of this Chapter or any State law; sick, injured, stray, unwanted or abandoned animals, and dogs which are
unvaccinated in violation of this Chapter.
B. To pick up or accept and care for any animal to be held for observation by the County Health Officer if such
animal is suspected of being rabid.
C. Custody of animals picked up. The Poundmaster shall place all animals which he takes into custody in the poun
required to be provided in the contract with said Poundmaster.
D. Cruelty to animal investigations. The Pounclmaster shall investigate all instances coming within his knowledge 4
inhumane treatment or cruelty to animals, and enforce the provisions of this or other parts of this Code or of State 1
pertaining to humane treatment of animals, and he may furnish shelter for any such animal which has recei an
treatment.

E. Disposal of dead animals. The Poundmaster shall pick up and dispose of all dead animals on public highways ar
on public and private property within the City, where the owner is unknown.

§ 9.01.205 IMPOUNDING REGULATIONS.
The Poundmaster and poundkeeper shall hold, advertise, sell, and in all respects treat animals impounded by him,
pursuant to the provisions of this Chapter, as provided in the California Agricultural Code.

§ 9.01.210 POUND CHARGES.
The Poundmaster may make such charges as provided by resolution of the City Council for impounding and caring fc
animals.

§ 9.01.215 DELIVERY TO POUNDMASTER OF STRAY ANIMALS.
Every person taking up any stray animal shall, within four hours thereafter, give notice to the Poundmaster or to the
Police Department of the City of the fact that he has the possession of such animal.

§ 9.01.220 PROCEDURE ON IMPOUNDING; NOTIFICATION OF OWNER.
The Poundkeeper shall, within 12 working hours after receiving any impounded dog, notify the owner by telephone o
letter as to such impounded animal. No charge or fee of any kind shall be charged for board or care of such dog during
time of its impoundment unless the Poundkeeper has given the notice as required herein.

§ 9.01.225 UNLAWFUL IMPOUNDING.
No charge shall be collected for any animal which has been unlawfully taken up and impounded. Such animal shall h
immediately delivered upon demand to the owner or person entitled to the custody thereof.

§ 9.01.230 OWNER'S RIGHT TO REDEEM.
The owner or person entitled to the custody of any animal taken up and impounded under the provisions of this
Chapter may at any time before the sale or disposal thereof redeem such animal by paying to the Poundmaster or
poundkeeper the fees and charges prescribed by this Chapter accrued up to the time of such redemption.

§ 9.01.240 POUNDKEEPER'S RECORDS.
The Poundkeeper shall keep a record of each animal impounded by him, the date thereof, manner of disposal, and
other pertinent facts, including the amount of all fees received or collected.

§ 9.01.300 LICENSE REQUIRED.
It shall be unlawful for any person to have, harbor, keep, to permit to be harbored or kept, any unlicensed dog in the
City, over the age of four months.

§ 9.01.305 LICENSE FEE; EXEMPTIONS.
A. License fee. There shall be an annual dog license fee. The amount, time of payment, prorating schedule, if any,
and penalty for late payment, if any, of said fee shall be established by resolution of the City Council. ('65 Code, § 5-27)

B. Exemptions.
1. The license fees established by Subsection A. of this Section shall not apply to any individual sixty-two (62)
years of age or older nor to any person who meets the criteria of disability as established by the Social Security
Administration's Supplemental Security Income Program for the Aged, Blind and Disabled (Title XVI of the Social
Security Act as amended), without regard to the age of such disabled individual.
2. In order to claim the exemption, any eligible person must file an application upon a form supplied by the Cit)
and shall state those facts declared under oath which qualify the applicant for an exemption, together with any additional
statements required by the City. All exemptions shall continue and be renewed automatically each year provided that the
exemption shall automatically terminate with any change of address of the exempt person.
3. The City shall have the right to demand evidence of continued eligibility for an exemption. The exemption
hereby made shall apply only to the next license period after the application for exemption is filed.

§ 9.01.315 EXEMPTIONS FOR CERTAIN DOGS.
A license and dog tag of indefinite duration shall be issued for any dog which has been honorably discharged from th
armed forces of the United States or for any dog during such time as he is owned and used by a blind person.

§ 9.01.320 TERM OF LICENSE.
Every license and dog tag issued pursuant to this Chapter shall be for the period from October 1st to and including
September 30th of the following year.

§ 9.01.325 TRANSIENT DOGS EXEMPTED.
The license provisions of this Chapter shall not apply to the following:
A. Any dog found within the City when the owner thereof resides in any municipality within the County or within
the unincorporated area of the County and such dog is wearing or has attached to it a license tag for the current year
issued by such municipality or County.
B. Any dog owned by or in charge of any person who is a non-resident of the City and is travelling through the Cit
or temporarily sojourning therein for a period of not exceeding 30 days.
C. Any dog brought into the City and kept therein for not to exceed 30 days for the exclusive purpose of entering ti
same in any bench show or dog exhibition or field trials or competition.
D. Any dog brought or sent into the City from any point outside thereof for the exclusive purpose of receiving
veterinary care in any dog hospital, in the event that such dog is kept at all times strictly confined within such hospital.

§ 9.01.330 VETERINARIAN'S CERTIFICATE REQUIRED.
No dog license shall be issued unless the applicant exhibits a certificate signed by a veterinarian licensed either by th(
State of California or by any other State to practice veterinary medicine, to the effect that:
A.
Such dog has been vaccinated with phenolized tissue vaccine less than one year prior to date of application or ti
first day of the license period, whichever is later, or
B. Such dog has been vaccinated with chick embryo vaccine less than two years prior to date of application, or the
first day of the license period, whichever is later, or
C. Such dog should not be vaccinated with rabies vaccine because such vaccination would jeopardize the health of
such dog due to infirmity or other disability, which infirmity or disability and the estimated date of termination thereof
shown on the face of the certificate to the satisfaction of the Poundmaster.

§ 9.01.335 DISABLED DOGS.
A person who obtains a license without submitting a certificate of vaccination because of the infirmity or disability o
the dog, shall within 10 days after the termination of such infirmity or disability cause such dog to be vaccinated as
required herein.

§ 9.01.340 LICENSE TAGS.
A. Manner of affixing. The license tag required hereunder shall be securely affixed to a collar, harness, or other
device which shall at all times be worn by each dog except while such dog remains indoors or in any enclosed yard or
pen. ('65 Code, § 5-35)
B. Duplicate tags. In the event any license tag for a dog is lost or destroyed, a duplicate thereof may be procured
from the agency designated by the Contractor upon the submission to such agency of such proof as he may require and
upon the payment therefor of the sum of One Dollar ($1.00). ('65 Code, § 5-36)
C. Unauthorized removal of tags prohibited. It shall be unlawful for any unauthorized person to remove from any
dog, any collar or harness or other device to which is attached a license tag for the current year or remove such tag
therefrom. ('65 Code, § 5-37)
D. Counterfeit tags prohibited It shall be unlawful for any person to attach to any dog a counterfeit tag in lieu of
the tag required and issued under the provisions of this Chapter. ('65 Code, § 5-38)

§ 9.01.345 RIGHT TO ENTER PRIVATE PREMISES FOR ENFORCEMENT.
The Poundmaster or any person authorized by him, or any other person authorized to enforce the provisions of this
Chapter, shall have the right to enter any premises upon which a dog is kept or harbored, in order to enforce the provisio
hereof. It shall be unlawful or any person to fail or refuse to exhibit any dog, certificate, license or tag when requested sc
to do by the person authorized to enforce the provisions of this Chapter, in the event that the same are possessed by such
person.

§ 9.01.350 REMOVAL AND DISPOSAL OF DOG FECES FROM PUBLIC AND PRIVATE
PROPERTY.
A. A person who owns or has custody of a dog shall immediately remove and dispose of in a sanitary manner, by
placing in an appropriate device and depositing in a sanitary receptacle, any feces deposited by such dog on any public o
private property without the consent of the person in lawful possession of the property.
B. A person who has custody of a dog shall carry an appropriate device to pick up dog feces during all times when
the dog is not on the premises of its owner or custodian.
C.
Exception: The provisions of this Section shall not apply to a blind person being accompanied by a guide dog.

§ 9.01.360 DOGS RUNNING AT LARGE; PROHIBITION.
It shall be unlawful for any person owning or having charge, care, custody or control of a dog in the City to cause,
permit or allow the same to be or to run at large upon any highway, street, lane, alley, sidewalk, median, parkway, court
or other public place, or upon any private property or premises other than those of the person owning or having charge,
care, custody or control of such dog, unless that dog be restrained by a substantial chain or leash not exceeding six (6)
feet in length, and is in the control of a competent person. In addition to the foregoing, no person shall cause,permit or
allow a dog under that person's charge, care, custody or control to be in any of the following places: any store, market,
restaurant, cafe, lunchroom, soda fountain, bakery or kindred establishments wherein foods for human consumption are
served, sold or kept for sale; or, except as permitted by § 9.10.400 or § 9.10.600, in any public park.

§ 9.01.365 DISPOSAL OF DOGS; CONDITIONS.
Dogs wearing a current license tag impounded pursuant to this Chapter shall not be destroyed or otherwise disposed
unless:
A. The person to whom the current license for such dog was issued so directs; or
B. Five full days have elapsed since such person was notified of his dog's whereabouts by telephone; or
C.
Six full days have elapsed since a letter, postage fully prepaid, addressed to such person at his last known
address, and informing such person of the whereabouts of his dog, has been deposited in the United States Mail.

§ 9.01.370 POUND CHARGES AND BOARDING CHARGES; DOGS.
A. Pound charges. The Poundmaster may make such charges as provided by resolution of the City Council for
impounding and caring for dogs. Before an impounded dog is released from the pound to anyone, that person shall pay t
pound charges and show proof that the dog is currently licensed and currently vaccinated against rabies. ('65 Code, § 5-
44) (Ord. No. CS-950 § 3)
B. Additional charges.
The Poundmaster may charge a fee for the care and feeding of each dog impounded pursua
to the provisions of this Chapter, excluding the day on which it is impounded, and in addition may charge for the giving
of notice of the impounding of any dog, in the amount of its actual cost. A charge may be made by the poundkeeper for
the impounding and boarding of other animals in the amount of actual reimbursement. ('65 Code, § 5-45) (Ord. No. CS-
415 §7.16)
§ 9.01.375 CONFINEMENT OF DOGS AFFLICTED WITH RABIES.
In the event the County Health Officer finds that any dog is afflicted with rabies, the Poundmaster or poundkeeper
shall confine it as directed by the Health Officer.

§ 9.01.380 VACCINATION AND RE-VACCINATION REQUIREMENTS.
A. Vaccination requirements. It shall be unlawful for every person keeping, harboring or having any dog over fou
months of age in the City without having it vaccinated with rabies vaccine by a person licensed by the State of Californi.

B. Re-vaccination requirements. Every person keeping, harboring or having a dog in the City which has been
vaccinated with chick embryo vaccine shall cause such dog to be revaccinated within a period of not more than two year
after such prior vaccination. When tissue phenolized vaccine has been used, each dog shall be revaccinated within a
period of not more than one year after a prior vaccination. ('65 Code, § 5-48) (Ord. No. CS-415 §§ 8.1, 8.2)
§ 9.01.385 VETERINARIAN CERTIFICATE TO OWNER.
Every Veterinarian who vaccinates a dog with rabies vaccine shall issue to the person to whom he delivers the dog, ai
original and a duplicate original of a certificate signed by him which states:
A. Name and address of the owner or harborer of the vaccinated dog.
B. Kind of vaccine used, name of the manufacturer and the manufacturer's serial or lot number, and date of
vaccination.
C. Breed, age, color, and sex of the vaccinated dog.

§ 9.01.390 EXEMPTION FOR LOCAL LAW ENFORCEMENT AGENCY DOGS.
Notwithstanding any other Section of this Chapter or Code, the regulations regarding licensing of dogs, dogs at large,
dogs on private property, and dogs in a public park or other public areas are not applicable to a dog which is part of a
canine program within a local law enforcement agency while such dog's activity is directly or indirectly related to the
canine program and the dog is on active duty with the local law enforcement agency.

Akil Manley, Management Analyst gave the staff report.
Following discussion, Councilmember Malsin proposed the following motion:
That the City Council support Version "A" of the proposed animal control
ordinance; that the ordinance would be effective on July 1, 2007; and would
include microchipping and mandatory alteration of cats.
Councilmember Rose seconded the motion.
Councilmember Gross expressed her opposition to mandatory alteration of cats
and dogs. Councilmember Gross proposed an amendment in which dogs be
altered after they have been caught for a second time.
Councilmember Malsin did not concur with Councilmember Gross amendment.

alteration, Councilmember Malsin proposed adding a breeder's exclusion similar
to what already exists in the County code regarding dogs.

Carol Schwab, City Attorney clarified that the City Council voted to introduce, for
first reading, Ordinance No. 2006-010, Version "A".
Heather Iker, Deputy City Attorney clarified that after completing further research,
staff would return to the City Council with an ordinance amending the City Code
to include the requirements of cat microchipping and cat alteration, because the
County does not require either as a part of Title 10 (Los Angeles County Animal
Control Ordinance).

The fees required to be paid for all services and activities set forth in Title 10 are as follows, except that the
director may waive any fees in cases of undue hardship:

All dogs and cats sold by the department are required
to be spayed or neutered as a condition of sale. The

fee for registration of discharged military dogs, for guide
