Nachbar (08/17/11) RECOMMENDATION: Staff recommends that the City Council: (1) accept the work performed by Creative Nile Builders, Inc.; (2) authorize the filing of a Notice of Completion; and(3) authorize the release of the retention payment for the El Marino Park Playground Rehabilitation Project, P-899, in the amount of $4,524.20 after the expiration of the 35-day lien period. BACKGROUND: On May 3, 2010, the City Council adopted the Youth Employment Plan for the Culver City Skate Park Fence Project, P-850, identifying El Marino Park Playground as an alternate youth employment site and thereby fulfilling the Los Angeles County Proposition A grant requirement related to the employment of youth for the Skate Park Fence Project. On February 14, 2011, the City Council approved the plans and specifications and authorized solicitation of bids for the El Marino Park Playground Rehabilitation Project, P-899. On May 2, 2011, the City Council awarded a construction contract to Creative Nile Builders, Inc. in the amount of $41,150 along with a $4,115 change order authority provided to the Parks Division Manager, for a total of $45,265. City of Culver City, California Agenda Item Report DISCUSSION: The El Marino Park Playground Rehabilitation Project included the demolition of the existing rubberized surfacing and playground structure for children ages 5 – 12 and installation of a new ADA ramp, two sumps and playground equipment. Pursuant to the Youth Employment Plan for P-850, the engineered wood fibar was installed by California Conservation Corps. Construction of the playground began on June 1, 2011 and the new playground was opened for public use on July 1, 2011. Punch list items were completed, and Creative Nile Builders, Inc.’s work was accepted as complete by the Parks Manager on August 8, 2011. Construction management was done by City staff, and the playground was audited and certified by Playground Safety Analysts. FISCAL ANALYSIS: Funds from the Capital Improvements & Acquisitions Fund (420) and the Park Facilities Fund (419) were allocated for this project. Fund 419is funded by development (Quimby – Park In Lieu) fees.Three change orders were issued for this project; the final Creative Nile Builders, Inc. contract amount was $45,242.00. There are currently adequate funds available in the budget of account number 41900899.730100 to pay retention to Creative Nile Builders, Inc. in the amount of $4,524.20. MOTIONS: That the City Council: 1. Accept the work performed by Creative Nile Builders, Inc. for the El MarinoPark Playground Rehabilitation Project, P-899; and, 2. Authorize the Parks Division Manager to execute the Notice of Completion and submit it to the Los AngelesCounty Recorder’s Office; and, 3. Authorize the City Manager to release $4,524.20 in retention funds to Creative Nile Builders, Inc. after the expiration of the 35-day lien period.
