RECOMMENDATION
Staff recommends the City Council (1) award a construction contract to Clarke Contracting Corporation (Clarke) in the amount of $343,600 for the Slope Repair Project Behind 9530 Jefferson Boulevard, CIP PP-022, as the lowest responsive and responsible bidder; and (2) authorize the Public Works Director to approve change orders in an amount not-to-exceed $22,668 (6.6% of total bid).
BACKGROUND/DISCUSSION
The slope behind the private property at 9530 Jefferson Boulevard is City-owned property as it is part of Culver City Park. The slope has been gradually sloughing due to heavy rains. This project will stabilize the slope using engineered mesh and soil nails.
The scope of the work includes:
* Clearing and grubbing the site
* Remedial grading
* Installing engineered mesh with soil nails
* Vegetating the slope with a seed mix of native California plants
On November 13, 2025, five bids were received:

HZS Construction $217,570
Clarke Contracting Corporation $343,600
Cerco Engineering $348,400

Horizon Design International $453,861
Staff reviewed the contractor bid documents and determined that Clarke Contracting Corporation submitted the lowest responsive total base bid. Staff reviewed the bid proposal and found the bid documents responsive and complete. Staff also contacted the references listed in the bid documents and determined that Clarke is a well-established contractor that has completed numerous similar projects in cities throughout Southern California, consistently delivering satisfactory performance. Clarke Contracting is on the City Council approved on-call emergency repair list for sewer repairs.
Although HZS Construction (HZS) submitted the lowest bid, HZS notified staff they had made a clerical error in their bid which would have made their bid much higher. Based on this error, HZS formally requested bid relief.
According to the California Public Contract Code, a bidder may be relieved if the following criteria are met:
* A mistake was made
* A request is made in writing by the bidder to the City requesting bid relief within 5 working days of the bid opening
* The mistake would have made the bid significantly different than the bidder intended
* The error was clerical.
Upon review of the documents submitted by HZS, staff has determined that all criteria were satisfied.

The Adopted Budget for Fiscal Year 2025-2026 includes sufficient funding for this contract in CIP Project PP-022 (Assessment of Culver City Park Hillside Slope) which can be found in the Capital Improvements section of the budget book under General Fund Facility Planning Reserves (Fund 420F) on page 592.

That the City Council:
1. Award a construction contract to Clarke Contracting Corporation, as the lowest responsive and responsible bidder, in the amount of $343,600 for the Slope Repair Project Behind 9530 Jefferson Boulevard, CIP PP-022; and,
2. Authorize the Public Works Director to approve change orders in an amount not to exceed $22,668;
3. Authorize the City Attorney to review/prepare the necessary documents; and,
4. Authorize the City Manager to execute such documents on behalf of the City.
