RECOMMENDATION
Staff recommends the City Council adopt a resolution establishing an initial permit application fee and an annual permit renewal fee for establishments engaged in the business of selling, leasing or otherwise transferring firearms and ammunition in the City.
BACKGROUND
On December 12, 2022, the City Council adopted Ordinance No. 2022-010, codified as Culver City Municipal Code (CCMC) Chapter 11.19, which requires that each establishment engaged in the business of selling, leasing or otherwise transferring firearms and ammunition in the City of Culver City (City) obtain a regulatory permit.
CCMC Section 11.19.025 specifies that “[e]ach application for a regulatory permit shall be accompanied by a nonrefundable fee for administering this Chapter as established by City Council resolution.” This is the initial permit application fee.
CCMC Section 11.19.065.B specifies that “[a] permit may be renewed for additional one (1) year period if the Permittee submits a timely application for renewal, accompanied by a nonrefundable renewal fee established by City Council resolution.” This is the annual permit renewal fee.
Staff has developed an initial permit application fee and an annual permit renewal fee for firearms and ammunition retailer establishments, based on recovery of the City’s reasonable costs to administer CCMC Chapter 11.19. Such costs include staff time to review of all application materials, investigations and inquiries into the information where applicable, site inspections, and permit issuance.
DISCUSSION
The proposed initial permit application fee and annual permit renewal fee for firearms and ammunition establishments is $1,681. This fee will recover the staff costs associated with administering Chapter 11.19 “Firearms and Ammunition Retail Establishments”. The fee is the same for the initial permit application fee and the annual renewal fee because the review process for (and thereby the staff time spent on) the initial permit application and annual permit renewal is the same.
Staff previously sent the City’s two existing firearms and ammunition retailers a letter about the new permit requirements applicable to their business, and has followed-up with them to ensure they are aware of the City’s new requirements. Staff has also been working to develop the permit application and expects firearms and ammunition establishments to be able to apply for a permit sometime in June, 2023. Ordinance 2022-10 (Chapter 11.19) became effective on January 11, 2023 (30 days after the adoption of the Ordinance). The Ordinance specifies that a person engaged in the business of selling, leasing, or otherwise transferring any firearm or ammunition on January 11, 2023 shall, within 180 days of the effective date, comply with Chapter 11.19. Accordingly, the last day for the City’s existing firearms and ammunition establishments to come into compliance with the permit requirements in Chapter 11.19 is July 10, 2023.
FISCAL ANALYSIS
There are currently two firearms and ammunition retail establishments in Culver City. Therefore, it is anticipated that the fees will generate annual General Fund revenue of $3,362.
