Noller) (07/29/09) Executive Director Approval: Mark Scott (07/29/09) RECOMMENDATION: Staff recommends the Redevelopment Agency Board (Agency) approve the first amendment (Amendment) to the Professional Services Agreement (Agreement) with Parsons Brinckerhoff Americas, Inc., for an amount not to exceed $5,000 for sound and vibration analysis and technical advice to the City related to the design of the Exposition Light Rail Transit (LRT) project and its potential impact on the City and community. BACKGROUND: On October 15, 2007, the Redevelopment Agency Board approved an Agreement with Parsons Brinkerhoff Americas, Inc., for an amount not to exceed $15,000 for consulting services related to the LRT project terminating at the future Washington/National station. The Agreement was executed March 21, 2008, and designated No. RA-2008-06. The Agreement allows staff to utilize Parsons Brinkerhoff’s services on an as-needed basis, expiring when cancelled by the Agency or when funding has been exhausted. DISCUSSION: Due to concerns over potential sound impact to the nearby residential area of Fay Avenue, the City has requested that Expo extend the LRT project’s sound wall approximately 150 feet onto the elevated structure adjacent to Syd Kronenthal Park. Expo has denied this request and the City plans to appeal. In preparation for and in City of Culver City, California Agenda Item Report support of the proposed appeal, a sound and vibration analysis must be conducted by a qualified acoustical engineer. The City and Agency have been using Rob Greene, INCE, a Board Certified Acoustics-Vibration-Air Quality TRC Manager, as a sound and vibration consultant since March, 2005. Mr. Greene is employed by Parsons Brinkerhoff Americas, Inc. The specialized expertise of Mr. Greene and Parsons Brinkerhoff will be crucial to the City and Agency during this appeal process. The original contract amount is insufficient to fund the additional services required by the City’s appeal. If approved, Paragraph A of Exhibit B of RA-2008-06 will be amended to read: AMOUNT OF COMPENSATION. For performing and completing all work and services described in Exhibit A, and for providing all materials required thereof, City shall pay Consultant a fee not to exceed a total of Twenty Thousand Dollars ($20,000.00). FISCAL ANALYSIS: The original contract with Parsons Brinkerhoff Americas, Inc., is for an amount not to exceed $15,000.00. The additional $5,000.00 requested in the Amendment will bring the total amount allocated to a not to exceed amount of $20,000.00. Adequate funds exist in Agency Account 59190400.619800 “Other Contractual Services” to fund this amendment. ATTACHMENTS: None. MOTION: That the Redevelopment Agency Board: 1. Approve the First Amendment to the Professional Services Agreement with Parsons Brinckerhoff Americas, Inc., for a Not to Exceed Amount of $5,000 for Consulting Services Related to the Exposition Light Rail Transit Project, raising the cumulative not to exceed amount for Contract No. RA-2008-06 to $20,000.00; and, 2. Authorize the Agency General Counsel to review/prepare the necessary documents; and, 3. Authorize the Executive Director to execute such documents on behalf of the Agency.
